    Application of Law 91-73, in particular Article 27, as amended by Article 10 of Law 91-1241. The government is committed to a plan to improve the management of the state's senior management. This plan constitutes a coherent whole and includes both human resources management measures and the improvement of the condition of the state's senior management. From the outset, the question of the transposition of certain measures to the military function was raised by the Ministry of Defence in order to avoid dropping out of the social status of general officers, or assimilates, in relation to their counterparts Officials, in the name of the very principle of transposition contained in the general status of the military in 1972. For senior military occupations, the idea has been to move towards parallelism with the measure of the new index improvement (NBI) for civilian bodies.     The Prime Minister,
    On the report of the Minister of Defence, the Minister of The economy, finance and industry and the Minister of the Public Service and the reform of the state,
    In view of the Civil and Military Pension Code;
    In the light of Law No. 72-662 of 13 July 1972 on the General Status of the Military;
    Given Law No. 91-73 of 18 January 1991, in particular Article 27, as amended by Article 10 of Law No. 91-1241 of 13 December 1991, concerning public health and social insurance provisions;
    In view of Decree No. 48-1108 of 10 July 1948 amending the hierarchical classification of the ranks and jobs of the civil and military personnel of the State under the general pension scheme;
    Given the amended Decree No. 82-1105 of 23 December 1982 on the indices From the public service,

    A new index bonus, taken into account and subject to contribution for the calculation of superannuation, may be paid monthly, within the limits of available credits, to members of the military Activity exercising a higher responsibility function set out in the schedule to this Order.

    The benefit of the new index bonus is related to the performance of duties. It shall not be paid to the incumbents' occasional alternates or cumulate with other indicial bonuses of any other nature which may be perceived by the member performing duties in the new Index enhancements under this Order.

    The amount in points plus the new index bonus and the number of posts for each function mentioned in the annex are fixed by joint order of defence ministers, Budget and public service.

    The start and end of assignment in one of the jobs eligible for the new index bonus is the subject of individual decisions by the Minister of Defence or a delegated authority. These decisions specify the start and end dates for the collection of the new index bonus. They shall be notified to the parties concerned.

    The new index bonus awarded to members is taken into account for premiums and allowances only for the purposes of calculating the residence allowance and the family pay supplement.

    This Order takes effect on January 1, 2002.
