Describes:
Article 4 of the Decree of 2 August 1985 is amended as follows:
I.-In the first paragraph, the words: Three years renewable " Are replaced by the words: " Four years renewable once ".
II. -The 1 is replaced by the following:
" 1. A member of the law: the Director General of the National Centre for Scientific Research or his representative. "
III. -In 2, the words: National education " Are replaced by the words: " Higher education " And the words: " Posts and telecommunications " Are replaced by the words: " Telecommunications ".
IV. -It is added at the end of 2 a sentence so written:
" Such representatives may, in the event of absence or incapacity, be replaced by a designated alternate under the same conditions as the holder. "
V.-The 4 is replaced by the following:
" 4. Four representatives of the staff of the Institute or their alternates, including two researchers, elected for a term of four years, renewable once, in accordance with arrangements laid down by the Minister for Research and the Minister responsible for Industry. "
VI. -In the thirteenth paragraph, the words: For three years " Are replaced by the words: " For a term of four years renewable once ".
VII. -In the fourteenth paragraph, after the words: " The Chairman of the Scientific Council, " Are added the words: " The Assistant Director General, ".
VIII. -The sixteenth paragraph is repealed.
IX. -The second sentence of the last paragraph is replaced by the following:
" However, their travel and subsistence expenses may be reimbursed under the conditions laid down in the rules applicable to State officials. "
Article 5 of the Decree of 2 August 1985 superseded by the following provisions:
" 1 ° General measures concerning the organisation of the institute and its rules of procedure; '.
The third paragraph of Article 6 of the Decree of 2 August 1985 is replaced by the following provisions:
" The proceedings shall be taken by a majority of the votes cast. In the event of an equal division of votes, the President shall have the casting vote. "
After article 8 of the decree of 2 August 1985, it is inserted an article 8-1 thus written:
" Art. 8-1. -An external evaluation committee composed of French and foreign scientific personalities external to the Institute shall evaluate the activities of the Institute in accordance with modalities defined by the Governing
. The members of this committee shall be appointed by the President of the Institute on the proposal of the Management Board, after consulting the Scientific Council. "
The fourth to thirteenth paragraphs of Article 9 of the Decree of 2 August 1985 are replaced by the following provisions:
" The Board shall comprise eleven qualified persons, including at least one foreign national, appointed by joint order of the Minister for Research and the Minister responsible for Industry, including:
" 1 ° Two personalities from the computer and automatic industry proposed by the minister responsible for industry;
" 2 ° Two personalities chosen from the computer and automatic users proposed by the minister responsible for industry;
" 3 ° Three scientific personalities proposed by the Minister responsible for research;
" 4 ° Three scientific personalities proposed by the Minister responsible for higher education;
" 5 ° A scientific personality proposed by the Minister of
. It also includes four staff members of the Institute or their alternates, including three researchers, elected by staff. The arrangements for the holding of elections and the arrangements for the replacement of elected members shall be laid down by the rules of procedure of the
. The term of office of the members of the Scientific Council shall be four years, renewable
. The President, chosen from among the qualified persons mentioned above, shall be appointed by joint order of the Minister for Research and the Minister responsible for
. Members who have resigned or died or who no longer carry out the duties under which they were appointed must be replaced. In this case, the terms of office of the new members shall expire on the date on which the members they replace would normally have terminated.
" The functions of members of the scientific council are free of charge. However, their travel and subsistence expenses may be reimbursed under the conditions laid down in the rules applicable to State officials. "
Article 10 of the decree of 2 August 1985 referred to above is amended as follows:
I.-The third, fourth and fifth paragraphs of Article 10 are replaced by the following:
A.-Sixteen scientists appointed by the President of the Institute, half of them on the proposal of the Chairman of the Scientific Council:
" 1 ° Eight persons or their alternates exercising their functions within the Institute;
" 2 ° Eight personalities outside the Institute.
" B.-Sixteen members or their alternates elected by and among the staff of the institution. The arrangements for the organisation of elections and the arrangements for the replacement of elected members shall be laid down in the rules of procedure of the Institute. "
II. -Added a last paragraph as follows:
" The term of office of the members and the chairman of the committee shall be renewable for three years. Members who have resigned or died or who no longer carry out the duties under which they were appointed must be replaced. In this case, the terms of office of the new members shall expire on the date on which the members they replace would normally have ceased. "
Article 13 of the aforementioned decree of 2 August 1985 is repealed.
After Article 16 of the aforementioned decree of 2 August 1985, a Article 16-1 reads as follows:
" Art. 16-1. -This Decree may be amended by decree in the Council of State with the exception of provisions relating to the term of office of the President of the Institute. "
The members of the Management Board in office on the date of publication of this Decree shall be held in office until the establishment of the Management Board, which shall take action within a period of six Months from this date of publication.
The members of the Joint Technical Committee in office on the date of publication of this Decree shall be held in office until the establishment of the Joint Technical Committee, under conditions Pursuant to the aforementioned decree of 28 May 1982, which must take place within six months of this date of publication.
Members of the Scientific Council and members of the Evaluation Commission on the basis of the date of publication Of this Decree shall remain in office until the establishment of the Scientific Council and the Evaluation Commission in accordance with the conditions laid down in this Decree and no later than the date set for the end of their Mandate.
The Prime Minister, the Minister of Economy, Finance and Industry, the Minister of Public Service and Government Reform, the Minister of Research, the Minister Delegate to Industry, Small and medium-sized enterprises, trade, craft and consumer affairs and the Secretary of State for the budget shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the Republic French.
