Summary

The organization and the The operation of the National Institute for Computer and Automatic Research (INRIA) was established by Decree 85-831 of 2 August 1985.In order to be consistent with the provisions adopted for the National Centre for Scientific Research, Measures implemented as a result of the guidelines set out by the Interdepartmental Committee on Scientific and Technical Research (ICSID) of July 1998, several adjustments to this decree are proposed. Set a term of four years, renewable once, the term of office of the President of the Institute, as well as that of the members of the Board of Directors and the members of the Scientific Council. The choice of four years for the term of office of the President justifies the raising of this Decree at the level of an Order in Council of Ministers, taking into account the provisions of Decree 79-153 of 26 February 1979 on the duration of the functions of the Presidents and heads of state institutions, state-owned enterprises and national corporations and certain public agencies. Other changes are proposed. These concern the Administrative Council, the Scientific Council, the Evaluation Commission and the Technical Committee. With regard to the Management Board, it is envisaged that the seat of the President of the Agency should be abolished. Informatics (this agency no longer exists), the replacement of representatives of the State and the Director General of the National Centre for Scientific Research and the participation of the Deputy Director General in meetings of this body. In addition, certain names of represented departments are updated. Finally, it seems desirable to mention expressly, among the tasks of the board of directors, that it deliberates on the rules of procedure of the institute. For the Scientific Council, several arrangements are proposed allowing the Appointment of persons of foreign nationality to the Council and amending the methods of appointment of persons serving in that body, the choice of its President and the representation of the Minister of Defence. In addition, as in the case of the Management Board, it is foreseen that a corporate name should be updated. Finally, it will be strengthened, the deconcentration of administrative acts towards the establishment by setting the rules for the election of the members elected to the supervisory board at the level of the interior. To evaluate the research teams and scientific staff, it is proposed, as provided for in the four-year contract of the establishment, that the number of members of this body be increased from twelve to sixteen in the college of Members appointed as members of elected members. In addition, it is proposed to indicate in the statutory decree the duration of the terms of office of the members of that committee. For the Joint Technical Committee, it is intended to delete the Article on the derogations for the appointment of representatives Members of the Joint Technical Committee, since this article has been moot since the establishment of joint administrative committees. In accordance with the amended decree 82-452 of 28 May 1982 relating to joint technical committees, representatives of staff can now be appointed by the representative trade unions and not elected by the whole of the Agents. A transitional provision shall be introduced, taking into account the adjustments made to these four bodies, providing for the maintenance of the members on the basis of the date of publication of this Decree, until the establishment of the bodies concerned, New measures. Finally, it is proposed that the Management Board may decide to set up an external evaluation committee, composed of French and foreign scientific personalities, to evaluate the activities of the Institute. In the light of the law n ° 82-610 of 15 July 1982 amended policy and programming for the research and technological development of France;

Article 4 of the Decree of 2 August 1985 is amended as follows:
I.-In the first paragraph, the words: Three years renewable " Are replaced by the words: " Four years renewable once ".
II. -The 1 is replaced by the following:
" 1. A member of the law: the Director General of the National Centre for Scientific Research or his representative. "
III. -In 2, the words: National education " Are replaced by the words: " Higher education " And the words: " Posts and telecommunications " Are replaced by the words: " Telecommunications ".
IV. -It is added at the end of 2 a sentence so written:
" Such representatives may, in the event of absence or incapacity, be replaced by a designated alternate under the same conditions as the holder. "
V.-The 4 is replaced by the following:

VIII. -The sixteenth paragraph is repealed.
IX. -The second sentence of the last paragraph is replaced by the following:

The fourth to thirteenth paragraphs of Article 9 of the Decree of 2 August 1985 are replaced by the following provisions:
" The Board shall comprise eleven qualified persons, including at least one foreign national, appointed by joint order of the Minister for Research and the Minister responsible for Industry, including:

Article 10 of the decree of 2 August 1985 referred to above is amended as follows:
I.-The third, fourth and fifth paragraphs of Article 10 are replaced by the following:
A.-Sixteen scientists appointed by the President of the Institute, half of them on the proposal of the Chairman of the Scientific Council:
" 1 ° Eight persons or their alternates exercising their functions within the Institute;
" 2 ° Eight personalities outside the Institute.
" B.-Sixteen members or their alternates elected by and among the staff of the institution. The arrangements for the organisation of elections and the arrangements for the replacement of elected members shall be laid down in the rules of procedure of the Institute. "
II. -Added a last paragraph as follows:
" The term of office of the members and the chairman of the committee shall be renewable for three years. Members who have resigned or died or who no longer carry out the duties under which they were appointed must be replaced. In this case, the terms of office of the new members shall expire on the date on which the members they replace would normally have ceased. "

" Art. 16-1. -This Decree may be amended by decree in the Council of State with the exception of provisions relating to the term of office of the President of the Institute. "

The members of the Management Board in office on the date of publication of this Decree shall be held in office until the establishment of the Management Board, which shall take action within a period of six Months from this date of publication.
The members of the Joint Technical Committee in office on the date of publication of this Decree shall be held in office until the establishment of the Joint Technical Committee, under conditions Pursuant to the aforementioned decree of 28 May 1982, which must take place within six months of this date of publication.
Members of the Scientific Council and members of the Evaluation Commission on the basis of the date of publication Of this Decree shall remain in office until the establishment of the Scientific Council and the Evaluation Commission in accordance with the conditions laid down in this Decree and no later than the date set for the end of their Mandate.
