Abstract

Modification of the art. 1 of the Order of 25-03-1999; s. 4, 5, 7, 9 and the Annex to the decree of 08-03-2001 laying down the conditions for the elaboration of the authorisations provided for in Decree 2001-143; Art. 2 and 9 of the decree of 08-03-2001 laying down the conditions for the preparation of declarations provided for in Decree 2001-143 and of Art. 1 of the Order of 13-11-2001.

The Minister of Economy, Finance and The industry,
In view of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, made in Paris on 13 January 1993;
In view of Law No. 98-467 of 17 June 1998 on The application of the Convention of 13 January 1993 on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction;
Law No. 2001-398 of 9 May 2001 establishing a French Agency for Environmental health safety;
In light of the amended Decree No. 93-1272 of 1 December 1993 on the organization of the central administration of the Ministry of Industry, Posts and Telecommunications and Foreign Trade;
Seen Decree No. 99-64 of 27 January 1999 concerning certain systematic international verifications, provided for by Law No. 98-467 of 17 June 1998 on the application of the Convention of 13 January 1993 on the prohibition of development, of The manufacture, storage and use of chemical weapons and their destruction;
In view of Decree No. 2001-143 of 15 February 2001 concerning the implementation of the provisions of Title II of Law No. 98-467 of 17 June 1998 on the application of The Convention of 13 January 1993 on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction;
In light of Decree No. 2001-269 of 26 March 2001 concerning inspections by means of Remains provided for in Title III of Act No. 98-467 of 17 June 1998 on the application of the Convention of 13 January 1993 on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction;
In light of Decree No. 2002-254 of 22 February 2002 on the Institute for Radiation Protection and Nuclear Safety;
In the light of the decree of 25 March 1999 on certain systematic international audits carried out pursuant to the Convention of 13 January 1993 on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction and as provided for in Decree No. 99-64 of 27 January 1999;
In view of the Order of 8 March 2001 as amended Laying down the conditions for drawing up the authorisations provided for by Decree No. 2001-143 of 15 February 2001 concerning the implementation of the provisions of Title II of Act No. 98-467 of 17 June 1998 on the application of the Convention January 1993 on the prohibition of the development, manufacture, stockpiling and use of chemical weapons and on their destruction;
In view of the Decree of 8 March 2001 laying down the conditions for the preparation of declarations provided for by the Decree No. 2001-143 of 15 February 2001 concerning the implementation of the provisions of Title II of Act No. 98-467 of 17 June 1998 on the application of the Convention of 13 January 1993 on the Prohibition of the Development, Production, The storage and use of chemical weapons and their destruction;
In view of the Order of 13 November 2001 laying down various provisions relating to the implementation of Decree No. 2001-269 of 26 March 2001 concerning inspections by formal notice In Title III of Act No. 98-467 of 17 June 1998 on the application of the Convention of 13 January 1993 on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction,
Stop :

Article 1


The first paragraph of Article 1 of the above decree of 25 March 1999 reads as follows:
" Attendants, including the head of the escort team, of an international audit, as defined in Article 1 of the aforementioned Decree of 27 January 1999, shall be appointed by the Associate Deputy Director General for the tasks covered by the The defence, of the Institute for Radiation Protection and Nuclear Safety, among the personnel on a list drawn up by the senior defence official to the Minister responsible for industry. Article 2


The order of 8 March 2001 which defines the conditions for the elaboration of authorisations is thus amended:
I. - The first paragraph of Article 4 reads as follows:
" The requests for authorisation provided for in Articles 2 and 3 of this Order shall be sent, by registered letter with acknowledgement of receipt, to the Minister of Economy, Finance and Industry, Senior Defence Officer, Security Service of the Economic and nuclear infrastructure, hereinafter referred to as "HFD/SIEN" (1), accompanied by a file in three copies, including one original, which includes: "
II. -In Articles 5, 7 and 9, the term: CMN service " Is replaced by: " HFD/SIEN ".
III. -References (1) and (2) read as follows:
" (1) Address of HFD/SIEN: Ministry of Economy, Finance and Industry, Senior Defence Officer, Economic and Nuclear Infrastructure Security Service, 20, avenue de Ségur, 75353 Paris 07 SP (Telephone: 01-43-19-51-00; Fax: 01-43-19-50-61).
" (2) The Annex to this Order may be consulted with the HFD/SIEN (1) and may be requested, as well as the relevant destatement manual, at the Institute for Radiation Protection and Nuclear Safety, Directorate of Nuclear Defence Expertise (service Application of International Controls), PO 17, 92262 Fontenay-aux-Roses Cedex (Telephone: 01-58-35-85-24; Fax: 01-46-54-34-63). "

Article 3


The above-mentioned order of 8 March 2001 defines the conditions for the preparation of declarations:
I. - Article 2 of Article 2 reads as follows:
" 1 ° Operators of facilities subject to " annual reporting of past activities addressed to the Institute for Radiation Protection and Nuclear Safety (1), hereinafter IRSN, by 31 January at the latest, a declaration Past activities for the previous calendar year. This declaration shall contain the information provided for in Annex 1 to this Order; "
II. -In Article 2 and Articles 3 to 10, the term: IPSN " Is replaced by: " IRSN ".
III. -The first paragraph of Article 9 reads as follows:
" Where a supplier wishes to benefit from the provisions of the second paragraph of Article 30 of the aforementioned decree of 15 February 2001, he shall communicate, by registered letter with acknowledgement of receipt, the exact composition of the mixture concerned to the Minister of Economy, finance and industry, senior defence official, economic and nuclear infrastructure security service (2). "
IV. -References (1), (2) and (3) read as follows:

" (3) The annexes to this Order may be consulted with the Senior Defence Officer, Economic and Nuclear Infrastructure Security Service (2), and may be requested, as well as the related declarations manuals, at The Institute for Radiation Protection and Nuclear Safety (1). "

Article 4


The order of 13 November 2001 is thus amended:
I.-The second paragraph of Article 1 reads as follows: :
" Such staff shall be selected from among officials and agents of the State placed under the authority of the Minister responsible for industry and among the agents of the Institute for Radiation Protection and Nuclear Safety proposed by the Deputy Director General Delegate for defence missions. "
II. -Reference (1) reads as follows:
