In view of the deliberation of the municipal council of Durtal on November 14, 2001 approving the zone management plan of the ZAC of the Val d' Argance ;
Given the deliberation of the Municipal Council of Durtal on November 14, 2001, requesting the initiation of joint public utility and piecemeal investigations;
Given the prefectural order of 12 September 2002 prescribing the initiation of investigations Joint prior to the declaration of utility and parcellar on the proposed development of the ZAC of the Val d' Argance;
In view of the documents of the investigation to which it was carried out from 21 October to 22 November 2002, together the unfavourable opinion of the Investigating Commissioner;
In view of the deliberation of the Municipal Council of Durtal on 19 February 2003 deciding on the continuation of the public utility declaration procedure for its draft before the Council of State;
Given the document dated 27 October 2003 setting out the grounds and considerations justifying the public utility of the Val d' Argance ZAC project (1);
The Conseil d' Etat (section of the interior) heard,
Describes:
Purchases and works necessary for the realization of the Val d' Val concerted development zone are declared of public utility Of Argance, situated in the territory of the municipality of Durtal, in accordance with the plan of 1/1000 annexed to this Decree (1).
The necessary expropriations shall be carried out within five years of the publication of this Order.
The Minister of the Interior, Internal Security and Local Freedoms and the Minister for Local Freedoms are each responsible for the execution of this Decree, which will be published in the Official Journal From the French Republic.
