Order of 21 March 2003 restricting the operation of the aerodrome of Toulouse-Blagnac (Haute-Garonne)

Secretary of State for Transport and the Sea,
In view of the International Civil Aviation Convention of 7 December 1944, together the Protocols which amended it, and in particular the Protocol of 24 September 1968 on the authentic trilingual text of the Convention on International Civil Aviation;
In the light of Council Regulation (EEC) No 2408/92 of 23 July 1992 Concerning the access of Community air carriers to intra-Community routes, and in particular Article 8.2;
In view of the Civil Aviation Code, in particular Articles L. 227-4 and R. 221-3;
In view of the environmental code, in particular Article L. 571-13;
Having regard to the order of 17 July 1992 on general air traffic procedures for the use of aerodromes by aircraft;
Having regard to the order of 12 May 1997 on technical operating conditions Aircraft by a public air transport undertaking (OPS1);
In view of the opinion of the Environmental Advisory Committee of the aerodrome of Toulouse-Blagnac as of 26 June 2002;
In view of the opinion of the Noise Control Authority Airports as of October 18, 2002,

Item 1


To reduce noise pollution around the Toulouse-Blagnac aerodrome, operating restrictions The following are decided on this platform:
I.-For the purposes of this Order, it is defined as:
- " Operator ", the operator of an aircraft;
-" The most noisy aircraft in Chapter 3, aircraft equipped with turbojet engines Whose sound certification meets the standards set out in Chapter 3 of Part Two of the first volume of Annex 16 to the Convention on International Civil Aviation of 7 December 1944 and which have a cumulative margin of Certified noise levels, relative to the allowable limits defined in this chapter, less than 5 EPNdB;
- " Noisy aircraft in Chapter 3 ", aircraft equipped with turbo-actors whose acoustic certification meets the standards Set out in Chapter 3 of Part Two of the first volume of Annex 16 to the Convention on International Civil Aviation of 7 December 1944 and which have a cumulative margin of certified noise levels, in relation to the limits Eligible defined in this chapter, greater than or equal to 5 EPNdB and less than 8 EPNdB;
- " Engine tests ", any operation carried out on an aircraft at the end of which its engines operate for more than five minutes or At a power greater than that used for the driving and driving sequences.
II. -Subject to the provisions laid down in III of this Article and in Article 4 of this Order, none of the most noisy aircraft in Chapter 3 can, on the Toulouse-Blagnac airfield:
-land between 22 hours and 6 hours, hours Local arrival on the parking area;
-take off between 22 hours and 6 hours, local hours of departure from the parking area.
On the same reservations and within the same time range, no noisy aircraft in Chapter 3 can Land or take off at the aerodrome of Toulouse-Blagnac, unless the operator of that aircraft can prove that the aircraft was operated on that aerodrome less than five years before the date of publication of this
. -On a transitional basis, the time range set out in II of this article shall extend to:
-from 23 hours to 6 hours between 30 March 2003 and 27 October 2003;
-from 22.30 to 6 hours between 28 October 2003 and 30 March
. -At landing, thrust reversers and propeller-pitch inverters can only be used beyond idling for operational and safety reasons.
V.-On the Toulouse-Blagnac aerodrome, no engine test May be performed between 22 hours and 6 hours, local hours.

Article 2


Subject to the provisions of Article 4 of the Order:
I.-Aircraft operating in accordance with the rules of flight to instruments must comply with the specific procedures developed with a view to limiting noise and brought to the attention of users by means of Aeronautical information.
II. -Crews must adhere to the operating manuals of operating manuals to minimize the sound impact of landings and takeoffs. These instructions shall be in accordance with ICAO PANS-OPS, Volume 1.
III. -Aircraft operating in accordance with visual flight rules shall comply with the specific instructions developed with a view to limiting noise and to the knowledge of users through aeronautical information.

Article 3


All operators engaged in commercial flights departing or arriving at the Toulouse-Blagnac aerodrome must publish, In their operating manuals, the classification of their aircraft in relation to the definitions contained in I of Article 1.

Article 4


I. -The provisions laid down in Articles 1 and 2 of this Order shall not preclude the landing or taking off, on an exceptional basis, of the following aircraft:
-aircraft performing health missions
-aircraft in emergency situations due to flight safety reasons;
-aircraft referred to in Article L. 110-2 of the Civil Aviation Code;
-aircraft engaged in government flights.
II. -The commander shall not depart from the rules laid down in Article 1 of this Order unless he deems it absolutely necessary for reasons of flight safety.

Article 5


A review of movements under Article 4 of this Order shall be presented by the Civil Aviation Services at each meeting of the Advisory Committee on The environment of the Toulouse-Blagnac aerodrome and made public at least once a year.

Article 6


The orders of 9 September 1998 and 31 August 1999 restricting the use of the aerodrome of Toulouse-Blagnac (Haute-Garonne) are repealed.

Article 7


Date Entry into force of this Order shall be fixed at 30 March 2003.

Article 8


The Director General of Civil Aviation and the Prefect of The Midi-Pyrénées region, prefect of the Haute-Garonne, is responsible, each as far as it is concerned, for the execution of this Order, which will be published in the Official Journal of the French Republic.
