Decree of 21 January 2004 on the system of noise emissions of devices intended for use outside buildings

The Minister of the Interior, Internal Security and Local Freedoms, the Minister for Social Affairs, Labour and Solidarity, the Minister of Equipment, Transport, Housing, Tourism and the Sea, Minister of Ecology and Sustainable Development, Minister of Health, Family and Disability, Minister Delegate to Budget and Reform Budget, the Minister responsible for Industry and the Secretary of State for Small and Medium Enterprises, Trade, Crafts, Liberal Professions and Consumer Affairs,
In view of Directive 2000 /14/EC of the European Parliament and of the Council of 8 May 2000 concerning the approximation of the laws of the Member States relating to noise emissions in the environment of material intended for use outside the buildings;
Having regard to Decree No. 95-79 of 23 January 1995 fixing the Requirements laid down in Article 2 of Law No. 92-1444 of 31 December 1992 on noisy objects and sound-proofing devices;
In the light of the amended order of 11 January 1972 to limit the noise level of air noise emitted By the engine or engines to be detonated by certain construction equipment;
In view of the Order of 7 November 1977 laying down the environmental conditions for the performance of noise level measurements of aerial noise emitted by construction equipment;
Vu The order of 3 July 1979 laying down the general code of measurement relating to the air noise emitted by construction equipment and construction equipment;
In the light of the amended Order of 17 June 1987 on the permissible sound level of lawnmowers;
In view of the order of 12 May 1997 laying down the common provisions applicable to construction equipment and construction equipment;
In view of the decree of 12 May 1997 on the limitation of the sound emissions of tower cranes;
Having regard to the order of 12 May 1997 concerning the limitation of Noise emissions from motocompressors;
In view of the decree of 12 May 1997 on the limitation of noise emissions of power generators;
In view of the decree of 12 May 1997 on the limitation of the noise emissions of groups Welding electrogenes;
In view of the decree of 12 May 1997 on the limitation of noise emissions from piercing hammers and concrete breakers;
In the light of the decree of 12 May 1997 on the limitation of the sound emissions of hydraulic shovels, of Cable shovels, mufflers, loaders, and loaders;
In view of the March 18, 2002 issue of noise emissions from materials intended for use outside buildings,

Item 1
The provisions of the amended decree of 11 April 1972 are no longer applicable to the following devices in accordance with the provisions concerning the decree of 18 March 2002:
-monte-materials ;
-vibrating and non-vibrating compactors;
-vibrating plates;
-vibrating pushers;
-site winches;
-power-washers less than 500 kW;
-power graders less than 500 kW;
-hydraulic groups;
-backfill and bucket waste compactors, loader type, power less than 500 kW;
-all-terrain fork-lift trucks;
-mobile cranes;
-finishers, excluding the Finishers equipped with a beam with a high compaction capacity.
The provisions of the amended Order of April 11, 1972, relating to construction equipment equipped with an explosion or internal combustion engine other than those cited Above are repealed.

The provisions referred to in the following orders are no longer applicable to devices in accordance with the provisions concerning the order of 18 March 2002:
-Order of 17 June 1987 as amended The permissible sound level of lawnmowers;
-adopted on 12 May 1997 laying down the common provisions applicable to construction equipment and construction equipment;
-adopted on 12 May 1997 on the limitation of noise emissions from cranes to Tower;
-order of 12 May 1997 concerning the limitation of noise emissions from motocompressors;
-order of 12 May 1997 concerning the limitation of noise emissions of power generators;
-order of 12 May 1997 Relating to the limitation of noise emissions of welding electrode groups;
-Order of 12 May 1997 on the limitation of noise emissions from piker hammers and concrete breakers;
-Order of 12 May 1997 on limitation Sound emissions from hydraulic shovels, cable shovels, balls, loaders and film loaders.
