Order of 3 February 2003 amending the Order of 23 November 1987 on the safety of ships

In light of the amended Order No. 84-810 of August 30, 1984, relating to the Protection of human life at sea, livability on board ships and pollution prevention;
In light of the amended Order of 23 November 1987 on the safety of ships;
In view of the opinions of the Central Safety Commission in its Session 754 as of January 7, 2003,

Item 1


Division 221 of the Regulations annexed to the Order of November 23, 1987 is amended as follows:
Is added a Chapter 221-XII, after Chapter 221-XI, written as follows:

"Article 221-XII/01
" Definitions


" For the purposes of this chapter:
A "bulk carrier is a bulk carrier as defined in item 221-IX/01, paragraph 6.
" A simple wallboard is a bulk carrier On board which a cargo hold is delimited by the wall edge.
" The "length of a bulk carrier is the length as defined in the International Convention on Current Load Lines.
" " Solid bulk cargo Means any cargo, other than liquid or gaseous, consisting of a mixture of particles, granules or larger pieces of material, of composition generally uniform and loaded directly into the cargo spaces of a ship, without Be retained by any intermediate device.

" The bulk carriers to which Article 221-XII/04 applies or Article 221-XII/06 shall comply with the provisions of those Articles in accordance with the following timetable, having regard to the enhanced inspection programme required by Article 221-XI/02 :
" 1. For bulk carriers aged twenty or more on 1 July 1999, on the date of the first intermediate visit or on the date of the first periodic visit scheduled after 1 July 1999, the closest to those two dates being retained;
" 2. For bulk carriers aged 15 or older but less than 20 years of age on 1 July 1999, on the date of the first periodic visit scheduled after 1 July 1999, but not later than 1 July 2002; and
" 3. For bulk carriers under fifteen years of age on July 1, 1999, on the date of the first scheduled visit after the date on which the vessel is fifteen years of age, but no later than the date on which the vessel will be seventeen years of age.


"Article 221-XII/04
"

" 1. Single wall bulk carriers, of a length equal to or greater than 150 m, constructed on or after July 1, 1999, which are designed to carry solid bulk cargoes of a density equal to or greater than 1 000 kg/m³, shall, When loaded at the summer load line, be able to resist the invasion of any of their cargo holds under all loading conditions and remain afloat in a satisfactory state of equilibrium, such as Specified in paragraph 3.
" 2. Subject to the provisions of paragraph 6, the state of equilibrium after flooding shall be in conformity with the steady state defined in the annex to resolution A. 320 (IX), a rule equivalent to rule 27 of the 1966 International Convention on Load lines, as amended by resolution A. 514 (13). In the invasion assumptions, only the cargo holds space can be considered to be invaded. The permeability of a loaded hold shall be considered as equal to 0.9 and the permeability of an empty hold at 0.95, unless a permeability specific to a particular cargo is taken into account for the volume of the invaded bilge which is Occupied by the cargo, with a permeability of 0.95 being retained for the remaining empty volume of this hold.
" 4. The bulk carriers built before 1 July 1999 to which a reduced freeboard was assigned pursuant to Rule 27.7 of the 1966 International Convention on Load Lines, as adopted on 5 April 1966, may be considered As satisfying the provisions of paragraph 2 of this Article.
" 5. The bulk carriers assigned a reduced freeboard pursuant to the provisions of paragraph 8 of the rule equivalent to Rule 27 of the International Convention on Load Lines, 1966, adopted by resolution A. 320 (IX), such as As amended by resolution A. 514 (13), may be regarded as satisfying the provisions of paragraph 1 or paragraph 2, as the case may
. 6. On board the bulk carriers assigned a reduced freeboard pursuant to the provisions of Rule 27.8 of Annex B to the 1988 Protocol Relating to the International Convention on Load Lines, the state of equilibrium after Invasion shall comply with the relevant provisions of the said Protocol.

" Requirements for

" 1. Single wall bulk carriers, of a length equal to or greater than 150 m, that carry solid bulk cargoes of a density equal to or greater than 1 780 kg/m³ shall comply with the requirements of this Article in accordance with the timetable Application specified in object 221-XII/03.
" 2. The water-tight transverse bulkhead that separates the two most forward cargo holds and the double bottom of the most forward cargo hold shall have sufficient strength to withstand the encroachment of the bilge. "Article 221-XII/08
" Compliance with
requirements for bulk carriers


" 1. The manual prescribed in Article 221-VI/07, paragraph 2, shall be the subject of the administration or its name so as to indicate that the provisions of Articles 221-XII/04 to 221-XII/07, as appropriate, are complied with.
" 2. Any restrictions on the carriage of solid bulk cargoes of a density equal to or greater than 1 780 kg/m³ in accordance with the requirements of Article 221-XII/06 shall be identified and recorded in the manual referred to in paragraph 1.
" 3. A bulk carrier to which paragraph 2 applies shall bear a permanent mark on the edge of the wall in the middle of the ship, on board and on starboard, consisting of an equilateral triangle full of 500 mm on the side whose vertex is 300 mm below Of the deck line and painted with a colour on the hull.

" Requirements for bulk carriers that cannot meet the requirements of Article 221-XII/4, paragraph 2, due to the construction characteristics of their cargo holds

" 1. The Administration may authorise a derogation from the application of Article 221-XII/04, paragraph 2, and Article 221-XII/06 for bulk carriers falling within the scope of Article 221-XII/04, paragraph 2, but which do not include a Sufficient watertight transverse bulkheads to meet the requirements, provided that these vessels meet the following requirements:
" 1. With regard to the most forward cargo hold, the inspections to be carried out as part of the annual inspection provided for in the reinforced inspection programme required by Article 221-XI/02 shall be replaced by the inspections This program requires the intermediate visit of cargo holds;
" 2. All cargo holds or cargo tunnels, as the case may be, shall be equipped with high-level alarms in the sumps that trigger an audible and visual alarm on the navigation bridge, as approved by The administration or an organization recognized by it in accordance with the provisions of Article 221-XI/01; and
" 3. These vessels must have detailed information on specific cases of cargo holds. "Article 221-XII/10
" Solid bulk cargo density declaration

Article 2


All provisions contrary to this Order are repealed.

Article 3


The Director of Maritime Affairs and Seafarers is responsible for the execution of this Order, which will be published in the Official Gazette of the Republic French.
