Decree n ° 2006-234 of 27 February 2006 for the application of Article L. 512-2 of the Social Security Code

The Prime Minister,
On the report of the Minister of Health and Solidarity,
In the light of the Social Security Code, in particular Article L. 512-2, As a result of article 89 of the Social Security Financing Act for 2006 (Act No. 2005-1579 of 19 December 2005);
Given the rural code;
Given the code of entry and residence of aliens and the right of asylum;
Vu The agreement between the Government of the French Republic and the Government of the People's Democratic Republic of Algeria on the movement, employment and residence of Algerian nationals and their families in France, signed in Algiers On 27 December 1968;
Having regard to Decree No. 74-449 of 15 May 1974 concerning the family register and the information of the intending spouses on family law, as amended by Decree No. 2002-1556 of 23 December 2002 and Decree No. 2004-1159 of 29 October 2004;
In view of the opinion of the Board of Directors of the National Family Allowance Fund as of 9 February 2005,
Décrète:

Item 1
It is inserted, in Chapter II of Title I of Book V of the Code of Social Security (part three: Orders), two articles D. 512-1 and D. 512-2 thus written:
" Art. D. 512-1. -Foreign nationals applying for family benefits justify the regularity of their stay by the production of one of the following valid residence permits or documents:
" 1 ° resident card;
" 2 ° Residence card Temporary;
" 3 ° Certificate of residence of Algerian national;
" 4 ° Renewal request receipt from one of the above titles;
" 5 ° Receipt of application for a residence permit valid for residence of a duration of Three renewable months with the words "recognized refugee;
" 6 ° Receipt of a request for a residence permit for a period of six months renewable with the words "alien admitted to the residence under asylum;
" 7 ° Provisional authorization of Stay longer than three months;
" 8 ° Monegasque passport bearing a mention of the Consul General of France in Monaco valid for residence;
" 9 ° Special Booklet, booklet or circulation book;
" 10 ° Receipt of Application for a residence permit valid for a period of validity of three renewable months issued in the context of the grant of subsidiary protection, together with the decision of the French Office for the Protection of Refugees and Stateless persons or the Refugee Board granting such protection.
" Art. D. 512-2. -The regularity of the entry and residence of foreign children that the beneficiary is dependent on and for which he claims family benefits is justified by the production of one of the following documents:
" 1 ° Birth certificate In France;
" 2 ° Certificate of medical supervision of the child, issued by the National Agency for the Reception of Foreigners and Migration at the end of the procedure for introducing or admitting residence for the purpose of family reunification;
" 3 ° Family Booklet issued by the French Office for the Protection of Refugees and Stateless Persons or, failing that, an act of birth, if any, established by that Office, where the child is a family member of a refugee, a stateless person or a beneficiary of Subsidiary protection. Where the child is not the child of the refugee, the stateless person or the beneficiary of the subsidiary protection, that act of birth shall be accompanied by a judgment giving the child's guardianship abroad who is seeking benefits Family;
" 4 ° Visa issued by the consular authority and containing the name of the child of a foreigner who holds the residence permit referred to in Article L. 313-8 or 5 ° of Article L. 313-11 of the code of entry and residence of aliens and The right to asylum;
5 ° Certification issued by the prefectural authority, stating that the child entered France at the latest at the same time as one of his parents admitted to stay on the basis of 7 ° of article L. 313-11 of the entry code And the stay of aliens and the right of asylum or the 5 ° of Article 6 of the Franco-Algerian Agreement of 27 December 1968, as amended;
" 6 ° residence permit issued abroad between sixteen and eighteen years of age under the conditions laid down in Article L. 311-3 The code of entry and residence of aliens and the right of asylum

Article D. 821-8 of the Social Security Code is replaced by the following:

"
