In view of Directive 2005 /36/EC of 7 September 2005 on the recognition of professional qualifications;
Having regard to the agreement of 2 May 1992 on the European Economic Area;
Having regard to the agreement of 21 June 1999 between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other part, on the free movement of persons;
Having regard to Directive No 2006/100 of 20 November 2006 adapting certain directives In the field of the free movement of persons as a result of the accession of Bulgaria and Romania;
Given the code of public health, in particular Articles L. 4221-4 and L. 4221-5,

Works in France from the profession of pharmacist to nationals of the Member States of the European Union, the States Parties to the Agreement on the European Economic Area and of the Confederation Swiss diplomas, certificates and other qualifications of a pharmacist issued by the former Czechoslovakia or which penalise a formation begun in that state before 1 January 1993, the date of the independence of the Czech Republic and of the Slovakia, if accompanied by:
(a) A certificate issued by the competent authorities of one of the two abovementioned Member States certifying that those diplomas, certificates and other qualifications have the same validity in their territory on the plan Legal as the titles they issue, in terms of access to the following professional pharmacist activities and their exercise:
-development of the pharmaceutical form of drugs;
-manufacturing and Drug control;
-drug control in a drug control laboratory;
-storage, storage and distribution of drugs at the wholesale stage;
-preparation, control, storage and Distribution of drugs in pharmacies open to the public;
-preparation, control, storage and dispensing of drugs in hospitals;
-dissemination of information and advice on drugs.
b) And Certificate issued by the same authorities stating that the persons concerned have effectively and lawfully exercised the activities in question in their territory for at least three consecutive years in the five years preceding the date of issue Certificate.
Works in France from the profession of pharmacist to nationals of the Member States of the European Union, the States Parties to the Agreement on the European Economic Area and of the Confederation Swiss diplomas, certificates and other titles of phramacian issued by the former Soviet Union or which sanction training begun in that State before 20 August 1991 for Estonia, 21 August 1991 for Latvia, 11 March 1990 For Lithuania, dates of their independence, if accompanied by:
(a) A certificate issued by the competent authorities of one of the three abovementioned Member States certifying that those diplomas, certificates and other qualifications have, on their Territory, the same legal validity as the titles which they issue, with regard to access to the following professional pharmacist activities and their exercise:
-development of the pharmaceutical form of the Drugs;
-drug manufacturing and control;
-drug control in a drug control laboratory;
-storage, storage, and distribution of drugs at the wholesale stage;
- The preparation, control, storage and distribution of medicines in pharmacies open to the public;
-preparation, control, storage and dispensing of medicinal products in hospitals;
-dissemination of information and advice on Medicinal products;
(b) and of a certificate issued by the same authorities stating that the persons concerned have effectively and lawfully carried out the activities in question in their territory for at least three consecutive years during the five years Before the date of issue of the certificate.
Works in France from the profession of pharmacist to nationals of the Member States of the European Union, the States Parties to the Agreement on the European Economic Area and of the Confederation Swiss diplomas, certificates and other qualifications of a pharmacist issued by the former Yugoslavia or which sanction training begun in that State before 25 June 1991, the date of the independence of Slovenia, if accompanied by:
(a) A certificate issued by the competent Slovenian authorities certifying that these diplomas, certificates and other qualifications have, in the territory of Slovenia, the same legal validity as Slovenian titles in pharmacy, in respect of which Is access to the following pharmacist activities as well as their exercise;
-drug formulation development;
-drug manufacturing and control;
-drug control in a laboratory Drug control;
-storage, storage and distribution of drugs at the wholesale stage;
-preparation, control, storage and distribution of drugs in pharmacies open to the public;
-preparation, Control, storage and dispensing of medicinal products in hospitals;
-dissemination of information and advice on medicinal products;
(b) and of a certificate issued by the same authorities stating that the persons concerned have in fact and Lawfully exercised the activities in question in the territory of Slovenia for at least three consecutive years in the five years preceding the date of issue of the certificate.
Open to the exercise in France of the profession of pharmacist, in accordance with the provisions of Article L. 4221-5 of the Public Health Code, diplomas, Certificates or other titles of pharmacist attesting to training started before the dates indicated below in the Member States of the European Union, the States Parties to the Agreement on the European Economic Area and the Swiss Confederation and Non-compliant with Community obligations:
1 October 1987 (entry into force of directives) for Germany, Belgium, Denmark, Ireland, Luxembourg, the Netherlands, the United Kingdom, Greece, Spain and Portugal;
1 November 1993 for Italy;
1 May 2004 (date of accession) for the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia;
1 January 2007 (date of accession) for Bulgaria and Romania;
1 January 1994 (date of entry into force of the Agreement on the European Economic Area) for Iceland, Liechtenstein and Norway;
1 October 1994 for Austria, Finland and Sweden (these three States Acceded to the European Economic Area prior to their accession, on 1 January 1995, to the European Union);
1 June 2002 (date of entry into force of the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other part) for Switzerland,
if accompanied by a certificate issued by the competent authorities of the States, members or parties, certifying that the persons concerned have effectively and lawfully devoted themselves to the Activities in question in the territory of these States for at least three consecutive years in the five years preceding the date of issue of the certificate.
The order of 9 September 1996 laying down the list of diplomas, certificates or other securities of pharmacist issued by the Member States of the European Community or parts thereof The agreement on the European Economic Area which may open the right to the exercise of the profession of pharmacist in France to nationals of the said States is repealed.
The Director General of Higher Education and the Director of Hospitalization and the Organization of Care are responsible, each as far as it is concerned, for The execution of this Order, which will be published in the Official Journal of the French Republic.
