Decree of 23 February 2005 amending the decree of 5 May 1982 concerning the designation of controlled origin " Faugers "

Prime Minister,
On the report of the Minister of Agriculture, Food, Fisheries and Rural Affairs, to the Minister of the Economy, Finance and Industry and the Minister for Small and Medium Enterprises, Trade, Handicrafts, Professions and Consumer Affairs,
In the light of Council Regulation (EC) No 1493/1999 of 17 May 1999 on the common organisation of the Wine market and regulations made for its application;
Given the general tax code;
Due to the customs code;
Due to the rural code;
Given the code of consumption;
In view of the Order in Council of May 5, 1982 relating to "Controlled appellation of origin" Faugers " ;
In view of Decree No. 2001-510 of 12 June 2001 on the application of the Consumer Code in respect of wines, sparkling wines, sparkling wines and liqueur wines;
Given the proposal of the National Wine and Life Committee of the National Institute of Appellations of Origin of 27 and 28 May 2004,
Décrète:

Item 1


Section 1 of the Order of May 5, 1982 is replaced and written as follows:
" Art. 1. -Only the red, rosé and white wines meeting the conditions laid down in this Decree shall be eligible for the designation of origin. "

Article 2


It is inserted before the last paragraph of Article 4 of the Decree of 5 May 1982 mentioned above:
" The white wines come from the following grape varieties:
-main grape varieties: white grenache B, marsanne B, roussanne B, vermentino B. The proportion of each of these grape varieties cannot be greater than 70 % of the cash. The proportion of ssanne B may not be less than 30 % of the insert;
-accessory pages: clairette B, bourboulenc B, macabeu B, white carignan B. The proportion of these varieties, together or separately, cannot be greater than 10 % of Auctionagement. The macabeu B and Carignan white B grape varieties are allowed only for plots planted before May 20, 1998 and the bourboulenc B grape variety only for plots planted before the ... (date of publication of this Decree).
White wines are derived from the assembly of grapes or wines originating from two or more of the above grape varieties, of which the russanne B. must be produced separately. Different grape varieties are assembled in the vinar containers prior to the collection provided for in Article R. 641-96 of the Rural Code. "

Article 3


Article 6 of the aforementioned decree of 5 May 1982 is replaced and read as follows:
" Art. 6. - For red and rosé wines, the basic yield referred to in Article R. 641-73 of the Rural Code shall be set at 50 hectolitres per hectare.
For white wines, the basic yield referred to in Article R. 641-73 of the Rural Code shall be set at 45 hectolitres. Per hectare. The yield referred to in Article R. 641-76 of the Rural Code shall be set at 54 hectolitres per hectare. The maximum agronomic performance on the parcel referred to in Article R. 641-82 of the Rural Code shall be set at 7 500 kilograms per hectare. "

Article 4


In the first paragraph of Article 7 of the above-mentioned Decree of 5 May 1982, the words: Wine " Are replaced by the words: " Red and rosé wines ".
It is added to the same Article of the said Decree two paragraphs written as follows:
" The vines producing the white wines with a controlled designation of origin " Faugères have a minimum planting density of 4 000 Foot per hectare. The spacing between rows cannot exceed 2.50 metres.
These vines are conducted in short size and cannot present more than ten francs per foot. They are palised. However, splicing is not required for white Grenache B, Carignan white B and macabeu B grape varieties when they are driven in a cup size. "

Article 5


It is added to Article 8 of the decree of 5 May 1982 referred to as follows:"
" For white wines, the Use of any technique of concentration is prohibited. These wines cannot present, after fermentation, a concentration of fermentable sugars greater than 4 grams per litre. "

Article 6


The provisions of the first paragraph of Article 9 of the aforementioned Decree of 5 May 1982 are replaced by the provisions Following:
" Wine shall not be put into circulation with the appellation d' origine contrôlée " Faugères without a certificate of approval issued by the National Institute of Appellations of Origin under the conditions laid down in Articles R. 641-94 to R. 641-98 of the Rural Code. "

Article 7


The Minister of Economy, Finance and Industry, the Minister for Agriculture, Food and Fisheries The Minister for Small and Medium Enterprises, Commerce, Handicrafts, Professions and Consumer Affairs and the Minister Delegate to the Budget and Budget Reform, Government Spokesperson, are responsible. Each in respect of the execution of this Decree, which shall be published in the Official Journal of the French Republic.
