Having regard to Council Directive 1999 /105/EC of 22 December 1999 on the marketing of forest reproductive material;
Having regard to Commission Regulation (EC) No 1597/2002 laying down detailed rules for the implementation of Directive 1999 /105/EC of the Council with regard to the model of national lists of basic material intended for forest reproductive material;
In view of Commission Regulation (EC) No 1598/2002 laying down detailed rules for the application of Directive 1999 /105/EC of the Council as regards mutual administrative assistance between official bodies;
In view of Commission Regulation (EC) No 1602/2002 laying down detailed rules for the application of Council Directive 1999 /105/EC as regards: Authorisation granted to a Member State to prohibit the marketing of specified forest reproductive material to the end user;
In view of Commission Regulation (EC) No 2301/2002 laying down detailed rules for the application of the Directive 1999 /105/EC of the Council as regards the definition of terms " Small amounts of seeds " ;
Given the Forestry Code, Book V, Title V, Legislative and Regulatory Parties;
In light of Decree No. 2003-971 of 10 October 2003 concerning the Marketing of forest reproductive material and modifying the forest code,
Stop:
1. For species previously subject to regulation
Authorized, until stocks are exhausted, the marketing of seeds, plants and parts of plants that have benefited from a certificate of origin or Accompanying document, with the exception of those referred to in point 2.
These forest reproductive material shall be marketed in the new category of their basic equipment as of the date of publication of this
. From selected base materials radiated from the register are marketed until they are exhausted in the selected category.
Inventory from the registry's radiated seed orchards is marketed until they are depleted:
-en Selected category in PPA 301 " Massif Icelandic " For maritime pine orchards (Pinus pinaster Aït) of:
Landes-Cabanac-VG;
Landes-Sore-VG;
Landes-Le Frau-VG;
-in selected category in Region of origin PSY 203 " Basses Vosges gréseuses " For Scots pine (Pinus sylvestris L.) orchard from:
Bitche-Bout-VG;
-qualified for Scots pine orchard (Pinus sylvestris L.) from:
Taborz-Cadouin-VG;
-qualified for the orchard of pine laricio in Calabria (Pinus nigra Arn. Ssp. Laricio Poir. Var. Calabrica Delam.) :
Bout-Bout-VG.
For all of these materials, the topic " Master certificate reference " The supplier document shall bear the reference to the number of the certificate of origin issued when the material or number is harvested Of the accompanying document.
For the specific case of plants and parts of plants of common ash (Fraxinus excelsior L.) derived from seed harvested before 1 September 1999 and marketed without reference to a category, the deadline for Marketing is scheduled for September 1, 2004.
2. For forest reproductive material of the species referred to in 1 having benefited from a certificate of origin or a supporting document and subject to reduced requirements in accordance with Council Directive 66 /404/EEC of 14 June 1966
a) The marketing in category identified up to July 1, 2011, of forest reproductive material derived from the following basic materials:
-for maritime pine (Pinus pinaster Aït), national forest regions, As defined by the nomenclature of the National Forest Inventory, included in the region of origin PPA 301, whose seeds harvested after harvest have been subjected to a terpenic analysis, to ensure that they are not derived from Iberian provenances;
-for cherry (Prunus avium L.), stands and orchards in France, whose crops produced before October 13, 2003, have been certified by an agent referred to in paragraph 2 of Article R. 555-2 of the Code Forestry.
(b) is authorized for marketing until stocks are depleted by qualified category of forest reproductive material derived from the following basic materials:
-for the larch of Europe (Larix decidua Mill.), orchards at Seeds listed in the National Register of Basic Materials under the codes: LDE-VG-002 (current name: Sudètes-le Theil-VG), LDE-VG-001 (current name: Sudeten-Cadouin-VG);
-for Douglas-fir (Pseudotsuga menziesii Mirb. Franco), the seed orchard recorded in the National Register of Basic Materials under the code: PME-VG-002 (current name: Luzette-VG).
(c) is authorized for marketing until stocks are depleted in the identified category of material Seeds from seed from the following provenances:
-American Douglas-fir stands identified by the EEC, the seeds of which were imported from the United States to France with reduced requirements, in application of Community annual decisions laid down in Directive 66 /404/EEC;
-American stands of Sitka spruce (Picea sitchensis Carr.) And Vancouver fir (Abies grandis Lindl.), the seeds of which were imported from the United States to France with reduced requirements, in application of annual Community decisions provided for in Directive 66 /404/EEC
Marketing up to the exhaustion of stocks, without reference to a category, of the forest reproductive material covered by point 2 and not referred to in paragraphs 2 a, 2 b and 2 c.
For forest reproductive material cited in Paragraphs 2 a and 2 b, the heading " Master certificate reference " The supplier document shall bear the reference to the certificate of origin number issued when harvesting the materials or the accompanying document number.
In the Cases referred to in point 2 c, the heading ' Master certificate reference " The supplier document shall contain the number of the accompanying document.
For the forest reproductive material referred to in paragraphs 2 d, the heading " Reference of Master certificate " Of the supplier's document shall be marked " 28.3-1999-105-CE ".
3. For species not previously subject to
regulation
a) For a transitional period, until July 1, 2008 for seeds and until July 1, 2011, for plants and parts of Plants, marketing without reference to the category of forest reproductive material of the species listed in the Annex to this Order.
The heading ' Master certificate reference " Of the supplier document shall be marked " 28.3-1999-105-EC ".
(b) The marketing of forest reproductive material from the hybrid larch (Larix x eurolepis Henri), registered in the register, may be marketed in a qualified category until the stocks are depleted National of basic materials under code LEU-VG-001 (common name: FH201-Lavercantière-PF), the seeds of which benefited from a certificate of origin or accompanying document.
The heading " Master certificate reference " Of the document The supplier shall bear the reference to the number of the certificate of origin issued when harvesting the material or the number of the accompanying document.
The order of 24 October 2003 concerning the conditions for the marketing of stocks of forest reproductive material present in suppliers as of the date of publication in the Official Journal of the Council of State decree transposing Directive 1999 /105/EC is repealed.
This Order will be published in the Official Journal of the French Republic.
