Decree of January 26, 2004 extending the effects of the declaration of public utility of the works of construction of avenues Jules-Grec and Jean-Michard-Pélissier (RD 704) on the territory of the municipality of Antibes (Alpes-Maritimes)

The Prime Minister,
On the report of the Minister of the Interior, Internal Security and Local Freedoms,
Given the code of Expropriation for reasons of public utility, in particular Articles L. 11-2 and L. 11-5;
Given the general code of the local authorities;
In view of the prefectorial order of 27 January 1994 for declaration of public utility of the work Development of avenues Jules-Grec and Jean-Michard-Pélissier (RD 704) on the territory of the municipality of Antibes;
Given the prefectural order of 8 December 1998 extending for a period of five years the declaration of public utility of the works Development of avenues Jules-Grec and Jean-Michard-Pélissier on the territory of the commune of Antibes;
In view of the letter from the Chairman of the Alpes-Maritimes General Council of 25 April 2003 requesting a second extension of the declaration Public utility of the development work of the Jules-Grec and Jean-Michard-Pélissier avenues (RD 704) on the territory of the municipality of Antibes;
In view of the deliberation of 22 January 2004 of the Alpes-Maritimes General Council confirming its commitment On the implementation of the departmental project by requesting its chairman to continue land acquisitions, to schedule the work and to mobilise the regulatory procedures, in particular with the Council of State, to ensure the extension of the The duration of validity of the declaration of public utility of the works of construction of avenues Jules-Grec and Jean-Michard-Pélissier on the territory of the municipality of Antibes;

Article 1

For a period of three years, effective January 26, 2004, the effects of the declaration of utility Public, pronounced by prefectoral decree of 27 January 1994, relating to the construction of avenues Jules-Grec and Jean-Michard-Pélissier on the territory of the municipality of Antibes.

Article 2

The Minister of the Interior, Internal Security and Local Freedoms and the Minister for Local Freedoms are responsible for the execution of the This Decree shall be published in the Official Gazette of the French Republic.
