Decree of 13 December 2004 on the organization of the National Council of Social Work of the Ministry of Justice

  • TITLE I: GENERAL PROVISIONS Article 1


    A National Council for Social Action is hereby established. Participates in the definition and management of the policy of social, cultural, sports and leisure action, implemented by the Directorate-General and the equipment in favour of all staff of the Ministry of Fairness, activity or retirees.
    As such, it issues opinions on:
    -the directions of the social policy policy;
    -the general conditions for the implementation of this policy;
    -measures relating to the organization And the operation of the services responsible for the application of this policy;
    -the nature of the specific actions to be undertaken;
    -where applicable, the encryption and impact of the new benefits envisaged;
    -the management balance sheet The social action of the previous year;
    -the next year's budget project;
    -it ensures the animation of the social action and controls the execution, based in particular on the evaluation of the actions taken.

    Article 2


    The National Council of Social Action establishes a project for the distribution of social action credits between the different groups Areas of intervention. This project is subject to the custody of the seals, Minister of Justice.

      -the Deputy Director of the General Administration and Equipment Branch;
      -the head of the personnel office of general administration and equipment;
      - The Secretary General of the Council of State;
      -the Grand-Chancellor of the Legion of Honor;
      -two representatives of judicial services under jurisdiction;
      -two representatives of the decentralised services of the Directorate of The Prison Service;
      -a representative of the decentralised services of the Directorate of Youth Judicial Protection;
      -three members appointed by the Minister.
      As alternate members:
      -the Deputy Director Human resources and social relations of the management of the general administration and the equipment or its representative;
      -a chief of staff of a head office or its representative;
      -an assistant to the chief The Office of Social Action and Medical Prevention or its representative;
      -the Deputy Director of the Registry of the Judicial Services Branch or his or her representative;
      -the Deputy Director of Human Resources The prison administration or its representative;
      -the Deputy Director of Human Resources of the Directorate of Youth Judicial Protection or his representative;
      -two representatives of judicial services in Jurisdiction;
      -two representatives of the decentralised management services of the prison administration;
      -a representative of the decentralised services of the judicial youth protection directorate;
      -the head of the office The general administration and equipment management budget;
      -the Assistant Secretary-General of the Council of State or his representative;
      -the Secretary General of the Grand Chancery of the Legion of Honour or his representative ;
      -three members designated by the Minister.

      Article 6


      Representatives of staff:
      -the trade unions of the staff on the ministerial technical committee of the Ministry of Justice;
      -the two trade unions representing the most representative judges at the end The results of the elections to the promotion commission.

      Article 7

      Article 9

      The President of the National Council of Social Action may call Experts at the request of the administration or trade unions, so that they can be heard on a point on the agenda.

    • Section 2: Operation Article 11


      Representatives, holders and substitutes, to the National Council of Social Action are appointed by the Minister of Justice.

      The National Council of Social Action establishes its rules of procedure.

      Article 18


      The National Council of Social Action meets at least three times a year. It takes note of the balance sheets and proposals of the regional social action structures as well as a summary of the activity reports and the debates to which they have given rise.

      Article 19


      The President shall convene the members of the National Council of Social Action at least one month before the date of the meeting. It shall establish the agenda it addresses at least 15 days before the date of the sitting.
      The Secretariat of the Council shall be provided by the Office for Social Action and Medical Prevention.

      Article 20


      A standing commission is formed. It prepares and assures, between two plenary meetings, the follow-up to the work of the National Council for Social Action.
      It is composed of:
      -the President of the National Council for Social Action;
      -the Vice-President of the National Council for Social Action Social action;
      -a representative appointed by each trade union organization with a seat on the board;

      Article 21

      Article 22

      Article 23


      At the first meeting of the National Council of Social Action, trade union organisations shall make known their representatives in the two committees referred to in Articles 21 and 22.

      Article 24


      In its jurisdiction, the National Council of Social Action may set up working groups. These groups are composed of representatives of the administration and representatives of trade union organisations serving on the National Council for Social Action. They present the conclusions of their work to the National Council of Social Action.

      Article 25

  • TITLE II: TRANSITIONAL AND FINAL PROVISIONS Item 26


    The National Board of Directors of Social Action will continue its mandate in its operation defined by the decree of 15 June 1976 referred to above until the renewal of the Joint Ministerial Technical Committee; one month after Renewal, the provisions laid down in Title I shall apply. As of that date, the Order of June 15, 1976 will be repealed.
