Where incestuous rape or incestuous sexual assault is committed against a minor by a person who is the owner of the parental authority, the court of judgment must rule on the total or partial withdrawal of that authority or On the withdrawal of the exercise of that authority pursuant to Articles 378 And 379-1 Of the Civil Code.

It may then decide on the withdrawal of that authority or the withdrawal of the exercise of that authority in so far as it concerns the minor brothers and sisters of the victim.

If the proceedings take place before the Court of Assitting, the Court shall rule on this matter without the assistance of the jurors.
