Where an offence is punishable by a fine, the court may impose a fine of less than the amount incurred.

The amount of the fine shall be determined taking into account the resources and expenses of the offender.

The fines imposed on criminal, correctional and criminal matters, with the exception of the flat-rate fines, may be subject to an increase, within the limit of 10 % of their amount, levied on their recovery. This increase, imposed under the conditions laid down in Article 707-6 of the Code of Criminal Procedure, is intended to fund victim assistance.
