In accordance with the decision of the Government, the (2002) , the law on the supervision of labour protection and the work of the workplace (44/2006) (3) and of the Law on the Environment, Public Health and Food Safety (395/2012) Pursuant to paragraph 2:

ARTICLE 1
Scope

This Regulation concerns asbestos work.

The licensing of asbestos removal work, the qualifications of the asbestos worker and the health check of the worker are laid down separately.

The treatment of asbestos-containing waste is regulated separately.

ARTICLE 2
Definitions

For the purposes of this Regulation

(1) Asbestos, The following fibrous silicates:

(a) actinolite asbestos CAS No 77536-66-4,

(b) amosite asbestos CAS No 12172-73-5;

(c) phyphyllitasbesti CAS No 77536-67-5,

(d) chrysotile CAS No 12001-29-5,

(e) croidolite CAS No 12001-28-4,

(f) tremolite asbestos CAS No 77536-68-6,

G) erionite CAS No 12150-42-8,

(2) Asbestos at night Asbestos removal work or other asbestos-containing product or substance in such a way as to cause exposure to asbestos dust,

(3) Asbestos removal work The dismantling and removal of asbestos-containing structures and technical systems, the work on the protection of the structures to be maintained, the cleaning of the landing site and the dismantling and removal of other similar structures, with immediate effect, Exposure to asbestos dust.

As far as asbestos removal work is concerned, this Regulation also applies to the maintenance or maintenance work of the building and the vessel's asbestos-containing structures or installations, which consists of asbestos dust.

ARTICLE 3
Exposure assessment, limit value and monitoring

The employer's obligation to clarify and assess the risk of exposure to asbestos dust is regulated by the (738/2002) Paragraph 1. The employer shall ensure that the asbestos work is carried out in such a way that the worker's exposure to asbestos is minimised and always less than the protection of workers from the risks related to exposure to asbestos at work The limit value provided for in Article 8 of Directive 2009 /148/EC of the European Parliament and of the Council, which is 0,1 fibres per cubic centimetre of the air as an average of eight hours.

For the estimation of exposure to asbestos, only non-fibrous asbestos particles with a length of five micrometres and a diameter of not more than three micrometres with a length ratio of 3: 1 or more shall be considered.

At regular intervals, the employer shall monitor and ensure that the limit referred to in paragraph 1 is not exceeded. The measurements shall be carried out in such a way that the samples represent the personal exposure of workers to asbestos dust. The measurement factor requires sufficient professional knowledge to take and evaluate the necessary samples. Measurements shall be documented.

§ 4
Limitation and operation of the exposure area

The area in which an employee may be exposed to asbestos must be clearly demarcated and indicated by means of warning signs. Non-asbestos-related persons must not be allowed access to the exposure area.

For workers in the exposure area, protective clothing and other personal protective equipment must be used in the area of exposure.

The introduction of asbestos outside the exposure area shall be prevented. The asbestos-containing substances, equipment and equipment must be transferred from the area of exposure, labelled and packaged in such a way as to avoid any risk. Before leaving the exposure area, the worker shall be cleansed of asbestos dust.

Suitable and properly equipped facilities shall be provided for asbestos purification.

§ 5
Maintenance facilities

Separate maintenance facilities for the maintenance and other maintenance of work equipment used in asbestos may be provided where the work can be carried out safely.

Maintenance facilities shall be cleaned regularly.

ARTICLE 6
Special education and guidance

The employer shall provide training and guidance to an asbestos worker in the following areas:

(1) the properties and health effects of asbestos,

2) the exposure limit value for asbestos as referred to in Article 3 (1), monitoring of the limit value below and the use of measuring instruments;

(3) product and material types likely to contain asbestos,

(4) measures for exposure to asbestos and the importance of preventive measures to reduce exposure;

(5) safe working methods, measures and protective equipment;

(6) protective clothing and purification,

(7) selection, proper use, decontamination and proper functioning of respiratory protective equipment;

(8) the treatment of waste containing asbestos,

(9) emergency procedures,

(10) health checks.

The training and guidance given to the employee must be supplemented, where appropriate.

§ 7
Asbestos mapping

The developer or any other person who controls or supervises the construction project, which may include asbestos demolition work, must ensure that asbestos is carried out.

Asbestos mapping has

(1) locate the asbestos at the landing site;

(2) identify the nature and quantity of asbestos and materials containing it;

(3) Clarification of the dustness of asbestos and of materials containing it when handling or dismantling them.

The author of the asbestos survey is required to have an adequate degree of familiarity with asbestos, its presence and dismantling, as well as the professional skills required for the quality and scope of the planned mapping.

The asbestos survey shall be documented and released for use by an employer or a self-employed person who is engaged in demolition work.

What is provided for in this article by a developer or other who controls and supervises the construction project, is subject to the joint work of the principal controlling employer within the meaning of Article 49 of the Safety and Health Code.

§ 8
Written security plan

On the basis of the analysis and assessment of the hazards of the work referred to in Article 7 (1) of the asbestos inventory and the assessment of the work referred to in Article 10 (1) of the Safety and Health Code, the employer shall carry out the asbestos demolition work.

The safety plan shall, to the extent necessary to ensure the safety of work and the working environment, be reflected in the assessment, reduction and monitoring of exposure.

The security plan shall be notified to the workers involved in the demolition work and to the operators and their employees affected by the work.

The self-employed person shall comply with the provisions laid down in paragraphs 1 to 3, within the meaning of Article 49 of the Safety and Health Act.

§ 9
Prior notification

The employer and the self-employed person shall notify the work at the site of the work on asbestos removal from asbestos at the regional level to the competent national safety authority. The notification shall be made in writing, if possible, at least seven days before the start of the work.

The notification shall contain the necessary information concerning:

(1) the nature, starting time and likely duration of the work;

2) the place where the work is carried out;

3) the subscriber and his contact details,

(4) the names of the workers employed;

(5) the suitability of the health of workers in the case of asbestos and the date on which the last health check is carried out and the validity of the inspection;

(6) key findings of asbestos mapping, date and factor of asbestos mapping;

(7) methods for the demolition of asbestos or materials containing asbestos,

(8) equipment for the protection and purification of workers and their characteristics;

(9) Equipment and characteristics used to prevent the spread of asbestos dust in the working environment;

(10) the name of the landfill where the waste is delivered,

11) the notifier and the contact details.

The notification to the Labour Inspection Authority shall be renewed if there is a change in working conditions, resulting in a significant increase in exposure to dust from asbestos or materials containing asbestos. In addition, the notification shall be supplemented if the demolition work becomes a non-notified worker.

Before starting work, an indication of the exposure area referred to in Article 4 shall be subject to a declaration indicating the information referred to in paragraphs 1, 2 and 11 of paragraph 2 of this Article.

ARTICLE 10
Management and control of asbestos demolition

The employer shall appoint a foreman for the implementation of the asbestos removal work.

The Executive Director shall continuously monitor and evaluate the implementation of the security plan referred to in Article 8 and ensure that the asbestos removal work is carried out in accordance with the safety plan.

ARTICLE 11
Principles of safe asbestos demolition

The asbestos removal work must be carried out in such a way that asbestos dust is formed as little as possible and the dust formed when it is born.

Asbestos must be removed from the structures to be dismantled in sufficient and appropriate terms for the safe use of the holding. The asbestos-left asbestos shall be covered and, where necessary, significant.

The demolition of asbestos-containing structures must be carried out in such a way that asbestos and asbestos-containing materials are removed before the structures are otherwise dismantled, unless there is greater exposure to workers than the removal of asbestos. They would cause.

ARTICLE 12
Working methods for demolition of asbestos

In the selection of the method used for the demolition of asbestos, account shall be taken of the extent of the demolition work to be carried out in addition to the principles mentioned in Article 11 and the circumstances of the landing site.

The asbestos removal work can be carried out:

(1) the method of subdivision, in such a way that the dismantling work is carried out in an exposure area, separated from the rest of the working environment,

(2) by means of a demolition bag method, so that a small-scale asbestos structure or technical system is isolated and underpressure from the rest of the airspace with a special preparation bag within which the structure or technical system is dismantled and which: Removal of demolition waste from the landing site,

(3) the total removal of the structure or instrument containing asbestos from the structure as a whole and the removal of part of the removable part covered by the material from the spread of dust;

(4) the immersion process in such a way that the removal of the asbestos-containing part of the structure and the device is immersed in order to prevent dusting in the pool where asbestos is removed,

(5) wet-purge in such a way that the asbestos-containing structure is thoroughly watered down to prevent dusting before unloading, or in such a way that the public outlet containing asbestos is removed as a wet sandbar,

(6) by enabling technical progress, other than those referred to in paragraphs 1 to 5, by a method for achieving an equivalent level of safety.

When the crocodolite is dismantled, the commisation method referred to in paragraph 2 (1) shall always be used.

Where there is no certainty about the asbestos content of the material to be landed, the dismantling work shall be carried out using the compartmentation method referred to in paragraph 2 (1).

ARTICLE 13
Additional requirements for the storage method

In accordance with Article 12 (2) (1), the exposure area shall, in order to prevent the spread of asbestos dust, be separated from the other working environment by a minimum of at least five or more parts of the working environment. ARTICLE 14
Use and proper functioning of tools

In the case of partial asbestos removal, the worker shall use the wooden-board assembly. At the time of the dismantling of the crocodolite, the worker shall wear a complete mask where the air is produced by a pressure device.

The breath protection should be checked before use. In addition, the inhalation of the inhaler shall be ensured on the inside of the protective device by a test at least once a year from the person's breath test.

The employer shall ensure that the degree of separation of the filtration equipment is sufficient and that the working equipment does not contain asbestos dust more than 0,01 fibres per cubic centimetre of air.

The tools must be kept under regular maintenance and maintenance. The tools must be cleaned after use before re-introduction. Maintenance and other measures to ensure proper functioning of the air conditioning equipment shall be recorded in the maintenance book.

The choice, use and performance of tools are otherwise specified separately.

§ 15
Ensuring the cleanliness of the exposure area and safety of further use

After the completion of the asbestos removal work, the employer shall ensure that the area of exposure has been thoroughly cleansed of asbestos and asbestos-containing material.

After the cleaning of the premises, the employer shall ensure that the exposure area does not contain asbestos more than 0,01 fibres per cubic centimetre of air.

The employer and the contractor who commissioned the demolition must make a joint statement on the introduction of the holding, stating the purity of the holding and the safety findings relating to the safety of the use.

The provisions of this article on the employer also apply to a self-employed worker within the meaning of Article 49 of the Safety and Health Code.

ARTICLE 16
Asbestos mapping on board

The vessel shall ensure that the asbestos-containing structures in the vessel are identified and labelled.

The asbestos surveyor shall be familiar with asbestos, ship's structures and materials used.

§ 17
Impacts of asbestos in foreign shipyards

Where asbestos has been carried out on board a foreign shipyard, the vessel master shall ensure that the premises in which the asbestos work has been carried out and to which the asbestos dust may have spread shall be cleaned.

After the cleaning of the premises, the ship-master shall ensure that no asbestos exceeds 0,01 fibres per cubic centimetre of air in the area of exposure.

ARTICLE 18
Entry into force

This Regulation shall enter into force on 1 January 2016.

This Regulation repeals

1) Decision of the Council of Ministers on asbestos (180/1994) ,

(2) the decision of the Council of State on the application of the decision of the State Council on asbestos (18/06/1988) ,

3) the decision of the Labour Inspection Board to prepare for the asbestos night on board; (19/02/1989) ,

4) the decision of the Executive Board on the methods and equipment to be used for acceptable asbestos removal work; (241/1989) .
