State Council Regulation on the allocation of investment aid for the 2012 farm

In accordance with the decision of the Council of State, which has been presented by the Ministry of Agriculture and Forestry, (1676/2007) Pursuant to Article 7 (4) and Article 30 (2):

Chapter 1

General provisions

ARTICLE 1
Scope

This Regulation shall apply to the award of (1676/2007) The investment aid referred to in Article 7 for an applicant who complies with the provisions of the Council Regulation on investment aid for agriculture and start-up aid for a young farmer (190/2008) The conditions for granting the aid.

This Regulation shall apply to applications where support for investments may be granted under Article 30.20.49 of the 2012 State budget, for the granting of interest rate loans or for the 2012 FRF The operational plan for the grant of aid to investment grants.

ARTICLE 2
Application of Community legislation on State aid and aid to be financed under the programme

For investments referred to in this Regulation, national aid may be granted provided that the investment fulfils the application of Articles 87 and 88 of the Treaty to small and medium-sized enterprises active in the production of agricultural products And the conditions laid down in Commission Regulation (EC) No 1857/2006 amending Regulation (EC) No 70/2001.

Issued under Articles 4 to 10 and Article 13 (2) of the Decree of the Council of State on national aid for the year 2008 (2006) In the A and B assisted areas referred to in Annex 1, with the exception of the Åland Islands, the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the Act concerning the conditions of accession of the Kingdom of Sweden shall apply, and , in particular Commission Decision C (2008) 696 concerning Article 141 thereof.

Chapter 2

Investments in the livestock sector

ARTICLE 3
Investments in the livestock sector

Household livestock For the purposes of this Regulation, for the purposes of this Regulation, the dairy sector, the pig economy, the sheep and goat economy, the poultry economy and the horse economy.

The costs incurred in the investments referred to in Sections 4 to 9 shall not include any costs incurred in connection with a production structure or any other storage or repair shop or other equipment referred to in paragraph 2. Costs related to the construction, extension or renovation of the holding, or any other related costs not directly related to the production of livestock.

§ 4
Lypsy and cattle farming

Support may be granted for the construction, expansion and renovation of the building, construction or structure necessary for the dairy farming economy.

If the feeding of the milking or cattle herd is not based on an integral feeding system, the aid may, in the context of the construction referred to in paragraph 1, be granted for the purchase of a feed-in or an apewagon for feeding systems Within the limits of unit costs. No aid shall be granted for the purchase of a small cargo or tractor.

§ 5
Pigs economy

Support may be granted for the construction, expansion and renovation of the building, construction or structure of the pig economy.

ARTICLE 6
Sheep and goat economy

Support may be granted for the construction, extension and renovation of the building, construction or structure of the ovine and caprine economy.

§ 7
Poultry economy

Support may be granted for the construction, expansion and renovation of the building, construction or structure necessary for the production of poultry meat.

§ 8
Restriction on the number of animals in the pig and poultry economy

Support for the construction or extension of the renewal or extension referred to in Articles 5 and 7 may be granted in 2012 for a maximum of 33 000 additional animals. For the purpose of calculating additional animal places, 1 sow time, 7 muscle gas spots, 168 broilers or 35 turkeys shall be considered as a single animal.

§ 9
Horse economy

Support may be granted for the construction, expansion and renovation of the stable or other productive structure necessary for breeding horses.

No aid shall be granted for the construction, expansion or renovation of manes or any other investment linked to the service activities of the equine economy.

Chapter 3

Crop-related investments

ARTICLE 10
Greenhouse production

Support may be granted for the construction, expansion and renovation of the building needed for the production of greenhouse gases. A temperature centre is also considered as such, in so far as it produces heat in the greenhouse. The heating system and the heating centre of the greenhouse shall be subject to the provisions of Article 27.

The greenhouse may be considered as an eligible building if it contains:

1) a concrete block of concrete or concrete or other equivalent solid foundation;

(2) heating, ventilation or cooling; and

3) as a cover for glasshouse glass, a floor plate or double plastic.

ARTICLE 11
Crypting

Support may be granted for the drainage of the field. In order to qualify for aid, it is necessary for the drainage to fulfil the conditions laid down in the Council Regulation on the quality requirements and the maximum eligible costs to be supported (333/2008) Provides.

The aid will not be granted for the pipeline or for investment in small-scale ventures.

ARTICLE 12
Dry mores

Support may be granted for the construction, extension and renovation of warm and cold-air dryers for the drying of cereals or hay, as well as for the purchase of caravans.

Aid granted in the form of a grant may be granted by five percentage points if the dry mass is used for the drying of two or more farms or hay. ARTICLE 13
Product stocks

Support may be granted for the construction, expansion and renovation of stocks of agricultural products.

Aid may be granted for the construction, expansion and renovation of the product storage of horticultural products, provided that the national aid scheme for agricultural and horticultural products is paid for the storage of these products (1559/2001) The storage aid for horticultural products referred to in Article 12.

ARTICLE 14
Harvest harvesters for collective use

Support may be granted for the purchase of a harvest machine for use in agriculture. The operating time of the machinery is essential for the harvesting of the harvest on a holding other than the holding of the applicant. Chapter 4

Other production trends

§ 15
Turkishness

Support may be granted for:

(1) for the construction investment resulting from the transfer of fur from the groundwater to a new location;

(2) the construction, extension and renovation of shadow houses, non-insulated animal halls, feed storage facilities and yarns, as well as the surrounding area, with a fence which can prevent animals from being allowed outside the orchard;

3) a year-round watering system and a construction investment for two or more orchards, as well as for the fitting of existing shadow houses on a watertight platform.

ARTICLE 16
Beekeeping economy

Support may be granted for the purchase of nest equipment for the apiculture, for the construction, expansion and renovation of processing facilities and storage facilities, as well as for the purchase of honey lines.

§ 17
Other types of production

The aid may be granted for the construction, extension or renovation of the building, construction or structure of the building, structure or structure necessary for the collection of fungi and the collection of wild berries and mushrooms.

No aid shall be granted for an investment to promote the production of wild boar, ostrich, suckers or buffalo or the production of meat from these animals.

Chapter 5

Outstanding investments

ARTICLE 18
Trade in agricultural products

Support may be granted for the construction, extension and renovation of buildings, structures and structures necessary for the rehabilitation of agricultural products, as well as the purchase of machinery and equipment. However, no aid will be granted for investments related to the refurbation of reindeer meat or for laying hens.

The bulk of the farm's raw materials must be recovered. The products must be prepared for sale to dealers or downstream processors.

The granting of aid shall be conditional on the continuation of the product's agricultural product as referred to in Annex I to the Treaty on the Functioning of the European Union.

§ 19
Investments to promote environmental protection, animal welfare and production hygiene

Support may be granted for an investment resulting in additional costs related to the protection or improvement of the environment, improvement of hygiene conditions in the livestock farming sector or the welfare of domestic animals. However, support for additional costs can only be granted if the investment is to exceed the environmental, hygiene conditions and domestic animal welfare in the European Union legislation on the industry and the base. The minimum requirements. Where equivalent requirements in national legislation exceed the corresponding requirements of Union legislation and the investment must be carried out in accordance with the minimum requirements of national legislation, the cost shall be: Additional only to the extent that it also exceeds the requirements laid down in national legislation.

The aid referred to in paragraph 1 shall not be granted for investment in the restructuring or expansion. Aid may be granted only for the additional eligible costs resulting from:

§ 20
Improving the working environment

ARTICLE 21
Other heating centre

In addition to the provisions of Articles 3 to 10, the aid may also be granted for the construction, renovation and extension of the heating centre of a single farm fulfilling the conditions laid down in Article 27, if the heating centre is wholly or partly served by the Production activities.

The heat centre shall be considered as an eligible building only where the heat generated by it is intended to be used:

(1) buildings and structures necessary for the production of the farm; or

(2) the machinery or machinery of machinery for the maintenance and repair of agricultural machinery, or any other such condition.

§ 22
Farm biogas plants

Support may be granted for the construction of a facility for the production of gas from biomass for the heating of buildings needed for farm production. The plant can also produce other energy needed for the production of the farm.

The granting of the aid shall be conditional on:

(1) more than half of the biomass used in the installation originates from a holding belonging to the applicant or, where the applicant is an entity, from a holding in the management of the Community or from a holding in the Community; and

(2) more than half of the energy produced is used on one or more farms as referred to in paragraph 1.

Biomass is considered to be bioenergy raw materials and by-products from the farm, organic waste from food manufacturers and traders, sewage sludge and sewage sludge from sharks.

Support may be granted for eligible costs resulting from:

(1) the construction of the space required for equipment belonging to an installation;

2) the construction of a gas and sludge tank;

(3) the purchase of a reactor producing gas;

(4) the construction of other structures and structures necessary for the production and operation of biogas and the purchase of machinery and equipment.

ARTICLE 23
Stocks of agricultural machinery

Support may be granted for the construction, expansion and renovation of stocks for the storage of agricultural machinery. The condition for granting the aid is that the warehouse is insulated and its facades are essentially and bear the structures of wood. § 24
Acquisition of the built agricultural property

The purchase of a built agricultural property may be granted for the following purposes:

(1) payment of the redemption share resulting from the purchase and distribution of the holding or part of the holding by the applicant;

(2) payment of a Tasingon resulting from the holding of sole ownership of the applicant;

(3) carrying out the supplement to the applicant for testing the farm or part thereof, if the whole farm is owned by the applicant;

(4) the purchase of the farm or part thereof subject to start-up aid where an application for start-up aid has been submitted by 31 December 2007 at the latest and the start-up aid has been granted;

(5) Acquisition of production facilities with land soles.

Eligibility shall be incurred as a result of the purchase of the agricultural production structure or production structure and its ground, structure and structure. In addition, aid may be granted for costs arising from agricultural land procured in connection with the building, in so far as the share of the agricultural land does not exceed 10 % of the total eligible costs of the investment. ARTICLE 25
Acceptable costs of the acquisition of a built agricultural property

Eligible costs shall include consideration of the value of the acquired property when used in agriculture, in so far as it provides:

Chapter 6

Construction restrictions

§ 26
Exclusion of construction costs

No aid shall be granted for the costs of construction, extension or renovation of:

1) a building, structure or structure which is not necessary for production;

2) holdings with a purpose other than agricultural production.

§ 27
Restrictions on thermal centres

As a condition for the granting of aid for the construction, extension or renovation of a heating centre, it is necessary to make use of the heat, water, air, soil or solar heat or other renewable energy source in the heating centre. Support for the construction, extension or renovation of a heat centre capable of making use of peat can only be granted if the heat centre can also generate heat through wood or other renewable energy sources.

The aid shall not be granted to the costs of the heat centre resulting from the use of oil, coal or other non-renewable fuel in the heating centre.

Chapter 7

Aid and application

ARTICLE 28
Form and maximum amount of aid

The aid shall be granted for investments under this Regulation in the form of a grant, interest rate subsidy or a State guarantee or a combination thereof, taking into account the aid ceilings and forms of support provided for in the Annex to this Regulation. The aid may be granted by 10 percentage points, plus the investments referred to in Articles 4 to 10 and Article 13 (2) if the applicant is:

(1) a natural person who fulfils the conditions for the granting of the start-up aid of a young farmer and whose establishment is not more than five years after the date of application;

(2) a Community whose members or members fulfil the conditions set out in paragraph 1;

(3) two or more farmers together or separately, all of which fulfil the conditions set out in paragraph 1.

The interest rate loan may be granted at least 60 % and up to 80 % of the eligible costs, as set out in the annex to the annex. However, if the total cost of the investment is less than EUR 7 000, no interest subsidy shall be granted.

Aid for the investments referred to in Articles 4, 5, 7 and 10 shall be granted in the form of a contribution from the European Union, within the limits approved by the European Union in the rural development programme of the continental Finland programme, and other parts of the subject's support exclusively from national funds. Grants for other purposes shall be granted entirely from national funds.

The State guarantee may be granted for the investment referred to in Articles 4 to 10 and 15. The maximum amount of the State guarantee per investment is eur 500 000.

The State guarantee for an investment other than the investment referred to in Article 4 may relate to a maximum of 80 % of the amount of the loan covered by the guarantee throughout the loan.

§ 29
Maximum amount of aid in the State guarantee

Where an investment is granted a State guarantee, the aid element in the State guarantee may exceed the aid ceiling set out in the Annex. However, the maximum level shall not be exceeded in so far as the aid element in the State guarantee combined with other aid for the same purpose would exceed 60 % of the eligible costs of the investment if the beneficiary was a young farmer, Or 50 % if the beneficiary is another farmer.

Where the investment relates to the investment referred to in Sections 4 to 10 and Article 13 (2), the maximum amounts of the aid referred to in paragraph 1 shall not exceed the aid ceilings in accordance with Commission Decision C (2008) 696 referred to in Article 2 (2).

ARTICLE 30
Maximum aid in certain cases

Investment aid may be granted only to the extent that the amount of the aid per holding does not exceed EUR 500 000 over a period of three fiscal years.

The amount of the aid referred to in paragraph 1 may exceed EUR 500 000, but not EUR 750 000, provided that the investment is carried out by two farmers jointly or by an agricultural holding with two shareholders or members and they all meet the agricultural The conditions laid down in Chapter 2 of the State Council Regulation on investment aid and start-up aid for a young farmer.

In addition, the aid referred to in paragraph 1 may exceed EUR 500 000, but not eur 1 000 000 if the investment is carried out by at least three farmers in one or more agricultural holdings with at least three shareholders or members, and they shall: All fulfil the conditions of the entrepreneur referred to in paragraph 2.

Persons who are married or unmarried shall not, for the purposes of paragraphs 2 and 3, be regarded as two agricultural undertakings or a shareholder or member of an agricultural holding. The term 'partner' means a person with whom an agricultural holding or a member of an agricultural holding or a member of an agricultural undertaking is not continuously living in a common household under marital conditions.

Where the applicant's natural person has received investment aid on the basis of the Community's participation or membership or jointly with another entity, the aid previously granted shall be taken into account in the calculation of the maximum aid ceiling referred to above: In proportion to the ownership of the natural person applying. ARTICLE 31
Search times

The search periods for investment aid for the bases referred to in Articles 4 to 23 shall be as follows:

1) the first application period shall start on 7 December 2011 and end on 20 January 2012;

2) the second period of application shall start on 6 February 2012 and end on 30 March 2012;

3) the third period shall begin on 16 April 2012 and end on 17 August 2012;

4) the fourth application period shall start on 3 September 2012 and end on 19 October 2012.

The application period for aid to the base referred to in Article 24 shall start on 7 December 2011 and end on 30 November 2012.

By way of derogation from paragraph 1, investment aid may be applied continuously if the production structure necessary for the production of the farm, which is eligible for aid under this Regulation, has been destroyed in relation to its intended use; and The destruction has been caused by a sudden and unforeseeable external accident which is independent of the applicant.

ARTICLE 32
Entry into force

This Regulation shall enter into force on 7 December 2011.

This Regulation shall apply to the application for the granting of the aid which has been initiated on or after 7 December 2011. Article 4 of the Regulation shall also apply to applications pending at the time of entry into force of the Regulation.
