Law on the Saamela Training Centre

In accordance with the decision of the Parliament:

ARTICLE 1
The purpose of the institution

The training centre in the Saami area is a State institution within the Ministry of Education.

The purpose of the training centre is to increase the professional skills of the Sami people, to organise training in the regions of the Sami region and to promote employment in the region and to preserve and develop A Sami culture.

In order to achieve this, the training centre organises vocational training and the teaching of the Sami language and culture, and produces and develops related educational material, e-learning and other support services for teaching.

ARTICLE 2
Location of the institution and teaching languages

The location of the training centre is Inari's municipality.

The educational languages of the educational centre are the language of Finnish and the language of the Sami.

ARTICLE 3
Vocational training

Vocational training courses organised by the School shall be governed by the law on vocational training (30/1998) And vocational training in vocational education and training (1998) , subject to this law.

§ 4
The teaching of the English language and culture

The Principal and the Teachers of the School shall draw up a plan for the teaching modules and the scope of the teaching of the language and culture, the objectives and the main content of teaching, the key teaching arrangements and the student Evaluation. The board will approve the plan.

If necessary, the training may also be organised outside the location of the training centre, taking into account the knowledge and educational needs of the Sami population.

§ 5
Development and service activities and production of learning material

Training support and related development and service activities can be organised in the training centre. In addition to the educational materials referred to in Article 1 (3), the training centre may also produce and develop support material for basic teaching in the teaching of the Sami language.

A fee may be charged for training, development and service activities and for the provision of educational materials. Payments shall be determined in accordance with the provisions of the State Payment Act (150/1992) Provides for charges to be levied on public law.

ARTICLE 6
Cooperation

The training centre must cooperate with the Sami people in the area of the Sami region and other education providers, educational establishments and higher education institutions.

§ 7
Rights and obligations of students in the language and culture

The provisions of Article 27 (1) to (3) of the Professional Training Act apply to the taking of the teaching of the English language and culture.

The student's right to a safe study environment is governed by Article 28 of the Law on Vocational Training. The plan and order rules referred to in paragraphs 2 to 4 of that Article shall be common to the students referred to in Articles 3 and 4 of this Act.

§ 8
Students in the study of the language and culture of the Saamen

Students in the language and culture of the Sami who study for at least a semester are awarded educational benefits as laid down in Article 37 of the Law on Vocational Training. Other students may be charged with material, catering and accommodation fees. Education is free of charge. Payments shall be made in accordance with the provisions of the State Payment Act, mutatis mutandis, on charges for public law. More detailed provisions will be laid down by a decree of the Ministry of Education.

If the fee charged to a student within the meaning of this Act has not been paid on a maturity date, the annual interest rate shall be charged as from the due date, as in the (163/1982) Provides. Payment of a fee is obtained without a judgment or decision in the form of a law on the enforcement of taxes and charges (20/2007) Provides.

The amount of aid and study aid for the student's travel expenses shall be adjusted separately.

§ 9
Executive Board

The training centre has a board of directors. The Board of Directors shall appoint no more than eight members for a maximum period of four years. Each of them shall be appointed as a personal alternate. Teachers, other staff and students shall elect a member and a member of the Executive Board for a term of office of one of their members. The term of office of the members representing the students may differ from that of the other members. The majority of the members of the Executive Board shall represent the Sami people and shall be appointed on a proposal from the Sami Committee. At least one member of the Executive Board and his alternate shall be represented by the municipalities of the Sami region.

In addition to the tasks assigned to it by this Act, the Board of Governors shall be responsible for the organisation and development of education. The Management Board shall monitor the educational needs of the Sami regions and the Sami population and shall take initiatives in the fields of education, training and other activities in accordance with this law. The composition, the setting up of the Executive Board and the Management Board shall be governed by more detailed provisions by the Council Regulation. The tasks of the Executive Board shall be subject to more detailed provisions in the management code referred to in Article 12.

ARTICLE 10
Advisory Board

In order to promote vocational education and training, and to maintain and develop the links between the training centre and working life and other necessary links, the training centre may have a negotiating body with more specific composition and tasks. Provisions in the management code referred to in Article 12.

ARTICLE 11
Student council

The training centre shall have a student body, which may include students in initial vocational training referred to in Article 3 and students who study in Article 3 and students in the field of vocational training referred to in Article 3. At the training centre for at least one semester. The role of the student body is to promote the collaboration of students. The student body is using the student's speaking power as referred to in Article 36 of the Vocational Training Act. The Board of Governors shall be governed by the Board of Governors.

ARTICLE 12
Management rule

The Executive Board of the Training Centre shall lay down more detailed provisions on the general criteria for the organisation of training, the administration and the tasks of the institutions and staff, the Advisory Board, the student body and the other internal activities. In addition, the Executive Code provides for general criteria for the organisation of teaching of the Sami language and culture. The Executive Board shall be approved by the Management Board.

ARTICLE 13
Headmaster and other staff

The training centre shall have a principal appointed by the Executive Board. The principal shall manage the activities of the training centre and shall be responsible for ensuring that the tasks assigned to the training centre are performed successfully and qualitatively, and shall carry out the other tasks assigned to him in this Act. The duties of the principal shall be subject to more detailed provisions in the management code.

The training centre has teachers and other staff necessary for the activities of the training centre. Staff are employed or employed in the State.

The principal shall appoint or take the training centre's teachers and other staff. However, for the time being or for a period longer than one year, the appointed teacher shall be appointed by the Management Board.

ARTICLE 14
Eligibility requirements for the principal and teaching staff

The requirements for the qualification of the principal and of the teaching staff are laid down in the Regulation on the qualification requirements of the teaching staff (986/1998) .

Notwithstanding paragraph 1, the principal shall have at least a good oral and written knowledge in the language of the Sami language. The provision of the language of the language shall apply mutatis mutandis to the law on general language examinations. (964/2004) And the State Council Regulation on the allocation of Finnish and Swedish language skills (2004) .

The Ministry of Education may, for specific reasons, grant exemption from the eligibility criteria.

§ 15
Secrecy

Article 42 of the Professional Training Act provides for the confidentiality of the institutions and staff of the training centre.

Appeals appeal

The decision of the School Board shall require an adjustment to the administrative law (2003) Provides. The decision to amend the requirement of amendment may be appealed against by the administrative court, as in the case of administrative law (18/06/1996) Provides. An appeal to the decision of the administrative court shall be lodged only if the Supreme Administrative Court grants an appeal.

However, the decision on the appointment of staff shall not be subject to any adjustment or appeal.

ARTICLE 16
Appeals appeal

The decision of the Board of the Education Centre under this Act shall be subject to appeal by the appeal to the administrative court, as in the case of administrative law (18/06/1996) Provides. However, it is not possible to apply for an amendment to decisions concerning the appointment of staff.

§ 17
Entry into force

This Act shall enter into force on 1 May 2010.

This law repeals the Law of 18 June 1993 on the training centre of the Sami area (545/1993) With its subsequent modifications.

ARTICLE 18
Transitional provisions

The student of the training centre, who has commenced his studies before the entry into force of this law, shall have the right, at least as a result of the entry into force of the law, to the educational benefits in force at the time of entry into force of the law.

The staff of the training centre, appointed before the entry into force of this Act, shall continue with the entry into force of this Act at the time of its entry into force.

The Board of Education, appointed before the entry into force of this Act, shall continue its term of office.

At the time of entry into force of this Act, the provisions in force and the provisions in force relating to the powers and tasks of the Executive Board and the holders of duties shall apply until the date of adoption by the Executive Board of a new The management rule.

Before the law enters into force, measures may be taken to implement the law.

This Act shall enter into force on 1 January 2016.

In the case of appeals before the entry into force of this Act, the provisions in force at the time of entry into force of this Act shall apply.
