In accordance with the decision of the Parliament:

ARTICLE 1
Purpose

This law provides for the organisation of flood risk management.

The aim of the law is to reduce flood risks, to prevent and mitigate the harmful effects of floods and to promote the provision of floods. The purpose of the law is also to coordinate flood risk management and other management of the river basin, taking into account the sustainable use of water resources and the needs of conservation.

ARTICLE 2
Definitions

For the purposes of this law:

(1) In the flood The water level resulting from the rise in the water level of the water, the rise in the sea level or the adhesion of the land resulting from the accumulation of waste water;

(2) The flood risk The combination of the likelihood of flooding and the resulting adverse consequences for human health, safety, the environment, infrastructure, economic activity and cultural heritage;

(3) Huglob Rain or melting water from the surface or other similar surfaces in the affected area;

(4) River basin The law on the organisation of water management (1299/2004) The river basin referred to in paragraph 6;

(5) Part of the river basin The part of the river basin referred to in Article 2 (7) of the Law on Water Management;

(6) In the water management area The water management area referred to in Article 3 of the Law on Water Management;

(7) In the international water management area Water management area for the territory of another Member State within the meaning of Article 3 of the Law on Water Management;

(8) Coordinating body, transport and the environment The coordinating industry, transport and environmental centre of the water management area referred to in Article 6 of the Law on Water Management.

ARTICLE 3
Authorities

The Ministry of Agriculture and Forestry directs and monitors the implementation of this law in cooperation with the Ministry of Interior, the Ministry of Transport and Communications and the Ministry of the Environment.

In addition to the provisions of Articles 4 to 6, the authorities of the State and the municipalities are involved in the planning of flood risk management under this Act.

§ 4
Responsibilities of the Food, Transport and Environment Agency

The Agency shall be responsible for:

(1) make a preliminary assessment of the flood risks of river basins and coastal waters;

(2) prepare a proposal for the designation of significant flood risk areas in the river basin and the sea coast;

(3) establish flood risk and flood risk maps for river basins and coastal waters;

(4) prepare proposals for flood risk management plans for river basins and coastal waters;

5) assist municipalities in the preliminary assessment of flood risks, the designation of significant flood risk areas and the development of flood risk management plans.

In addition, the Centre for Enterprise, Transport and the Environment shall be responsible for the management of flood risks other than those referred to in paragraph 1. In particular, the Centre shall be responsible:

(1) take care of the management of flood risk management in non-significant flood risk areas;

(2) provide, in the event of a flood and during the flood, the organisation of cooperation between authorities and control measures in the waters;

(3) make recommendations on the coordination of water rationing and runs;

(4) promote flood protection and other measures to improve flood risk management;

(5) provide for hydrological monitoring, as well as the water situation and flood warning service in cooperation with the Finnish Environment Agency and the Institute of Aeronautics;

(6) carry out the tasks necessary for the management of flood risks by the Ministry of Agriculture and Forestry.

The Ministry of Agriculture and Forestry may provide that the Centre for Enterprise, Transport and the Environment shall carry out the tasks referred to in this section in the area of the other industry, transport and the Agency.

§ 5
Functions of the municipality, the province of the province and the region

The municipality, the province of the province and the rescue operation in the area are involved in the planning of flood risk management of the river basin and the sea coast, as provided for in this Act.

The municipality is responsible for the management of hulewater flood risk management as provided for in Article 19.

ARTICLE 6
Tasks of the Finnish Environment Agency and the Institute of Aeronausciences

The Finnish Environment Agency and the Institute of Aeronautics will provide expertise in the field of flood risk management.

§ 7
Preliminary flood risk assessment

The preliminary flood risk assessment shall be carried out on the basis of the results of the floods and the evolution of climate and water conditions, taking into account the long-term climate change.

§ 8
Significant flood risk areas

An area where, on the basis of the assessment referred to in Article 7, a potential significant flood risk is identified or where there is a presumption of such a risk, is designated as a significant flood risk area. When assessing the significance of the flood risk, account shall be taken of the likelihood of flooding and of the following adverse consequences, if any, of the flood risk:

(1) a harmful consequence to human health or safety;

(2) long-term interruption of the essential service, such as water, energy, telecommunications, road transport or other similar activities;

(3) long-term interruption of economic activities which are vital to society's vital functions;

(4) a long-term or extensive detrimental effect on the environment; or

5) irreparable damage to cultural heritage.

The importance of the flood risk assessment shall also take into account regional and local circumstances.

The Ministry of Agriculture and Forestry shall designate significant flood risk areas for the river basin and the sea coast, on a proposal from the Transport and Environment Agency. The decision of the Ministry shall not be subject to a separate appeal.

§ 9
Flood maps

The significant flood risk areas referred to in Article 8 shall be drawn up with maps describing the dispersion of floods in different probability ( Flood hazard map ) and maps showing the potential adverse effects of such floods ( The flood risk map ).

ARTICLE 10
Flood risk management plan

A flood risk management plan shall be established for a river basin with one or more significant flood risk areas and an important flood risk area for the sea coast. If flood risks arising from flooding and rising sea levels occur in the same area, the flood risk management plans for the river basin and the sea coast may be combined. The waste water management plan shall be drawn up in the territory referred to in Article 19 (2).

The flood risk management plan sets out the objectives of flood risk management for each major flood risk area and the measures to be taken to achieve the objectives. When selecting measures, efforts shall be made to reduce the likelihood of flooding and to use other means of flood risk management based on non-flood protection structures, if the circumstances as a whole are considered appropriate. The plan examines the costs and benefits of the measures and sets out the priorities of the measures.

ARTICLE 11
Flood risk management objectives

The objective of flood risk management is to reduce the harmful effects referred to in Article 8 (1). In addition, efforts must be made to minimise the harmful consequences of river flooding in the river basin as a whole.

ARTICLE 12
Coordination of flood risk management and water management

The establishment and review of flood risk and flood risk maps and flood risk maps and flood risk management plans shall be coordinated in accordance with Article 5 (1) of the Law on Water Management With. In particular, it is necessary to ensure that the measures set out in the flood risk management plan are coordinated with the environmental objectives of the operational programme referred to in Article 12 of the Law on water management.

The participation and information referred to in Article 17 of this Act and the procedures laid down in Article 15 of the Law on the organisation of water management shall be coordinated where necessary.

ARTICLE 13
Environmental report

An environmental report shall be presented as part of the flood risk management plan. The environmental report is laid down in the Law on the assessment of the effects of plans and programmes on the environment (2011) .

ARTICLE 14
Design of flood risk management in river basins crossing the national border

The coordination of the flood risk management plan and other cooperation in the design of flood risk management in a river basin crossing the national border will be organised in accordance with the provisions of the international agreement.

The flood risk management plan shall be aimed at reconciling the corresponding plans for a part of the river basin district referred to in paragraph 1. It can be supplemented by more detailed plans, which will be coordinated with one of the trans-border river basins.

The flood risk management plan shall not include measures which, by virtue of their scale or effect, significantly increase the flood risk in a part of the river basin district referred to in paragraph 1, unless the measures have been adapted One throughout the river basin. § 15
Flood group

For the purpose of establishing a flood risk management plan, a flood risk group shall be set up for cooperation between the authorities concerned in the river basin and the seaside area, to which one or more significant amounts have been designated on the basis of the preliminary flood risk assessment. ARTICLE 16
Task force's tasks

§ 17
Participation and information

ARTICLE 18
Approval of management plans for water and sea-fire risks

The Ministry of Agriculture and Forestry approves flood risk management plans for river basins and coastal waters.

§ 19
Design of waste water flood risk management

§ 20
Revision

The initial assessment of the flood risks, the designation of significant flood risk areas, flood hazard maps and flood risk maps and flood risk management plans shall be reviewed every six years. ARTICLE 21
More detailed provisions

The decree of the Council of State lays down provisions:

(1) the content and revision of the preliminary flood risk assessment, flood risk and flood risk maps and flood risk management plans, the preparation of the flood risk management plan and the planning of flood risk management; Deadlines;

2) the time limits for the participation and information referred to in Article 17.

§ 22
Appeals appeal

The decision of the Ministry of Agriculture and Forestry concerning the approval of the flood risk management plan shall be subject to appeal by the appeal to the Supreme Administrative Court, as in the case of administrative law (18/06/1996) Provides. The right of appeal shall be:

(4) a registered local or regional association or a foundation intended to promote environmental or natural protection or the use of water resources and whose area of activity is covered by the flood risk management plan.

The municipality's decision to approve the hulewater flood risk management plan shall be governed by Articles 188 and 191 (1) and 191 (2) of the Land Use and Construction Act, which provide for appeals and the right of appeal to be approved. Of the Decision.

ARTICLE 23
Taking account of the flood risk management plan

The flood risk management plans approved by the Ministry of Agriculture and Forestry, in accordance with Article 18 of the Ministry of Agriculture and Forestry, shall be taken into account by the State and local authorities and by the regional development authorities, as appropriate.

The taking into account of flood risk management plans shall also apply to the rest of the law.

§ 24
Transmission of information

The authorities shall provide the Centre for Business, Transport and the Environment and the Municipality concerned with the information necessary for the planning of flood risk management free of charge.

The provisions of paragraph 1 shall also apply to the obligation under the law to provide for exceptional circumstances or situations of disturbance and specific situations.

ARTICLE 25
Transmission of information

The municipality shall provide the Centre for Business, Transport and the Environment with information on the significant areas of flood risk referred to in Article 19 (1) and the paragraphs referred to in Article 19 (2) of the acts referred to in Article 19 (2) Flood risk management plans.

§ 26
Information system

The information system, including the maps referred to in Article 4 (1) (3), the decisions referred to in Article 8 (3) and Article 15 (2), as referred to in Article 18, shall be maintained by means of transport, transport and environment centres and the Finnish Environment Agency. Other information to be stored in the information system may be regulated by a Council Regulation.

§ 27
Making information available to the public

The Finnish Environment Agency shall ensure that information on significant flood risk areas, flood hazard maps and flood risk maps and approved flood risk management plans are available to the public.

ARTICLE 28
Flood risk management unit

The water management area is the flood risk management unit and the international water management area is the international flood risk management unit.

The Government Decree provides for a cooperation authority for the International flood risk management unit.

§ 29
Entry into force

This Act shall enter into force on 30 June 2010.
