In accordance with the decision of the Government of the Ministry of Defence, which has been presented by the Ministry of Defence, the (1242/2005) And the Law of 3 May 1985 on the investigation of accidents (373/1985) , as amended by Law 282/1995:

Chapter 1

General provisions

ARTICLE 1
Scope

ARTICLE 2
Specific requirements for military aviation

Chapter 2

Military Aviation Authority

ARTICLE 3
Military Aviation Authority

The Military Aviation Authority will operate in conjunction with the Air Force Headquarters. The Authority has an independent decision in matters relating to military aviation.

§ 4

Chapter 3

Registration of military aircraft

§ 5
Military aircraft register and its intended use

The Military Aviation Authority shall keep a military aircraft register to monitor flight safety, identify military aircraft and meet international obligations which are binding on Finland.

The military aircraft register shall include manned and unmanned aerial vehicles owned by the State of Finland.

A military aircraft register may also include an aircraft that is controlled by armed forces or used exclusively for military aviation, which is not included in any other aircraft register.

Publication of data from the register

The military aircraft register shall not be subject to the provisions of Article 12 (3) of the Aviation Act for the publication of information and information on the electronic network to be seen.

§ 7
Indication of military aircraft

Chapter 4

Airworthiness and emissions of aircraft used for military aviation

§ 8
Type-approval certificate, certificate of airworthiness and certificate of airworthiness

§ 9

Conditions for granting a medical certificate

Flight preparation and conduct

ARTICLE 13
Military aircraft documents

ARTICLE 14
Flight training permit

Military flight training, issued by the armed forces itself, is not required by Article 77 of the Aviation Act.

§ 15
Flight authorisation

An air work permit referred to in Article 76 of the Aviation Act shall not be required for operations carried out by the armed forces on a Finnish military aircraft in accordance with the provisions adopted by the military aviation authority.

ARTICLE 16
Aircraft licence

An air sample permit referred to in Article 78 of the Aviation Act shall not be required for the demonstration of military aviation or for an individual proficiency performance whose defence forces are carried out by a Finnish military aircraft in accordance with the provisions adopted by the military aviation authority In accordance with

Air traffic control

The Military Aviation Authority shall exclusively approve air navigation systems and military aviation procedures for the use of military aviation.

Chapter 7

Aviation accidents, damage and incidents and their investigation

ARTICLE 18
Purpose of the investigation

§ 19
Execution of the investigation

A military aviation accident investigation commission is being investigated by a military aircraft accident. An accident or incident shall be investigated by the investigating panel or investigator of the military aviation damage or incident.

§ 20
Accident, damage, incident and occurrence reporting

The military aviation operator shall be required to report immediately the accident, damage and incident and the exemption referred to in Article 128 of the Aviation Act to the Military Aviation Authority.

An accident, incident and occurrence associated with civil aviation or its services shall be notified to the Aviation Administration in accordance with Articles 123 and 128.

The military aviation authority shall inform the Military Aviation Authority of any departure, maintenance, repair and preparation of the aircraft or parachute, and any departure from aerodromes and air navigation services, Errors or other exceptional situations which compromise or may compromise the security of military aviation.

ARTICLE 21
Setting up a committee of inquiry and examiner

The Military Aviation Authority shall annually appoint the Chairman of the Military Air Accident Investigation Board and the permanent members and their alternates. The Chairman shall be familiar with military aviation and experienced in an air-accident investigation. Other members shall represent knowledge of medical or police activities.

In the event of an accident, the Military Aviation Authority shall appoint, where appropriate, additional members of the Investigation Board representing the necessary expertise in aeronautics, aircraft technology, accident investigation or other areas.

For each other military aviation accident, the Military Aviation Authority shall set up a committee of inquiry with sufficient expertise.

The Military Aviation Authority shall lay down provisions for the setting up of an accident or incident board and of the examiner, as well as the duties of the Board and of the investigator.

§ 22
Military Aviation Accident Review Board

The Ministry of Defence is setting a military aviation accident inspection board for three years. The Chairperson and the Vice-Chairperson of the Board shall have a degree in law. The Board also includes four other members and two alternates who should have aviation, military or technical knowledge.

The members of the Board of Inquiry into the Civil Aviation Accident Investigation Board, the duty of duty, professional secrecy and fees and allowances are in force, as laid down in the law on the investigation of accidents.

ARTICLE 23
Processing of an investigation report

The Military Aviation Authority shall decide on the measures to be taken in the light of the accident, damage or incident report and the recommendations contained therein.

The Military Aviation Authority shall forward the investigation file on the aeronautical accident and its decisions to the Military Air Safety Inspection Board.

The Military Aviation Safety Inspection Board shall give its opinion to the military aviation authority on the causes of the accident and the adequacy of the measures taken.

Chapter 8

Outstanding provisions

§ 24
Insurance

By way of derogation from the provisions of Chapter 15 of the Aviation Act, aircraft operated by the State in military aviation owned by the State or other defence forces shall not be insured.

ARTICLE 25
Entry into force

This Regulation shall enter into force on 1 January 2006.

Before entry into force of the Regulation, measures may be adopted for the implementation of the Regulation.
