Law on the reimbursement of a pension under State resources for the period of treatment or study of children aged under three years

In accordance with the decision of the Parliament:

ARTICLE 1 (7 DECEMBER 2007)

This law provides for the care and studies of children under three years of age. The benefit is paid in the form of a pension under the laws and pension rules referred to below:

1) the worker's pension (185/2006) ;

(2) the Maritime Pensions Act; (1290/2006) ;

3) the entrepreneur's pension law (1272/2006) ;

(4) the farmer's pension law; (1280/2006) ;

(5) State Pensions Act (1295/2006) ;

6) Municipal Pensions Act (2003) ;

7) Pension law of the Evangelical Lutheran Church (298/1966) ;

(8) Law on the Orthodox Church (185/2006) ;

(9) Law of the National Pensions Office (11,91/2001) ;

(10) The Bank of Finland (214/1998) Article 11 The pension rule adopted pursuant to paragraph 2 (6); or

11) on the application of the provisions on State pensions in force in the Kingdom of the Province of Åland (ÅFS 54/2007).

ARTICLE 2 (7 DECEMBER 2007)

The right to benefit is granted by an older person who is prevented from doing gainful employment under the age of three years of age, and is entitled to a child's home care and private care (19/08/1996) Or the equivalent of a child's home care allowance under the Åland Law. The basis for calculating the benefit is EUR 523,61 per month. More detailed provisions on benefit are laid down by a decree of the Government.

ARTICLE 3 (10,2004)

The entitlement to benefit is not more than five years of study by a person who has completed a vocational qualification, a vocational degree or a lower or higher education qualification. The basis for calculating the benefit is EUR 523,61 per month.

On the basis of a higher education qualification, the right to benefit is granted for five years, from a professional university degree, from four to four years, and from three years on the basis of a higher education qualification and a basic vocational qualification. However, if a person has completed more than one degree, the entitlement to benefit is not more than five years.

The diploma awarded abroad entitles the holder to the benefit of the benefit provided that the person has obtained a study grant. (1999) Or equivalent study grants under the Åland Law of Åland. (7 DECEMBER 2007)

More detailed provisions on benefit are laid down by a decree of the Government.

§ 4 (10,2004)

The date shall not be completed until the end of the year following the beginning of the year preceding the retirement of the month following the retirement of the month. For the benefit of the benefit, the person shall have a total of at least EUR 12 566,70 by the end of the previous year preceding the pension scheme referred to in Article 1 or the pension rule.

However, no benefit shall be paid to any person who receives a disability, unemployment or old-age pension as referred to in the law or pension provision referred to in Article 1.

§ 5 (7 DECEMBER 2007)

The benefit shall be reduced by 1/8 % per calendar month from the criterion referred to in Articles 2 and 3. Benefits in accordance with Article 107 of the Pensions Act of the Workers' Pensions Act and in situations other than those referred to in Article 1 of the Act referred to in Article 1 of the Act referred to in Article 1 of the Act referred to in Article 1, the last pension institution From the date of commenting of the benefit, except for the date of the completion of the examination referred to in Article 3 by the applicant. If the claimant's pension entitlement has been transferred to the pension scheme of the European Union, the law on the transfer of pension rights between the Finnish employment pension scheme and the pension scheme of the European Communities (165/1999) , the benefit under this law shall be reduced and, on application by the beneficiary, a municipal pension institution. The benefit shall be paid from the date on which the person is entitled to a pension under the Staff Regulations of the European Union. (4 JUNE 2010)

ARTICLE 6

For the purpose of determining the benefit referred to in Article 2, the parent of the child shall, in his application for home management aid, declare to the National Pensions Office or to the municipality of Åland whether he is prevented from gainful employment A three-year-old child. In addition, at the request of the pension institution or the Pension Security Centre, the applicant shall, where appropriate, present a statement that he fulfils the conditions for obtaining the benefit. The educational institutions shall inform the National Pensions Office of the conduct of the examinations referred to in Article 3, as laid down in the Council Regulation.

The municipality of Åland, which is paying the support of the People's Pension Fund and the home-care allowance, shall inform the Pension Centre of the information required by the provisions of paragraphs 1 and 2, which are necessary for the purpose of resolving the benefit, as specified by the Government Decree Provides. § 7 (7 DECEMBER 2007)

The benefit of the pension institution under this Act shall be subject to the provisions of the law or pension provision referred to in Article 1, the adoption of a decision, the payment of the pension, the payment of the pension and the recovery of the pension, access to the information And extradition, the appeal procedure and the removal of the legal decision.

By virtue of this law, the Pension Security Centre shall, upon request, give the applicant the conditions referred to in Articles 2 to 4 of the Decision if the pension institution has not adopted a decision on the matter under Article 75 (6) of the Pension Act, Article 81 (6) of the Seamen's Pensions Act, On the basis of Article 69 (5) of the Pensions Act or Article 75 (5) of the Pensions Act. With regard to the decision of the Pension Protection Centre, the provisions of the Pensions Act shall apply to the Pension Protection Centre for the purposes of dealing with the case, the adoption of a decision, the access to and transfer of information, the appeal procedure and the final decision Removal.

§ 8

In order to cover expenditure and expenses incurred by the Pension Security Centre and pension institutions under this Act, the Centre shall, on application by the Ministry of Social Affairs and Health, carry out an annual report on expenditure and expenses incurred by the State Department. The Pension Security Centre shall reimbursing the funds received from the State to pension institutions in accordance with the criteria of the Ministry of Social Affairs and Health mentioned above.

The Åland Municipality of Åland shall be entitled to receive compensation for the notification referred to in Article 6. (7 DECEMBER 2007)

§ 9 (10,2004)

This Act shall enter into force on 1 January 2005.

The benefit under this law shall be entitled to the period referred to in Article 2, including the entry into force of this Act. Those studies shall entitle the holder to benefit under this law in so far as the calculation period referred to in Article 3 (2) is after the entry into force of this law.

The amounts provided for in Articles 2 and 3 correspond to the value of the salary coefficient referred to in Article 96 of the Pensions Act of the employee in 2004 (1000). The amounts of the money shall be adjusted by the salary factor mentioned in the moment of the calculation. (7 DECEMBER 2007)

Before the entry into force of this Act, measures may be taken.

This Act shall enter into force on 1 January 2005.

For the purposes of Article 1 of this Law, the laws and pension rules referred to in Article 1 of this Act shall also be assimilated to the laws and pension rules mentioned in Article 1 of this Act.
