The presentation of the Minister for Agriculture and Forestry is governed by the provisions of Protocol 47 to the EEA Agreement and certain provisions of Decision No 7/94 of the EEA Joint Committee amending certain Annexes to the Agreement and the application of the Decision of 28 June 1994 Of the law (530/94) Pursuant to paragraph 1 and Article 6:

ARTICLE 1
Control system

Farmers who are committed to their plant production to comply with Council Regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs (hereinafter referred to as ' the The production method laid down in the Council Regulation, and a holding that fulfils the conditions laid down in the abovementioned Council Regulation for organic farming, shall be entered in the register of the plant production control centre ( Register of organic farming) . The farmer admitted to the control system shall be entitled to use the products produced on the holding when marketing the official inspection mark referred to in Article 6.

ARTICLE 2
Audit Board for organic farming

The organic agricultural production control board set up by the rural economic district of the region shall decide on the approval of the farmer and the farmer in the control system and shall ensure the control of production as provided for in this Regulation. The Board of Appeal shall be composed of representatives of the rural economy, food authority, organic production and consumers. The Chairperson of the Board and the Secretary of the Board shall be appointed by the rural business district.

The Inspection Board of the Organic Agricultural Inspection Board shall have a statute approved by the control centre for plant production, which shall include provisions on penalties other than those provided for in Article 9, where deficiencies are detected and Irregularity.

ARTICLE 3
Inspectors of organic farming

The checks required by the Council Regulation on holdings are carried out by inspectors who are authorised by the plant production inspecting centre to meet the requirements of organic production. The rural industry is proposing to authorise inspectors in the area and after consultation with the Organic Farming Association.

§ 4
Registration in the monitoring system

A farmer who wishes to get his farm under the control system under this Regulation must submit an application to the rural economy. The application shall be made using the form established by the plant production control centre and shall contain the information required by Annex IV to the Council Regulation.

§ 5
Approval of the control system

The inspector shall carry out an initial check on the application referred to in Article 4 of the EAFRD. The inspector shall prepare a report on the inspection ( Audit report) , on the basis of which the Board decides on the approval of the farmer and the holding in the control system.

ARTICLE 6
Official inspection marking

A farmer whose status is admitted to the control system shall be entitled to use the official inspection mark mentioned in Annex V to the Council Regulation in its products approved by the control system:

In the case of official inspection marking, the name of the inspection board of the organic agricultural production authority which has granted access to the label shall also be indicated.

§ 7
Production control

Each year, the farmer shall notify the rural industry of the production plan for the next year of production of its agricultural products, broken down by block, by the rural business district. The farmer shall also inform the rural industry without delay of any material change in his activities or in the circumstances affecting it.

The authorised inspectors shall, at least once during the year of production, carry out the production control on the holding belonging to the control system and report the result of the inspection to the Inspection Board. The Board shall process the notifications and shall, where appropriate, take action on the basis of the guidelines referred to in Article 2 (2) or the measures mentioned in Article 9.

§ 8
Register of organic farming

The Plant Production Inspection Centre shall keep a register of farmers and holdings authorised in the control system on the basis of the information provided to it by the Inspection Boards.

For each farmer in the control system the following information shall be entered in the register:

(1) the name and address of the farmer, the location of their crops and, where appropriate, the parcels, where organic production takes place, on a yearly basis, on the holding, and the date of arrival of the starting declaration;

(2) information on the transition to organic production;

(3) the date of inspection;

(4) a decision approving the control system;

(5) the production control date; and

(6) penalties imposed by the panel pursuant to Article 9 or periodic penalty payments imposed by Article 10.

The information entered in the register of organic farming shall be public.

§ 9
Penalties

In addition to the right of the Board to impose prohibitions under Article 9 (9) (a) and (b) of the Council Regulation, the Board of Appeal shall be entitled to decide on a payment of a fee and to order the removal of the farmer from the register.

The prohibitions and orders referred to in paragraph 1 shall be issued on a temporary basis, provided that it is possible to remedy or eliminate the deficiencies on which they are based. Prohibitions and orders shall be withdrawn without delay if the inadequacy has been removed or where it is no longer relevant to the prohibition or order.

Notwithstanding the correction requirement, prohibitions and orders shall be complied with, unless the authority from which the adjustment is sought is expressly exempted.

ARTICLE 10
Periodic penalty payment

The Inspection Board may impose a penalty payment on the prohibitions referred to in Article 9 (1). The decision to impose a periodic penalty payment shall not be submitted separately by the appeal.

ARTICLE 11
Re-examination and correction

If the farmer is dissatisfied with the inspection referred to in Article 5 or Article 7 (2), he shall be entitled to request a recheck. Within 14 days of the result of the inspection, the farmer shall make a request for a renewal check. The chairperson of the Audit Board shall be responsible for organising the re-inspection.

If the farmer is dissatisfied with the decision to approve the control system referred to in Article 5 or the decision on the prohibition or removal from the register referred to in Article 9 (1), he shall be entitled within 30 days to: Upon receipt of the information, make a written request to the Board for the correction of the decision. The decision shall be accompanied by a statement of objections.

ARTICLE 12
Appeals appeal

The decision referred to in Article 11 (2) shall be subject to appeal by the appeal to the Board of Appeal of the Board of Appeal of the (154/50) In accordance with the order.

The decision of the Board of Appeal of the Board of Appeal, referred to in paragraph 1 of the Board of Appeal, may be appealed against by the appeal to the Supreme Administrative Court.

The decision referred to in Article 11 (2) of this Regulation shall not be appealed against.

ARTICLE 13
Fees and fees

The checks under this Regulation shall be charged to the State for payment of the reasons and the amount of which are to be determined by the State (99/92) In accordance with

ARTICLE 14
Monitoring and training of the monitoring system

The plant production control centre is responsible for monitoring the activities of the Inspection Boards and a yearly report to the Ministry of Agriculture and Forestry.

The plant production control centre, together with organic farming organisations, is responsible for the training of inspectors and board members.

§ 15
Finland's 4h union derogation

Notwithstanding the above, the 4h Union of Finland shall ensure that the inspection and control required by the Council Regulation are carried out under vines of less than 15 islands in the 4h Union. However, where there are irregularities in these crops, the inspection panel of organic farming shall consider the checks on these crops as provided for in this Regulation.

For the purposes of this Article, the advisors authorised by the 4h association shall act as inspectors within the meaning of Article 3. The 4h Union shall provide information on its inspectors and the cultivation of its inspection and control systems annually for the purposes of registration and control of the plant production control centre.

ARTICLE 16
More detailed provisions

More detailed provisions on the implementation of this Regulation will be provided by the Ministry of Agriculture and Forestry, as appropriate.

§ 17
Entry into force

This Regulation shall enter into force on 1 July 1994.

Before the entry into force of this Regulation, measures may be adopted for the implementation of the Regulation.

ARTICLE 18
Transitional provision

The control panel of organic farming may decide on the approval of the farmer and the holding on the basis of an inspection carried out by the inspector referred to in Article 3, carried out before the entry into force of this Regulation And which shows that organic agricultural production on the holding meets the conditions laid down in the Council Regulation.

Similarly, the approval of the 4h Union before the entry into force of this Regulation before the entry into force of this Regulation is approved by the farmer and the farmer referred to in Article 15 (1).
