Regulation on the Archives

The presentation of the Minister for Education is provided for in the Archives Act of 23 September 1994 (831/94) Pursuant to:

Archives of the Archives
ARTICLE 1

The task of the archives shall be:

(1) directing the archiving operation in accordance with the law of the archives (831/94) And is provided for or provided for;

(2) ensure the overall development of the archival action and the research and training required for it;

3) accept and retain documents supplied by the authorities;

(4) acquire and retain other documents relevant to society and research;

(5) take care of the information service relating to the material it maintains; and

(6) perform the other tasks which are or shall be assigned to it.

ARTICLE 2

The National Archives will lead to the operation, administration and development of the repository. The National Archives are guided by the archives of the central government and the other archivists referred to in the repository whose jurisdiction covers the whole country. It also acts as a central repository and a centre for research and development in its field of activity.

The provincial archives shall exercise independent decision-making powers in respect of the cases provided for or prescribed by them. The county archives are governed by the archival office of archivists.

They are also regional central archives and research and development centres.

The activities of the provincial archives are carried out in the cities of Helsinki, Espoo, Beautiful and Vantaan National Archives.

ARTICLES 3 TO 5

Articles 3 to 5 have been repealed by A 4.3.2004/173 .

Staff and its tasks
ARTICLE 6

The Head of the National Archives is the Director-General, who has the title of the State archivist. In addition, the National Archives have archival advice whose responsibilities and functions are laid down in the Rules of Procedure.

The head of the provincial archives is the head of the county archives.

§ 7

The Executive Director shall conduct the activities of the Archives and the National Archives and shall be responsible for the efficient and financial management of the tasks assigned to them.

Archives shall assist the Executive Director in the management of the Archives in accordance with the responsibilities laid down in the Rules of Procedure.

The Director of the National Archives shall manage the activities of the provincial archives and shall be responsible for the efficient and financial management of the tasks assigned to it.

Settlement of cases
§ 8 (4 MARCH 2004)

In addition to the rest of the legislation, the Executive Director shall decide on matters relating to:

(1) the general development and policies of archival and archive services, as well as the operational and economic performance objectives of the archive services, in the context of the performance targets set by the Ministry of Education;

2) the Archives' Action Plan and the Budget proposal;

(3) the repurchase, reproduction or storage of a private archive or document referred to in Articles 19 and 20 of the Archives Act;

4) other issues of general scope and fundamental importance for the archive services.

§ 9 (4 MARCH 2004)

The Director-General shall decide on the presentation. The Rules of Procedure shall determine which other matters shall be resolved by the presentation.

Archives Advisory Board (4 MARCH 2004)

The Archive institution has a consultative committee to support its activities, which deals with the development, policy and planning of the repository, and promotes cooperation between the repository and its stakeholders.

The Advisory Board shall be set up and specified by the Advisory Board. At least one of the members of the Advisory Board shall represent the staff of the repository.

Eligibility requirements and fulfilment of posts and freedom of office
ARTICLE 10 (11.02.2000)

The Director-General is required to have a higher education qualification, a familiarity with the field of competence of the repository and, in practice, a managerial skill and management experience.

The archivist and the governor of the provincial archives are required to have a higher education qualification, a familiarity with the business of the repository and the practice of leadership in practice.

ARTICLE 11

The Executive Director shall be appointed by the Council. The Director-General shall be appointed by the Ministry of Education on a proposal from the Director General. (4 MARCH 2004)

The Director-General shall be appointed by the Director of Archives and Archives. (4 MARCH 2004)

Unless otherwise provided for in the Rules of Procedure, the Executive Director shall appoint or take the staff of the other National Archives.

The manager of the provincial archives shall be appointed or taken by other staff of the provincial archives.

ARTICLE 12

For a maximum of two years, the Director General of Freedom shall be granted by the Ministry of Education and for more than two years the Council of State. (11.02.2000)

Unless otherwise provided for in the Rules of Procedure, the Director General of the National Archives and the Director of the Archives of the National Archives shall be granted leave of absence.

The administrators of the provincial archives shall be granted leave of absence from the archives of the provincial archives.

ARTICLE 13

An authority or an official who shall grant leave of office shall be subject to the authority of the Agency during the period of freedom of office or when the office is open.

Miscellareous provisions
ARTICLE 14

The National Archives have a position and responsibility on behalf of the State, as well as the Court of Justice, the arbitration procedure and other authorities, the interests and the right of the State in all matters relating to the archives.

Under the Rules of Procedure of the National Archives, the official shall have the right to supervise or authorise an agent to supervise the interests of the State in any of the cases referred to in paragraph 1 and to take up the challenge on behalf of the Archives Service.

§ 15 (11.02.2000)

An amendment to the decision of the National Archives and of the provincial archives is sought from the administrative court, as in the case of administrative law (18/06/1996) Provides.

ARTICLE 16

In the context of the National Archives, in the context of the National Archives, there is a panel of experts in the National Archives, from which more detailed provisions are laid down by the Archives Department.

§ 17

More detailed provisions on the organisation of the National Archives and of the National Archives Organisation, the tasks and powers of operation units and personnel, and the handling of cases and other arrangements shall be laid down in the Rules of Procedure.

Paragraph 2 has been repealed by A 4.3.2004/173 .

ARTICLE 18

This Regulation shall enter into force on 1 October 1994.

This Regulation repeals the Regulation of 25 March 1988 on the heraldic board (267/88) .

The term of office of the Administrative Board, which was in force at the time of entry into force of this Regulation, shall expire on 31 March 1995.

The Management Board shall be appointed for the first time in accordance with this Regulation with effect from 1 April 1995.

Before the entry into force of this Regulation, measures may be taken to implement it.

Entry into force and application of amending acts:

11.2.2000:

This Regulation shall enter into force on 1 March 2000.

4.3.2004:

This Regulation shall enter into force on 1 April 2004.

Before the entry into force of the regulation, measures may be taken to implement the Regulation.
