In accordance with the decision of the Parliament:

ARTICLE 1 (181,2013/37)
Regulation of contractual terms

Contracts between the trader shall not use the condition or apply a practice which is disproportionate to the traders of the other party involved, taking into account the The need for protection from a weaker position and other relevant factors.

The trader may be prohibited from pursuing the use or practical application of the condition referred to in Article 1 (1), or renewing the use or practical application of such a condition. The prohibition shall be made more effective by periodic penalty payments, unless it is unnecessary.

A prohibition may, if there is a particular reason, also apply to the trader or to any other person acting on behalf of the trader, as referred to in paragraph 2.

Determination of the ban
