In accordance with the decision of the Parliament:
Contracts between the trader shall not use the condition or apply a practice which is disproportionate to the traders of the other party involved, taking into account the The need for protection from a weaker position and other relevant factors.
The trader may be prohibited from pursuing the use or practical application of the condition referred to in Article 1 (1), or renewing the use or practical application of such a condition. The prohibition shall be made more effective by periodic penalty payments, unless it is unnecessary.
A prohibition may, if there is a particular reason, also apply to the trader or to any other person acting on behalf of the trader, as referred to in paragraph 2.
For the purposes of this law, the trader shall also be regarded as (30/2013) The contracting entity referred to in Article 2 where it acquires goods or services by means of commercial activities.
The prohibition laid down in Article 1 shall be determined by market law. The market law may also impose a ban as temporary, in which case the ban will remain in force until the matter has been finally resolved.

This Act shall enter into force on 1 January 1994.
