Law on compensation for civilian casualties caused by combat equipment

In accordance with the decision of the Parliament:

ARTICLE 1 (24.4.2015)

According to this law, compensation for the injury or illness of an Finnish citizen and a foreign resident permanently resident in Finland, provided that it has been caused by armed forces, munitions, mines, explosives or Other combat instruments which have not been unduly held by the armed forces. Compensation shall not be made if the injured person is entitled to compensation for accidents at work and occupational diseases (10/09/2015) Or military accident (1211/1990) Included.

L to 42/2015 Article 1 shall enter into force on 1 January 2016. The previous wording reads:

ARTICLE 1

According to this law, compensation shall be paid to the Finnish national and the Finnish resident permanently resident in Finland, if it has been caused by armed forces, munitions, mines, explosives or other Fighting instruments that have not been unduly held by the armed forces. Compensation shall not be made if the injured party is entitled to compensation under the law on the compensation of civil servants (449/90) , accident insurance law (20,8/48) Or military accident (1211/90) Included.

ARTICLE 2

The State shall be liable for the damage regardless of the fault.

ARTICLE 3 (13/03/2013)

The compensation shall apply mutatis mutandis in respect of (412/1974) , Chapter 6, Article 1 and Article 3 of Chapter 7.

§ 4

Compensation shall be required within 10 years of the occurrence of the injury. For a specific reason, compensation may be paid, even if the compensation has been applied for later.

State speaking power in matters governed by this law shall be exercised by the State Treasury. (28.11.2012)

§ 5 (24.4.2015)

The compensation paid under this law shall be deducted from the same disability or sickness benefit under other law.

L to 42/2015 Article 5 shall enter into force on 1 January 2016. The previous wording reads:

§ 5

The compensation paid under this law shall be deducted from the compensation payable under the same disability.

ARTICLE 6

This Act shall enter into force on 1 January 1991.

This law applies to a bodily injury that was born after the law came into force.

Entry into force and application of amending acts:

13.3.2009/14:

This Act shall enter into force on 1 September 2009.

The provisions in force before the entry into force of the Act prior to the entry into force of the Act shall apply.

28.11.2014:

This Act shall enter into force on 1 January 2015.

The claim made before the entry into force of this Act shall apply to the provisions in force at the time of entry into force of this Act.
