Law on the division of the functions of the Chancellor of State and the Parliamentary Ombudsman

In accordance with the decision of the Parliament:

ARTICLE 1

The Chancellor of State's Attorney General is exempted from the obligation to enforce the law in respect of matters falling within the mandate of the Parliamentary Ombudsman concerning:

(1) the Ministry of Defence, with the exception of the lawfulness of the acts of the Council of Ministers and its members, the Defence Forces, the Border Guard, the Military Crisis Management Act (211/2006) , in accordance with the procedure laid down in (556/2007) , including military training, as well as a military trial;

2) in the law of coercion (2006) , detention, detention, travel ban, detention or other deprivation of liberty;

3) prisons and other institutions to which a person has been taken against his will.

The Chancellor of Justice shall also be released from dealing with a case within the competence of the Ombudsman which has been initiated by a person whose freedom is to be arrested, detained or otherwise restricted.

ARTICLE 2

In the cases referred to in Article 1, the Chancellor of Justice shall refer the matter to the Ombudsman, unless he considers it appropriate, for specific reasons, to resolve the matter himself.

ARTICLE 3

The Chancellor of Justice and the Ombudsman may, on a reciprocal basis, delegate a matter falling within the competence of both parties, when the transfer can be assessed to speed up the handling of the case or where it is justified for other reasons. The complaint must be notified to the complainant in the complaint.

§ 4

This Act shall enter into force on 1 January 1991.

This law repeals the Law of 10 November 1933 on the criteria for the division of the duties of the Chancellor of State and of the Parliamentary Ombudsman (276/1998) And the Law on the release of the Chancellor of State for certain tasks on the same day (195/33) .

This law shall also apply at the time of entry into force of the law of the Office of Justice and in cases pending in the Office of the Parliamentary Ombudsman.
