Regulation on the granting and payment of certain pensions

The presentation of the Minister of Finance under the responsibility of the Ministry of Finance provides for:

ARTICLE 1

Matters relating to a permanent pension to be granted to a person in a capacity or employment relationship or in any other comparable service shall be dealt with and settled by the Treasury.

The State Treasury shall also examine and decide on the application for matters relating to the granting of a permanent pension to the national representative and to a person other than the person referred to in paragraph 1 on the basis of a service or employment relationship.

At the same time, the State Treasury shall decide on the application for the payment of a permanent survivor's pension, funeral or funeral expenses after the person referred to in paragraphs 1 or 2.

Where a pension should be granted in accordance with a post or activity which is no longer in existence, it shall be granted in accordance with the post or post of the equivalent post or activity. (17,1978/135)

ARTICLE 2

Following an application for a pension, funeral and funeral expenses referred to in Article 1, the State Treasury shall issue a decision to the applicant.

When the decision to resolve the pension is essentially dependent on medical matters, the State Treasury shall obtain the opinion of the medical officer of the State Railways, the Head of the State Railways or the Medical Department of the General Staff. Where appropriate, an opinion of the Board of Health may be obtained in the event of invalidity.

§ 4

The pensions, survivors' pensions, cemeteries and the reimbursement of funeral expenses, as referred to in Article 1, and extra-State pensions paid by State resources shall be borne by the Treasury. In addition, the Treasury pays maintenance pensions and annualinterest rates according to the military deficit, according to the agreement between the Treasury and the accident agency, invalorine syrup and, if not otherwise, by the Ministry of Finance State resources, other forms of compensation and benefits in the form of a pension.

The rehabilitation benefits under the State Pension Act shall be paid by the State Treasury or by the employer for the purpose of the State Treasury allocation. (13.12.1991/1428)

For the purposes of this Regulation, as provided for in this Regulation, the other payments referred to in paragraph 1 shall apply mutatis mutandis. (13.12.1991/1428)

§ 5

The State Office shall keep a register of the information required for the issue and payment of pensions and survivors' pensions.

Agencies and institutions and the employers concerned shall make the necessary declarations for registration in accordance with the instructions of the Treasury.

The State Treasury shall be obliged to provide the agencies and institutions with information on the register, at their request, for the purposes of determining the entitlement of the employees of the State, hospital care and pay for sickness and childbirth. (19/121980/883)

ARTICLE 6 (4.3.1983/240)

The Population Register Centre shall inform the State Treasury of any changes in the data relating to the person entered in the central register of the population or to his family relationship.

§ 7

The State Treasury pays the pensions monthly if it is not otherwise provided for. Payment days are set by the Treasury.

§ 8

The State Treasury shall ensure that no pension is paid to a person who has lost his entitlement to a pension.

For the purposes of payment of a pension, the pensioner shall provide a statement deemed necessary by the Treasury. The State Treasury may suspend the payment of the pension until the report has been completed.

§ 9

More detailed provisions on the implementation and application of this Regulation shall be provided by the Ministry of Finance, where appropriate.

ARTICLE 10

This Regulation shall enter into force on 1 June 1971 and shall repeal the Decree of 11 December 1959 on the granting and payment of certain pensions (354/59) .

Entry into force and application of amending acts:

17.02.1978/135:

This Regulation shall enter into force on 1 March 1978.

19.12.1980/883:

This Regulation shall enter into force on 1 January 1981.

4.3.1983/240:

This Regulation shall enter into force on 1 July 1983.

Before the entry into force of this Regulation, measures may be taken to implement it.

20.12.1985/1021:

This Regulation shall enter into force on 1 January 1986.

13.12.1991/1428:

This Regulation shall enter into force on 15 December 1991.
