DECREE NVÍNO 574

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No 172, dated twelve November of two

mil fifteen, published In the Official Journal N00-217, Tomo Nándor 409, dated

twenty-five of that same month and year, provisions were issued for the creation of the San Salvador-based Second Instance Environmental Chamber and the

Santa Ana-based Environmental Court, as well as the entry into

operation of the Environmental Court with In San Miguel.

II.-That the Supreme Court of Justice was unable to comply with the ninth attribution of Article 182 of the Constitution, which mandates the

appointment of the Judges of First Instance who would be in charge of the above mentioned Courts, because the respective terms must be

National Council of the Judicature, which was recently

conformed; on the other hand, considers that according to the statistics of work there is no justification for creating such a court.

III.-That, in view of the above Considering that it precedes, it becomes

imperative to issue Transient Disposition, in order to extend the creation of the

San Salvador-based Second Instance Environmental Chamber.

BY TANTO,

in use of its Constitutional powers and on the initiative of the Supreme Court of Justice.

DECCRETA, the following:

Transitional Provisions for Extending the Creation of the Second Instance Environmental Chamber with

San Salvador Headquarters

Art. 1.-To extend the

of the Second Instance of the Environmental Chamber of the Second Instance in San Salvador to March 1, two thousand seventeen, in an unpostponed manner

Art. 2.-Extend the jurisdiction of the Third Civil Chamber of the First Section of the Center to continue to know of environmental matters in accordance with the Law; this while

does not create and operate the Chamber Second Instance Environment based in San

Salvador, according to the previous article.

Art. 3.-The Supreme Court of Justice, through the dependencies it determines, will elaborate the studies and analyses corresponding to the effect of determining and following up the demand for services

that will result in the application of the Environmental jurisdiction, for which the different Environmental Courts, must report to the corresponding assigned dependency, every three months.

The Supreme Court of Justice will be required to report to the Legislative Assembly on

the management of the Environmental Courts, every three months.

Art. 4.-This Decree will enter into force from the day of its publication in the Official Journal.
