DECREE NCÍNO 545

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That the Constitution establishes as obligations of the State to protect, preserve and defend the right to life, to physical and moral integrity, to freedom, to the

security, to the work, property and possession of the persons; as well as the principle of equality of all persons established in Art. 3 and the guarantee

not to be discriminated against in the enjoyment of their rights, among other reasons, by

sex.

II.-That by Legislative Decree Núncia 520, dated November 25, 2010,

published in the Official Journal Núncia 2, Tomo Núncia 390, of January 4, 2011, is

issues the Comprehensive Special Law for a Free Life of Violence for Women @.

III.-That with the aim of improving the next implementation of the Specialized Courts for a Free Life of Violence for the Mujeres@ and to make an effective life free of violence and discrimination for women is

opportune to carry out reforms to the Comprehensive Special Law for a Free Life of Violence for the Mujeres@ approved by Legislative Decree N50a 520, dated November 25, 2010, published in the Official Journal Núncia 2, Tomo Núncia

390, of 4 January 2011.

FOR TANTO,

in use of its Constitutional powers and at the initiative of the Deputies and Deputy Ana Marina

Alvarenga Barahona, Maria Elizabeth Gomez Perla, Karla Elena Hernández Molina, Juan Pablo Herrera Rivas, Silvia Estela Ostorga de Escobar, Sonia Margarita Rodríguez Siguenza and Numan Pompilio Salgado

Garcia.

DECRETA the following:

REFORMS TO THE COMPREHENSIVE SPECIAL LAW FOR A LIFE FREE OF VIOLENCE FOR

THE WOMEN

Art. 1.-Reform Article 4, in its literal b) as follows:

Ab) Favorability: in case of conflict or doubt on the application of the provisions

contained in this Law, the most favorable to the women that face

violence, except in those provisions that refer to the fixing of the facts or the

appreciation of the test. @

Art. 2.-Add article 56-A, and your Acapite as follows:

Specialized AJurisdiction and Multidisciplinary Teams

For the application of the criminal types contained in this regulation, a

sensitized and specialized jurisdiction in the field of gender must be created, following the same structure, degrees of

knowledge and instances that in the common criminal proceedings but taking into account the particularities ordered in this Law and the International Human Rights Instruments applicable and ratified,

this jurisdiction must be supported by teams

As long as this jurisdiction is not created and completed, you will continue to know the courts competent in criminal matters. @

Art. 3.-Reform Article 57 in its literals (f) and (l) as follows:

Af) Be informed and notified in a timely and truthful manner of the actions to be taken

during the entire judicial or administrative process, as well as as well as the relevant resources and help services.

l) Receive the help and protection, timely and appropriate of the National Civil Police. @

Art. 4.-This Decree shall enter into force eight days after its publication in the Official Journal

.
