DECREE NO 5.

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I. That it has been a constant policy of the Government of El Salvador, respect and protection of the fundamental rights of the human being;

II. That the Executive Branch has submitted to this Legislative Assembly, the American Convention on Human Rights, called the "Pact of San Jose of Costa Rica," signed in San Jose, Costa Rica, on November 22, 1969;

III. That the mentioned Convention fundamentally coincides with the principles of human rights established by our Political Constitution, which is why it is necessary to ratify it;

THEREFORE,

in use of its powers On the initiative of the President of the Republic through the Minister of Foreign Affairs,

DECCRETA:

Art. 1.-ratify the American Convention on Human Rights, called "Pact of San José de Costa Rica", signed in San José, Costa Rica, on November 22, 1969, composed of a preamble and eighty-two articles, approved by the Executive Branch on the Foreign Relations Agreement by Agreement No. 405, dated June 14, of the year, making the caveat that such ratification is without prejudice to those provisions of the Convention that may conflict with Express precepts of the Political Constitution of the Republic.

Art. 2.-ratify this Convention, interpreting the provisions of this Convention in the sense that the Inter-American Court of Human Rights will have jurisdiction only to know of any cases that may be subject to it, both by the The Inter-American Commission on Human Rights as for any State Party, provided that the State of El Salvador, as a party to the case, has recognized or recognized such competence, by any means and under the modalities that Convention itself is noted.

Art. 3.-This Decree shall enter into force on the day of its publication in the Official Journal.
