DECREE No. 1074.-

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That in accordance with Art. 53 of the Constitution, the right to education and culture is inherent in the human person and, consequently, it is the primary obligation and purpose of the State conservation, promotion and dissemination; likewise, it is the State's obligation to promote research and scientific work;

II.-That for the promotion and the intellectual and editorial production in the national and international markets, it is necessary the identification of the edited and printed works in the Republic of El Salvador, with a coded numbering according to the standards established by the International System for Books;

III.-Which, dated January 27, 1997, the International Standard Book Number, known by its acronym ISBN, based in Berlin, Republic Federal of Germany, officially designated the National Library of El Salvador as the National Agency of the ISBN in the Republic of El Salvador;

IV.-That the System ISBN facilitates the control of the world bibliographic production; contributes to remove language barriers in the marketing of books, formalisation of technical processes in libraries; facilitates the integration of archives; the recovery and transmission of data in computer systems of libraries and libraries; Therefore, it is appropriate to adopt the system of bibliographic control legally. international in El Salvador;

in use of its constitutional powers and on the initiative of the President of the Republic, through the Minister of Education,

DECCRETA: LAW FOR THE ALLOCATION OF THE INTERNATIONAL NUMBER

STANDARD FOR BOOKS

CHAPTER I GENERAL PROVISIONS

Object of Law

Art. 1. This Law is intended to regulate everything related to the use of the International Normalized Numbering System for Books, the name of which comes from the translation of the English phrase "International Standard Book Number", which is hereinafter referred to as "International Standard Book Number". to be abbreviated with the acronym ISBN. This system has the following purposes:

a) Numbering the titles of the country's editorial production.

b) Localize and unequivocally identify the titles of printed works, authors and national publishers.

c) Incorporate bibliographic records of national productions and international to printed catalogues and CD-ROMs.

By means of the ISBN, all the literary works and productions indicated in this Law will be cataloged, uniformly, in order to promote their commercialization at national and international level and, in addition, effective control of the production will be established national bibliographic.

Encharged Institution

Art. 2.-The National Library, in its capacity as the National Agency of the ISBN, will be the only national agency responsible for allocating the ISBN number. Similarly, this Library will create and exercise control over the catalogues and any other documents related to the application of the ISBN. The system number allocation service will be provided free of charge.

Terminology

Art. 3.-For the purposes of this Law, the terms, acronyms and meanings are recognized below:

a) CERLALC: Regional Center for the Promotion of the Book in Latin America and the Caribbean.

b) Author: Natural person who performs intellectual creation.

c) Editing: First printed materialization of a set of copies of a book, made by the same iron, in a single dump.

d) Editor: Person or entity responsible for publishing a book, at whose charge the address of the edition, distribution and sale of the same is found.

e) Copy: Each printed copy of a bibliographic edition.

f) Brochure: Any printed, non-serial publication consisting of five to forty-eight pages, not including the cover.

g) Fonogram: All fixation, exclusively, of a representation, execution, or other sounds, in magnetophonic records.

h) Format: Size of a book, that is its length and width.

i) Book: All printed, non-serial publication, consisting of more than forty-eight pages, without include the cover page.

j) Portada: Sheet located at the beginning of the book, on whose front they are placed: the title of the work, the name of the author and translator, if any, and the printing foot.

k) Contracover: Reverso of the cover that contains various data of the publication including: previous editions, original title, in the case of a translation; number of Legal Deposit, if any, reservation of copyright, ISBN number, reproduction of the record sheet, which must be drawn up by a professional librarian; and some details of the editing.

l) Computer program: Set of instructions expressed by words, codes, plans or any other form that upon being incorporated into an automated reading device, is capable of producing information, executing certain tasks and getting certain results.

m) Publication: Production of copies, placed within the reach of the consumer with the consent of the holder of the respective right, provided that the availability of the same, allows to satisfy the reasonable needs of the public.

n) Multimedia publications: Those consisting of written materials of any kind, whether sound, visual or audiovisual.

o) Seriated publications: It is the set of two or more works, published in successive parts at regular or determined intervals, with the purpose of continuing indefinitely, as long as they meet the following:

1. That have been published by the same editor.

2. That the titles of each work are independent and independent.

3. That the title of the string appears at least once in each component of the string.

p) Reissues: The successive edition of a book that contains modifications to the text, as a revised edition or in the representation format.

q) Reprint: Any subsequent printing or reproduction of a book without modifications to the content, format or typographical features.

r) Tirage: Number of copies that make up an edition.

s) Title: Denomination with the which author designates his work.

t) Subtitle: Title of a subdivision of the text. A secondary title that is sometimes placed after the main title, either of the work or of an important part of it.

u) Cover: Outer part of a carnated book consisting of two pieces of paper-coated cardboard, skin, fabric, etc.

v) Bibliographic tab: Tab containing bibliographic data.

The ISBN Number

Art. 4.-The ISBN is composed of ten digits preceded by "ISBN". The complete number consists of four variable extension parts, separated by dashes, with no spaces between the different ranges; each of which represents the following information:

1) Group identifier: It is the set of digits which form the first part of the number, and identifies a geographical language or group. This issue is assigned by the International ISBN Agency of Berlin, Germany.

2) Editor's identifier: The second part of the ISBN, identifies the publisher and is assigned by the National ISBN Agency to each publishing company. The number of digits may vary in this part according to the editorial production.

3) Title identifier: Third part of the ISBN that identifies a specific title, which is assigned by the National Agency.

4) verification: This is the last part of the ISBN number, assigned by the National Agency, which is used to record that the publisher submitted the data concerning a given title. This number forms a single digit, from zero to ten and ensures that there are no errors when using the full number. When the check digit is equal to ten, it will be replaced by a capital "X".

In the back cover, next to the ISBN number, the "C" symbol of the English "Copyright" which means "Copyright" and the "Copyright" is also printed. Bibliographic tab.

Limitations on the Use of the ISBN

Art. 5.-The numbers assigned by the Salvadoring Agency of the ISBN and subsequently used, may not be used under any circumstances in other different materials.

Each new edition must bear a different ISBN number.

All reprints must bear the same ISBN number of the corresponding edition that is reprinted.

Submitting Works to the ISBN System

Art. 6.-Editions, reissues and reprints made for profit, shall be subject to the system of the ISBN, provided that they remain in the following categories:

(a) Books and brochures published in the country, other than serial publications, including those that constitute a unit with its sound, audiovisual, electronic and other media.

b) Atlas or set of maps with binding text.

c) Music partitions with text.

d) Publications in braille systems.

e) Microfilms or microtokens.

f) Publications on electronic media.

g) Publications on multimedia.

h) Software computer programs.

The collectible loose sheets, which in your all forms a production of the enunciated in this article, they will be subject to the ISBN system when they have completed the work.

When the work contains several volumes, an ISBN will be assigned to the complete work and an ISBN at each volume individual of those who make up the work. However each volume will be printed by the ISBN number of the complete work and the specific volume.

The work produced for non-profit may do without or request the ISBN System.

Assignment of ISBN to Computer Programs

Art. 7.-An ISBN number will be assigned to each computer program. If there is more than one version, each must have a different number. If the programme is revised and modified in any way, the point of constituting a different edition will be assigned a different ISBN number. No new number will be allocated when an existing product is launched on the market, even if it involves a change of packaging or other non-essential factor. If the programme is accompanied by a manual, which is applied to it and sold together, it must have the same number of ISBN.

List of publications

Art. 8.-The publishing houses must submit annually to the National Agency a list of all their publications, in which the name of the work, the number of the tirage, the name of the author and the ISBN number, for the purposes of updating

User Rights

Art. 9.-The user of the ISBN system has the following rights:

a) To be assigned a number of the ISBN to each of its new works and productions, as well as to its new editions.

b) That such number be incorporated into an international catalog.

c) That by means of a catalogue, the work or production can be sponsored and marketed internationally by the Agency International of the ISBN and CERLALC.

d) That the assigned number be printed on the back cover and back of the paste or cover of each published copy.

e) That the National Library incorporate the work into its public catalogues and that the titles be included in the library collections for general use.

Obligation of Authors and Editors

Art. 10.-Before starting the publication of a work or production listed in the previous article, the author or publisher must appear before the National Agency of the ISBN, in order to be assigned its number. Authors and publishers who do not use the ISBN system will not benefit from the benefits of this Act.

Form Delivery

Art. 11.-An author or editor who will first process the assignment of the ISBN number, must fill out a form with all his personal data and any other information that is required by the Agency. This form will produce a file in which you will record all the works produced by that author or publisher, as well as any modifications made to the personal data.

This form will contain the following information: Name of the publisher, address, telephone, fax, e-mail and information about its annual editorial production. The form will be prepared and reviewed regularly by the National ISBN Agency and will meet the requirements of the International ISBN Agency.

In addition to the above mentioned form, the author or publisher must complete another form for each title that is published, which will be used for the assignment of the respective ISBN number. The National ISBN Agency will submit these forms to the author, publisher or representative of the publisher who requests it. The forms will be drawn up by the National Agency, in accordance with the standards established by the International Agency of the ISBN.

Document Presentation

Art. 12.-The person concerned shall submit to the National ISBN Agency, together with the duly completed form, the following documentation:

a) The bibliographic sheet of the work, drawn up by a graduate librarian. This will use the Materia Table, provided by CERLALC.

b) Portada of the book to be edited.

c) General index or table of contents of the book.

d) Introduction, prologue or preface of the work.

e) Photoscopy of the Enrollment in the Registry of Commerce of the publishing company. This document will only be required when the procedure is performed by the editor or the representative of the publisher.

Assignment of the ISBN Number

Art. 13.-When the respective forms and documentation are accepted, the Agency shall allocate the number of the ISBN. The number stipulated for the respective work will be recorded in written certification, which will be accompanied by an original bibliographic document to be printed on the back cover of the book.

The application forms will remain in the Records of the Agency for the purposes of carrying out internal control in the Book of Records and the compilation of the National Catalogue of the ISBN.

CHAPTER III FINAL PROVISIONS

ISBN National Catalog

Art. 14. The Agency shall carry out a check on the bibliographic records to which the ISBN has been assigned to the organization, edition and publication of the National Catalogue. This catalogue will be reviewed and published annually.

The database used for the compilation of the national catalogue will be sent to the International ISBN Agency and CERLALC, for these entities to incorporate into their publications.

Previous Editions

Art. 15.-In the event that the first edition of a book has taken place prior to the date of validity of this Law, the Salvadoran Agency will grant a number to reprint or reissue after that date.

Vigency

Art. 16. -This Decree will enter into force eight days after its publication in the Official Journal.
