DECREE NO 469.-

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

WHEREAS:

I. That the Constitution in its Article 1, Section 3 states that it is the obligation of the State to assure the inhabitants of the Republic, health, education and culture; therefore, sports activity is a factor of vital importance that contributes to its compliance.

II. That by Decree Law No. 300, dated June 28, 1980, published in the Official Journal No. 122, Tomo 267, dated: 30 of the same month and year, the General Law of the Sports of El Salvador was issued, which does not respond to the current sports reality.

III. That sporting activity has an essential role to improve the quality of life of the population, mainly in relation to the physical and mental health of people; consequently, it is the primary obligation and purpose of the State, its conservation, promotion and dissemination.

IV. That physical activity and sport constitute factors through which both physical and mental faculties develop, and it is the duty of the State to promote and support them, as essential factors of the process. educational and social integration, with emphasis on the mass of sport, volunteering and adequate protection for athletes and athletes.

V. That for all the above, it becomes necessary and appropriate to issue a new General Law of the Sports of El Salvador.

DECRETA the following:

EL SALVADOR SPORTS GENERAL LAW

TITLE I PRELIMINARY PROVISIONS

CHAPTER I

Of the object of the law

Art. 1. The purpose of this law is to lay down the general principles and rules to which sports policy must be oriented in the country; and to establish the bodies responsible for preparing, disseminating and implementing the policy of the Status in this matter.

Principles

Art. 2. Public administration shall ensure access to sport and organized physical activity to the public in accordance with the following guiding principles:

a) ACCESSIBILITY: Facilitation and promotion of the practice of sport and activity physical for the population, including people with special abilities and the older adult, for full social integration.

b) SOCIAL WELFARE: Sports practice and physical activity as factors that improve health, increase the quality of life and social welfare and contribute to the training and integral development of the individual through the promotion and practice of values.

c) CULTURE: Sport and physical activities as cultural manifestation and activities of general interest fulfil a social function.

d) SPORTS ethics: Sport and physical activity must preserve the healthy competition, the pundonor and the respect to the established norms.

e) GENDER EQUITY: Equation of opportunities for men and women, in access to sport, physical activities and sports structures, in accordance with international conventions and treaties ratified by the country.

f) EQUALITY: All people have the right to sport and activity regardless of nationality, social status, race, sex or religion.

g) LEGALITY: Sports bodies and participants shall benefit from the legal and disciplinary regimes applicable to them.

h) The recognition of sport and physical activity as important elements of social integration, of the occupation of free time and the prevention of harmful behaviors to society and violence.

i) PROBITY: Transparency in the administration of public and private goods and resources in the field of sports and activities physical.

j) VALUES: Development of a sports culture solidly based on the observance of fundamental human values.

k) UNIVERSALITY: All inhabitants have the right to the practice of sport and physical activity without any discrimination.

Public Utility Declaratory

Art. 3.-The organization, promotion and development of sport throughout the national territory is declared of social interest and of public interest.

The Executive Body is obliged to guarantee to the inhabitants of the Republic the fundamental right of access to sport, physical activity and the teaching of physical education.

To make the enjoyment of such rights effective, sport and physical education will be the focus of attention, encouragement and support from the State.

Definitions

Art. 4.-For the purposes of this law:

Athlete: A sportsman who possesses, the product of a systematic work, a physical capacity, strength, agility or superior resistance to the average and consequently, is suitable for activities physical, especially for competitive ones.

High-performance athlete: Is the athlete who possesses optimal faculties, qualities and physical skills, that through a delicate and appropriate physical and competitive training, technical- Tactical has achieved excellent mastery and execution in a sports discipline.

Elite Athlete: He is the high performance athlete, who possesses special talent, exceptional physical condition, with mental preparation, with a scientific and systematic work of training, which manages to reach gold medals in Games Central American and the Caribbean and any medal class at the Games Panamericans, Olympians and World by Discipline.

Active Athlete: He is the high performance athlete enrolled in a sports federation that meets his training plans and competitions outlined by the federation.

Featured Athlete: It is the athlete who excelled for his performances in the sports competitions he participated in, thereby causing a greater impact on the sport in general, as well as, an advertising display of his exploits having demonstrated an exemplary conduct in and out of the competition scenarios, becoming a positive model for childhood, youth and national pride.

Physical Activity: Movement of the human body that produces an energy expenditure above the resting metabolic level, oriented towards recreation and health, which may or may not have an organized and competitive character.

Sports Association: Are sports associations, not for profit, those organizations integrated by natural or legal persons, of a private nature whatever their structure, which, according to its social object, promotes, practices or contributes to the development of sport and physical activity.

Classes and Groups of Drugs: The term "classes and pharmacological groups of agents or methods of doping" shall mean those prohibited by International Sports Organizations and appearing in lists that for the effect publish the INDES, in accordance with the provisions of the Medical Commission of the International Olympic Committee and the World Anti-Doping Agency.

Sports Club: Private organizations, integrated by persons The main objectives of the programme are the promotion, development and continuous practice of the physical and sporting activity within or outside the federated scope.

Sportsman: It is every natural person who practices physical activities of any kind, for eminently recreational purposes, health and the use of free time.

Federated Sport: It is the one that is practiced in a systematic way with essential objectives of competition, in the various categories and levels of quality, according to the regulations of classification of its federation and according to the regulations established by the respective international federation. Their development is the competence of the National Sports Federations.

Unfederated Sport: It is the one that is practiced with essential objectives of recreation, health, rehabilitation, development of values, use of free time and socialization, in the different sports branches and ages, according to the internal rules of their respective organization. The development of these activities will be the responsibility of spontaneous, public and private organizations.

Sport: All forms of physical activities that, through a participation, organized or not, have the objective of expression or improvement of the physical and mental condition, the development of social relations and the obtaining of results in competition of all levels.

High Performance Sport: Regulated and developed activity in competitions that aim to achieve the highest level of sport.

National Delegation: It is the integration of selected athletes, coaches, psychologist, doctor, masseur, delegate, grouper, and other body technical and support staff, representing the country in international events, whether official composition or invitation. Within the Olympic Cycle you will be known as the Olympic Quota.

Doping: It is the use or administration of substances or the use and application of prohibited methods aimed at artificially increasing the physical capabilities of the

Physical Education: A pedagogical process aimed at improving the skills of the motor, leading to an adequate level of fundamental physical qualities.

Sports Entity: is any territorial base organization that, coordinated by the INDES, will develop the national policy of promotion and mass of sport.

Team: A set of athletes who are required to participate in a sporting competition.

Sports Leagues: sports teams participating in a competitive event organized by a national sports federation or other recognized sports body in the country. The leagues can be part of the organizational structure of the federations or only participate in the competencies in which they are registered.

Physical Recreation: Any kind of voluntary activity that makes it possible to make good use of the free time, involves body movement, which generates joy and personal satisfaction.

National Selected: It is every athlete who has been chosen for his outstanding performance, by a technical body based on technical criteria and disciplinary selection, to represent the country in terms of competence international, which is an official or an invitation, which is a high honor that the country confers.

National Selection: It is all group or set of national selected, called by their respective Federation Sports, to represent the country in competitions of an international character, whether it is this official or an invitation made inside or outside the national territory.

CHAPTER II OF THE SPORTS POLICY

Policy Guidelines Sports

Art. 5. The purpose of the State's sports policy is to provide the sport with a social content, which contributes to the integral formation and the full development of the person, guiding it especially to the following:

(a) The promotion of sport and physical activity, for men, women and the elderly, including people with special abilities as a way of creating good social habits among the population.

b) Support for the federations, subfederations, associations, clubs, committees and other organisations sports, as basic structures that foster the development of sport and physical activity.

c) Coordination with the different public and private sectors for the promotion, mass of sport and physical activity.

d) Training and training of the human resource in science and technology related to sport.

e) Development of research in the sciences and techniques applied to sport and physical activity.

f) Stimulating athletes and persons whose relevant merits in the field of sport make them worthy of them.

g) Promoting sport through the private sector and establishing incentives for the development of sport and physical activity, as a complement to public investment.

h) Development of high level sport as a factor that strengthens national pride, promotes the formation of positive models and stimulates grassroots sport.

i) Access of the population to public sports facilities, respecting the rules of use established by the entity that manages and the installation's own vocation.

j) Dissemination and promotion of fair play in practice

k) Elimination of methods and consumption of prohibited substances harmful to the health of the sportsman.

l) Establishment of preventive, corrective and sanctioning measures of violent and anti-sports acts.

m) Promotion of the construction of sports facilities in a context friendly to the environment in the national territory.

n) Strengthening integration, fraternity and peace of peoples through sport.

ORGANISMS TITLE II

CHAPTER I OF THE NATIONAL INSTITUTE OF SPORTS OF EL SALVADOR

Creating INDES

Art. 6.-Create the National Sports Institute of El Salvador, rector of sport in the country, with legal personality and own patrimony, which will be governed by the provisions of this Law and its regulations. INDES may be referred to in the text.

The INDES will be related to the Executive Body through the Presidency of the Republic.

The INDES, will have to coordinate with the Organs of the State, its dependencies and the municipalities; as well as with private entities, in order to unite efforts for the training, specialization, research and development of physical and sports activities; as well as their medical care.

INDES Address

Art. 7.-The domicile of the INDES, will be the city of San Salvador, which can be established in another place of the Republic by chance or force majeure. You can set representations anywhere in the Republic.

INDES Competencies

Art. 8.-Compete to INDES.

a) Develop, establish, coordinate, execute, monitor and evaluate the national policy of sports and physical activity, determining the measures necessary to promote its mass.

b) Encourage, perform and coordinate the research and development of science applied to sport and physical activity.

c) Develop programmes for the training, updating and accreditation of the human resource linked to sport and physical activity.

d) Provide technical and economic assistance to public and private sports entities dedicate to the promotion and practice of sport.

e) Coordinate with government institutions and municipalities, program execution and use of resources for the development of sport and physical activity.

f) Provide technical specifications for the construction of sports facilities and facilities, including safety and condition aspects

h) Collaborate with the Ministry of Education in the implementation of the programmes

Steering Committee

Art. 9.-The direction of the INDES will be carried out by a Steering Committee, which will be responsible for preparing, approving and implementing national sports policy and directing the administration of the INDES.

Integrating the Steering Committee

Art. 10.-The Steering Committee consists of seven owners and seven alternates; distributed as follows:

Four owners and four public sector alternates, who will be appointed by the President of the the Republic and shall perform their duties during the presidential term of the Republic. One of them will be the President of the INDES.

Three representatives and three alternates of the Sports Federations of the country, who will be elected for a period of 3 years in General Assembly of the same, specially convened for this effect by the INDES, being able to be reelected.

The alternate members of the Committee shall replace their respective owners in the event of death, resignation, impairment, absence, excuse or any other reason, which shall be justified to the Committee. If the absence is final, the respective alternate member will assume the position, until the end of the period for which he was elected.

Of the General Assembly of the National Sports Federations

Art. 11.-The General Assembly of the Sports Federations referred to in the previous article, shall be held at least once a year, in order to address other issues related to the development of the sport, by convening of the INDES Steering Committee, or at written request of a third of the Federations

Sports recognized and registered by this.

Requirements to be a member of the Steering Committee

Art. 12.-To be appointed or elected member of the INDES Steering Committee, it is required:

a) Be a Salvadoran and over 25 years old.

b) Be of morality and notary competencies.

c) Be in some way related to sport.

The members elected by the federations must be active members of any of the Sports Federation recognized and registered by the INDES.

Incompatibilities

Art. 13.-They may not be members of the Steering Committee:

(a) Those who have been convicted of serious crimes or against public finances or property of public administration and property crimes.

b) Those who are not solvent with public or municipal finance.

c) Those with managerial positions in the Olympic Committee of El Salvador.

d) The spouse or relatives within the fourth degree of consanguinity or second degree of affinity.

e) Those who are they are suspended or expelled from any of the recognised Sports Federations and registered by the INDES according to this law, regulation or its statutes.

Powers of the Steering Committee

Art. 14.-They are the privileges of the Steering Committee:

a) Approve your Rules of Procedure and others that you consider necessary for its operation.

b) Approve the modifications to your organizational structure.

c) Approve the job plans

d) Dictate the institutional policies for the preparation of the annual budget, in harmony with the budgetary policy approved by the Council of Ministers.

i) Authorize the availability of the real estate and furniture of the INDES, under the legal figure that is derived according to the corresponding laws.

j) Approve the Statutes of the Federations and Sports Associations national, which must comply with the requirements laid down in this Law and its regulations, granting them their legal personality and authorizing their registration in the register which for this purpose will carry the INDES.

k) Approve the annual economic allocation for each National Sports Federation and other sports organizations.

l) Establish control and control measures to be implemented in the Federations, Subfederations, Associations and other sports organizations to which they have been assigned in any form of State funds.

m) Issue agreements aimed at normalizing the administrative and sports functioning of the federations, Subfederations, associations and other sporting organisations, in compliance with the provisions of the Law. Such agreements shall be in accordance with the statutes of each Federation and shall not exceed 2 years.

n) Approve the hiring of External Audits when deemed necessary, for INDES or to audit a Sports Federation National.

o) Recognize the Boards of Directors of the elected federations according to their own statutes.

p) Encourage the creation, training and permanent updating of the Arbitration Associations. You will only recognize a Sports Association.

q) Call the General Assembly at least once a year to the National Sports Federations.

r) The others that point to this Law and its regulations. Steering Committee meetings

Art. 15.-The Steering Committee shall meet ordinarily once a week and extraordinarily whenever it deems necessary.

The members of the Steering Committee shall pay per diem for the ordinary sessions to which they attend, in no case shall they be be more than four a month. The president will not have any diet.

Valid Quorum for Sesionar

Art. 16.-In order for the Steering Committee to be validly sessioned, four of its members will be required to attend.

The agreements will be taken, at least, with four votes and in the event of a tie, the President will have a vote of quality.

The Executive Address

Art. 17.-The Executive Directorate of the INDES will be exercised by its President, who will be full time and will have the obligation to execute and enforce the agreements and resolutions of the Committee.

Privileges of the President of the INDES

Art. 18.-The President of the INDES has the following powers:

a) Represent judicial and extrajudicial to INDES;

b) Coordinate the elaboration of the national sports policy project with the participation of the sectors

c) Ensure compliance with the guidelines set out in Art. 5 of this Law.

d) Formulate and submit to consideration and approval of the Steering Committee, the draft budget.

e) Prepare and subject to consideration and approval of the Steering Committee, the annual memory.

f) Name, hire, remove, license and point out work schedules in accordance with the laws, administrative and technical staff.

g) Convocation to the Special session steering committee, on its own initiative or at the written request of three of its members.

h) Support the development of national and international sports activities.

i) Develop the draft internal regulations and other regulations which it considers necessary for the consideration and approval of the Steering Committee.

j) Grant official missions when deemed necessary and in those cases which, due to their specific characteristics, are appropriate to the regulations in force.

k) Propose to the Steering Committee the approval of the legal status of the Federations.

l) Coordinate with others public and private bodies, the organisation and implementation of programmes, projects and activities that promote the development of sport and physical activity.

m) Build, manage and receive any title of goods intended for development and practice of sport.

n) Approve and conclude agreements on sports cooperation with national and international institutions in coordination with the competent body.

o) Propose to the Steering Committee the modification of the organisational structure of the INDES.

p) Manage additional resources to the budget for the development of sport and physical activity.

q) Contry, after approval of the Steering Committee, the External Audits that it deems necessary.

r) All those other privileges and duties that may be assigned to you by laws, regulations and administrative provisions or that are mandated or delegated to you by the Steering Committee.

Tax Exemption

Art. 19.-The INDES shall enjoy exemption from all taxes, including municipal taxes on goods, income or income of any kind or on the legal acts, contracts or business that it carries out; as well as, of the fees and other rights of the Center National Register provided that these must be paid by law by the INDES.

Heritage

Art. 20.-The heritage of the INDES will be constituted as follows:

a) All national sports facilities and scenarios built or in the process of construction, owned by the INDES.

(b) Goods transferred to it by the State or its decentralized institutions.

c) The goods it receives by way of donation, subsidy or any other type.

(d) The resources that you obtain from the operations of the management of your assets.

e) The funds from the General Budget of the Republic.

f) The extraordinary contributions received by both the Government of the Republic and others national or international entities.

CHAPTER II OF THE STATE SPORTS Entities

Of State Sports Entities

Art. 21.-The following are sports entities:

a) Departmental Sports Committee.

b) Municipal Sports Committee.

Of The Departmental Sports Committees

Art. 22.-The Departmental Sports Committees will be integrated as follows:

a) A representative of the INDES, who will be the president.

b) A representative of the Ministry of Education.

c) A representative of the Ministry of Education of Public Health and Social Care.

d) A representative of the Departmental Committee of Mayors.

e) A representative of the federated sport

f) A representative of amateur sport

g) A person of recognized hobby and sports spirit.

The respective regulations will establish the choice and selection of the representative to which the literals f) and g) of this article are related.

Departmental Sports Committees Competences

Art. 23.-Compete the Departmental Sports Committees:

a) Promote the development of national sports policy at the departmental level.

b) Support the municipal sports structure.

c) Develop the annual work plan for the development of sport at the departmental level.

d) Develop a budget projection that allows the implementation of the annual work plan.

e) Manage resources from the public and private sector as well as international cooperation.

From The Municipal Sports Committee

Art. 24. The Municipal Sports Committees will be integrated as follows:

a) A representative of the City Council, who will preside over it.

b) A representative of the INDES.

c) A representative of the Ministry of Education.

d) A representative of the Ministry of Health and Social Care.

e) A representative of the federated sport.

f) A representative of amateur sport.

g) One person of recognized hobby and sporting spirit.

In the cases of the literals (f) and (g) shall be carried out in accordance with the provisions of the final paragraph of Article 22 of this Law.

The aforementioned authorities shall exercise their competence at the level of the municipal.

As long as there is no federated sport in the municipalities, one more representative will be appointed of amateur sport.

Municipal Sports Committee Skills

Art. 25.-Compete to the Municipal Sports Committee:

CHAPTER III OF THE COMMITTEE OLYMPIAN OF EL SALVADOR

Recognition of the Committee El Salvador Olympian

Art. 26.-The Olympic Committee of El Salvador is recognized as a public utility, with legal and non-profit status, which is governed by its own Statutes and the Olympic Charter.

CHAPTER IV OF THE FEDERATIONS SPORTS, SUBFEDERATIONS

AND SPORTS ASSOCIATIONS

Of Sports Federations

Art. 27. For the purposes of this Law, Sports Federations are those made up of Sports Associations, Sports Clubs, Sports Leagues, Teams, Coaches, Referees or Athletes. The Federations are entities of public utility, with legal personality and non-profit. These Federations shall be governed by this Law.

The Statutes of the sports federations shall conform to the requirements laid down in this Law, and in what is not regulated, shall be governed by the provisions of the Law of Non-Profit Associations and Foundations.

Recognition of National Sports Federations

Art. 28.-National Sports Federations are the ultimate authority in their sport and can only be recognized by the INDES one for each sport, according to the recognition of their respective International Federation.

National Sports Federations

Art. 29.-National Sports Federations shall have their domicile in the place where they determine their statutes.

In case of change of domicile, the public deed of constitution shall be amended.

Integration of the General Assemblies

Art. 30.-The General Assemblies are the highest authority of the National Sports Federations and will be integrated according to their own Statutes.

Choosing the members of the Boards

Art. 31.-Members of the National Sports Federations ' Boards will be elected for a period of 4 years.

Requirements to be a Board Member

Art. 32. To be elected member of a Board of Directors of a National Sports Federation, the requirements of Art. 12 of this Law must be fulfilled.

The incompatibilities established in Art. 13 shall also apply to them.

Funds Fiscalization

Art. 36.-The administration of the funds allocated by the State to the National Sports Federations and those generated with the assets of the INDES, will be subject to the audit and audit of this and the State Comptroller.

Report to INDES

Art. 37.-The National Sports Federations shall report monthly to the Institutional Financial Unit of the INDES, the income they generate with the use of the INDES patrimony.

Art. 40.-The subfederations are auxiliary and collaborative sports entities of the respective federations, of whom they depend directly.

Only one Subfederation can be constituted by each department of the Republic.

Competence

Art. 41.-The competition of the subfederations shall be determined by the statute and the regulations governing their respective National Sports Federation, and shall be limited to their respective department, where they are constituted.

Delegation

Art. 42.-The subfederations shall fulfil the privileges and duties delegated to them by their respective federations.

Art. 43.-The members of the boards of the subfederations must meet all the requirements that are necessary to be a member of the boards of the federations and will have their own privileges and duties.

Art. 44.-Federations, subfederations, and other national sports associations recognized and regulated by the INDES by means of this Law and their administrations, shall not be considered as members, organs or officials of the administration

CHAPTER V

CREATION, PURPOSE, AND ORGANIZATION OF THE NATIONAL REGISTRY OF NATIONAL SPORTS FEDERATIONS AND ASSOCIATIONS

Creating the Registry

Art. 45.-Create the National Register of Federations and Sports Associations, as a dependency of the INDES, hereinafter referred to as "the Register", with a public character, which will have national jurisdiction and in which the Federations and National Sports Associations, as well as their respective Representation Bodies, which shall be covered by this Law. Registration will be granted free of charge, subject to compliance with the requirements by the stakeholders established in this Law and its Regulations.

The INDES will collaborate through agreements with the Ministry of Education and the accredited higher education institutions, which will develop training and specializations in the field of sport, in order to establish the curricula of sports training courses, research processes and teaching updating, in the field of science applied to sport.

From Authorizations

Art. 48.-Private institutions or institutions engaged in the training, training and specialization of human resources involved in the development of sport, must have the status of accredited, in accordance with the Law of Education Top.

CHAPTER II PROTECTING SPORTSMEN AND ATHLETES

Regulation of Sports Facilities

Art. 52.-The INDES will regulate the conditions of hygiene and health of the sports facilities.

Art. 55.-The INDES, in collaboration with the national sports federations, will adopt the control and inspection measures that favor the health and prevention of accidents in the sports activity, according to the characteristics of each modality.

Control Rules

Art. 56.-INDES, will establish and require control standards that federations, coaches and other sports officials must comply with in terms of plans and practices of safe sports training and maintenance of levels optimal health of the athletes.

Insurance Against Accidents and Life

Art. 57.-INDES will manage hospital medical insurance, against accidents and life, to the delegations when they represent the country at national and international events.

For high performance athletes, with elite category, It will be permanent, while retaining this category, of which the INDES will be responsible.

Job Insertion Programs for Athletes

Art. 58.-INDES will be able to manage, through public and private institutions, programs of enabling and insertion in the labor sector for the athletes, as well as to promote the establishment of agreements with institutions of higher education that promote the academic continuity of the athletes.

Studies for Athletes

Art. 59.-INDES will coordinate with the Ministry of Education and universities, special studies programs for high-performance athletes that will allow for a better fit of their time for study and sport.

Athletes

Art. 60.-The athlete and the technical staff who integrate a national team possess the investiture of the official representative of the country and consequently the work centers and the state and private educational centers, will be obliged to give the corresponding, in accordance with the current regulations.

CHAPTER III PREVENTION AND CONTROL OF DOPING IN SPORT

Observance and Application

Art. 62.-INDES shall ensure compliance and enforcement of international doping standards and develop educational and prevention programs on the use of prohibited methods and substances.

Art. 63.-INDES with the support of the Ministries of Education and Public Health and Social Care and other state, private or sports bodies, will develop and implement preventive programs on the use of prohibited methods and substances in sport, in the national education system.

Anti-Doping Control

Art. 64.-Athletes and support personnel, Salvadorans and foreigners, who act in competitions and events held in the country must be subject to national and international anti-doping control standards.

Violation of the Rules Anti-Doping

Art. 65.-The athlete who incurs in violation of the anti-doping rules, will be punished according to the international anti-doping provisions.

National Anti-Doping Commission

Art. 66.-The INDES shall establish the National Anti-Doping Commission, involving for that purpose, the public or private bodies which, through their respective powers, may be part of that Commission. Your integration and operation will be developed in a special regulation.

Art. 67.-It is the responsibility of the State through the Superior Council of Public Health, to require the companies producing and importing products containing prohibited substances for the athletes, to record in the packages and labels the warning "this product contains prohibited substances for athletes" according to Annex 1 of the International Convention against Doping in Sport.

TITLE IV OF THE SPORTS FACILITIES, PHYSICAL EDUCATION,

OF THE DEPORT STUDENT AND SPECIAL SPORT

CHAPTER I SPORTS FACILITIES

Sports Area Reserve

Art. 68.-The Ministry of Public Works, Transport and Housing and Urban Development through the Vice-Ministry of Housing and Urban Development, and the Municipal Technical Offices with favorable opinion of the Vice-Ministry of Housing and Development Urban, in order to exercise the functions of approval of projects of parking and urbanization, they must ensure that they have the respective green areas duly equipped for the physical activity and the sport. Security and Prevention of Violence in Sports Facilities

Art. 72.-The INDES will have to draft a regulation on security and prevention of violence in sports facilities taking into account the following criteria:

a) Senalization of emergency exits, safety, hygiene and others.

b) Prohibition of tobacco use, intoxicating beverages and all kinds of narcotics.

c) Responsibility of event organizers.

d) Control of people's income.

e) Sales of tickets.

f) Sale of other products.

g) Obligations of the spectators.

h) High risk events.

i) Control of hazardous objects and instruments.

j) Security devices.

Use of Advertising

Art. 73. The use of advertising in public or private sports facilities should correspond to the promotion of the practice of ethical and moral values. In no case will the use of propaganda that incites violence and drug use be allowed.

CHAPTER II OF PHYSICAL EDUCATION

Physical Education and Student Sport

Art. 74. The teaching of Physical Education will be aimed at contributing to the integral development of education, cultivating its creativity and physical psycho-psychomotor skills and as an essential element for the integral development of its personality.

From Competition

Art. 75.-The teaching of Physical Education, as well as teacher training and training, will be the responsibility of the Ministry of Education through the General Law of Education and the Law of Higher Education respectively.

Special Sports Associations

Art. 79.-The sports associations of persons with special capacities duly constituted and registered in the INDES, will be included in their budget and will be part of their plans of work.

TITLE V OF THE MANAGEMENT OF RESOURCES FOR THE DEPORT

UNIQUE BUDGETARY ALLOCATION

Art. 80.-The State shall assign to the INDES the necessary funds for the development of the national sport and implement the provisions of this Law.

Stimulus

Art. 81.-It is up to the INDES and the public sector institutions to grant and promote in the field of their respective competences, incentives to the national athletes, technicians and sports organizations in accordance with the provisions of this Law and your Regulation.

Stimulus Types

Art. 82.-The stimuli provided for in this law may consist of:

a) Money or species.

b) Scholarships for education and training.

c) Technical assistance.

TITLE VI OF THE VIOLATIONS, SANCTIONS AND ADMINISTRATIVE PROCEDURES.

CHAPTER I

Sports Entities Discipline Provisions

Discipline Provisions

Art. 87.-The Federations and Sports Associations shall provide in their statutes or regulations the following:

a) A system typified for violations, for leaders, athletes, and technical and administrative personnel in accordance with the rules and

Art. 90.-Serious violations are considered as follows:

b) Not to apply for recognition of INDES, nor to register in the respective Registry, which will have the effect of this.

c) Failure to comply with and prevent compliance with its statute, regulations and other applicable rules.

d) Not to carry formal accounting in accordance with generally accepted accounting principles; nor shall it present: the statement of budgetary execution; the cash-cash report; the balance sheet; the statements of revenue and expenditure, as determined by the INDES.

e) Not to present to INDES, in the month of February of each year, memory of the activities carried out during the previous year, including the financial statements duly audited, in addition any other information and data that the INDES request.

f) Do not administer the resources of the National Sports Federation with transparency and efficiency, whether they are from the INDES or from any other lawful management carried out by it.

g) Prevent audits by the INDES and the State Comptroller, without prejudice to the responsibility to which it takes place.

h) Negotiate or collude the results of any sporting event.

Intimidation or Coaction

Art. 92.-Any member of an association, federation or national sports subfederation who agrees, intimates or coerced judges, referees, sportsmen, coaches, coaches, delegates and managers in order to achieve a favourable result in a Sports event will be sanctioned with suspension of participation in the federal and sports activities from 1 to 2 years.

In case the offence mentioned in the previous paragraph, is committed for the second time, the sanction will be the suspension of participation in the 2-to 5-year federative and sports activity.

Incitation of Violence

Art. 93.-The athletes, coaches, coaches, judges, referees, directors or members who, through public statements, incite the teams or the spectators to the violence, will be punished with suspension of participation in the federative activity and 1 to 2 years.

In case the violation mentioned in the previous paragraph is committed for the second time, the penalty will be suspended for the offender to participate in the federal and sports activities from 2 to 5 years.

National Selection

Art. 94.-The one who without a fair cause will refuse to integrate the respective national teams, will be punished with the loss of the benefits and stimuli granted by this Law for 2 years and with the suspension of their participation in all sporting events national and international for 1 year; except that, the Federation to which the alleged infringer belongs is not up to date with the stimuli, benefits, agreements or contracts they have acquired with it, if any.

Criminal Responsibility

Art. 96.-When a conduct that violates this law and the regulatory provisions arising therefrom is sanctioned, and that of such conduct can be derived criminal responsibility, the governing body of the sport will make of the knowledge of the competent authority, to exercise the respective criminal action.

CHAPTER III OF THE SANTIONS

Sanctions Classes

Art. 97.-For violations committed to this law, the following minor, serious and very serious sanctions will apply.

Imposition of sanctions

Art. 98.-The imposition of the penalties shall be made in accordance with the nature of the infringements, as follows:

a) The minor infractions shall be sanctioned with a fine ranging from the equivalent of 1 to 5 minimum monthly salaries

b

Serious infringements shall be punishable by a fine which shall be between the equivalent of 6 and 15 months. urban minimum monthly wages established for the commercial sector, or the suspension of the infringer of participate in the federative and sporting activity from 6 months to 1 year.

In case the offence mentioned in the previous paragraph is committed for the second time, the sanction will be the suspension of the offender to participate in all federative activity and

c) Very serious infringements will be sanctioned with a fine ranging from the equivalent of 16 to 25 urban minimum monthly wages established for the commercial sector, or the suspension of the offender to participate in the federal and sports activity from 1 to 2 years.

In case the infringement mentioned in the previous paragraph, the second time, the penalty will be suspended for the offender to participate in all federal and sports activities for a period of 5 years.

Application of Sanctions

Art. 99.-For the application of the sanctions, the INDES shall take into account as principal

criteria for the graduality of these, as set out in Article 95; the intentionality of the infringer, the economic capacity of the infringer, the recidivism in committing for the second time an infringement of the same nature declared by resolution firm, except in the case of serious and very serious infringements, nature of the damages caused and the circumstances in which the violation is committed, as the case may be.

CHAPTER IV OF THE PROCEDURE FOR IMPOSING SANCTIONS

Of The Competition

Art. 100.-The INDES is the competent authority to know about the sanctioning procedure and to impose the respective sanctions when they incur violations of the provisions of this Law.

Initiation of the Procedure

Art. 101.-The sanctioning procedure must be initiated on its own initiative or by complaint filed by any member of a Federation, National Sports Association, Sports Agency, or any other interested party, before the Committee Director of the INDES.

Start Auto

Art. 102.-In the order initiating the procedure, the facts of the alleged infringer must be included at least, the infraction in which he may incur and the possible sanction to be imposed; as well as the summons for him to appear in the four days to manifest their defense. The notification must be made at the address of the offending federation or association.

probative term

Art. 103.-After the time limit set in the previous article, the term of the Board shall be opened for an eight-day period and the Steering Committee shall issue a resolution within ten days.

Resolution

Art. 104.-The resolution shall contain, in a clear manner, the relation of the facts, the adequacy of the facts to the conduct prohibited by this Law, and the imposition of the respective sanction of being appropriate.

Resource of Review

Art. 105.-Against the judgment handed down in the sanctioning procedure, the review appeal shall be brought, which shall be submitted no later than three days after the notification of the Resolution, to the Steering Committee.

The Committee analyse the appeal lodged and shall take a decision thereon at the latest within 10 days of the submission.

Final Resolution

Art. 106.-The resolution terminating the sanctioning procedure shall be motivated, containing a detailed account of the facts, the adequacy of the facts to the conduct prohibited by this law, the assessment of the evidence of charge and the discharge, the imposition of the respective penalty of being sourced and the legal arguments on which the imposition is based.

CHAPTER V OF THE STATE APPEAL AND ARBITRATION COMMISSION OF SPORT

Appeals Commission and Arbitration

Art. 107.-The Court of Appeal and Arbitration for Sport shall have full autonomy to dictate its resolutions and shall be composed of a President, who shall be appointed by the INDES Steering Committee, two full members and two alternates, who shall will be proposed by the Federations and National Associations in General Assembly called by the INDES. The appointments mentioned above must be made by persons with a degree of academic degree in legal sciences and knowledge in the field of sport, as well as recognized prestige and moral quality.

The President of the Appeals Commission and Arbitration for Sport, will last for 3 years in his order, being able to be ratified for one more period. The other members will last for 3 years and will not be able to be appointed for two consecutive terms.

The INDES will issue the necessary regulatory standards for the integration and functioning of the Appellate Commission and Sport Arbitration.

Appeals and Arbitration Commission Competences

Art. 108.-The Court of Appeal and Arbitration for Sport shall have the following powers:

a) To know and to administratively resolve the appeal of appeal against the resolutions issued by the sporting bodies and of the various sports commissions of each federation.

b) To know and to address the conflicts of an economic and sporting character that are raised between the Federation and Sports Associations, the athletes, referees, technicians, leaders and others participants in the sports activity.

c) The others who establish the rules regulatory.

Lead Computing

Art. 109.-All the time limits mentioned in this law in days, will be understood as working.

Of the Teaching Escalations

Art. 110.-Scalafonated teachers who provide their services to INDES, in any capacity, will enjoy the right to be counted as teaching service time and the corresponding scale promotion.

Application of Equity Gender

Art. 111.-For the purposes of this Law, it should be understood that the reference to a natural person, implicitly encompasses the female and male gender, unless otherwise specified.

Benefits in an equitable way

Art. 112.-The INDES Steering Committee, the COES, the State Sports Committees and the Boards of National Sports Associations and Federations shall ensure that the benefits arising from the application of this law, its regulations and more related rules, will benefit equally for both men and women.

Preventive Programs

Art. 113.-The INDES, COES and the Boards of Directors of the Federations and National Sports Associations, will have to develop educational programs and prevention of sexual harassment, sports violence and the hostile environment in the sports environment.

Sporting Conflicts

Art. 114-Conflicts of a sporting nature may also be resolved in accordance with the Law of Conciliation, Mediation and Arbitration.

What is not provided for in this Law shall be applied in an additional manner to the common law.

Art. 115.-National teams, participating in each official event, must use in the uniform indicated by the INDES or the corresponding federation, the colors of the National Pavilion.

TRANSIENT provisions

Art. 116.-The new National Institute of Sports of El Salvador created in this law, happens by the Ministry of Law to the National Institute of Sports of El Salvador created by Decree No. 300 referred to in Article 120 of this Law. Law, in all its rights and obligations.

Art. 117.-The current sports federations will have 1 year, starting from the current law, to comply with the provisions of article 27 of this law.

The Boards of Federations and Subfederations Sports, they will continue to exercise their functions and duties in accordance with their internal rules in which they do not object to the provisions of this Law, having to adapt their statutes and the election of the members of the Boards of Directors to the within the time limit referred to in paragraph 1 of this Article.

Those who do not comply with as set out in this article, they will not be entered in the register established in this Law.

Art. 118.-The President of INDES and the Steering Committee will continue to perform their duties until the end of the period for which they were appointed.

Art. 119.-The President of the Republic shall draw up the corresponding regulations of this Law, within 90 days of the entry into force of this Law.

REPEAL

Art. 120.-Derogase Decree No. 300 of the Revolutionary Board of Government, dated June 28, 1980, published in the Official Journal No. 122, Volume No. 267, dated: June 30, 1980 containing General Law of the Sports of El Salvador and its subsequent reforms.

VALIDITY

Art. 121.-This Law will enter into force, eight days after its publication in the Official Journal.
