LEGISLATIVE CONSTITUTIONAL REFORM AGREEMENT No. 4
THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
I. That the Constitution of the Republic Article 32 stipulates that the family is the fundamental basis of society and have the protection of the State, which shall enact the necessary legislation and create the appropriate organizations and for integration, welfare and social, cultural and economic development services.
II which in turn establishes the legal foundation of the family is marriage and it rests on the legal equality of spouses; it should be borne in clearly defined constitutional status, the scope of marriage and adoption.
III.- That in view of the foregoing in recitals is appropriate to make relevant amendments to the Constitution.

AGREES: The following amendment to the Constitution, issued by Decree Constituent No. 38 dated December 15, 1983, published in the Official Gazette No. 234, Volume No. 281 dated 16 the same year, the Constituent Assembly , which it is considered individually for ratification.
Art. Article 32 1. reformed as follows:.
"Art. 32. The family is recognized as the fundamental basis of society and have the protection of the State shall enact the necessary legislation and create the appropriate organizations and services for integration, welfare and social, cultural and economic development.
The legal foundation of the family is marriage and it rests on the legal equality of spouses. They will be working for marriage including men and women, and infants, who
meet the conditions set by law. Marriages between same concluded or recognized under the laws of other countries sex, and other unions that do not meet the conditions set by the Salvadoran legal system, will not take effect in El Salvador.
The State shall encourage marriage; but the lack thereof shall not affect the enjoyment of the rights established by law. "
Art. 2. Article 33 reformed as follows:.
"Art. 33. The law shall regulate personal and property relations between spouses and between them and their children, establishing reciprocal rights and duties on an equitable basis; and create the necessary institutions to ensure their applicability. He also regulate relations resulting from a stable union of a man and a woman, well born, and have no impediment to marriage. "
Art. 3. Article 34 reformed as follows:.
"Art. 34. Every child has the right to live in family and environmental conditions that enable their integral development, which will have state protection.
Adoption is recognized as an institution whose guiding principle is the best interests of the adoptee.
They will be empowered to take persons who meet the conditions established by law. the adoption by couples of the same sex is prohibited.
The law shall determine the duties of the State and create institutions for the protection of motherhood and childhood "
