INDEX LEGISLATIVE DECREE No. 42

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- under Article 172 of the Constitution corresponds to the judiciary the power to judge and make execute judgments in civil and commercial matters in the courts of First Instance and of second instance; also it provides that the organization and operation will be determined by law.
II.- Legislative Decree No. 372, dated May 27, two thousand ten, published in the Official Gazette No. 100, Volume No. 387, dated May 31 two thousand and ten, in his article 17, regulates processes pending the entry into force of the Civil and Commercial Code, they must be substantiated and closed cases no later than the expiration of two years from the entry into force of that legislation; term could be extended for a reasonable time that the Supreme Court would determine, prior diagnosis.
III.- because that next June 30 this year, the deadline referred to above recital, it was not enough, so it becomes necessary to extend that period for a period of eighteen months.
THEREFORE,
in exercise of its constitutional powers and initiative of the Supreme Court of Justice, DECREES
:
Art. 1.- extended for eighteen months, the purposes of Article 17 of Legislative Decree No. 372, dated May 27, two thousand ten, published in the Official Gazette No. 100, Volume No. 387, dated May 31 of two thousand and ten.
Art. 2. This Decree shall enter into force on 1 July of this year, after its publication in the Official Journal.
