1 index Legislative Decree No. 49 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the people who are elected to public office is first degree or second degree; mostly enjoy, a salary for such a function, is discounted those who for that very reason the percentage corresponding to the tax on income, as well as the respective discounts to cover their share of social security and pension savings; This not being the case applicable, for the owners and alternate members in the performance of their duties in the municipal councils, lacking for this reason of social security and pension savings.
II.-that for the reason outlined earlier, is considered necessary to reform article 46 of the Municipal Code, in the sense of establishing that the remuneration payable by the owners and alternate members, in their corresponding functions, are subject of discounts from the respective contributions of social security and pension savings; in order to that the aldermen can have access to social security and to provide balance in their respective individual pension savings account.
III.-in accordance to article 131 ordinal 5 of the Constitution, is competence of this body of State Decree, authentically interpreted, reform and repeal laws secondary.

DECREES the following: reform the Municipal Code, issued by means of the Decree legislative No. 274 of date 31 January 1986, published in the official newspaper Nº 23, volume 290 dated 5 February of the same year.
Article 1.-reforming article 46, thus: "article 46.-the aldermen, smallholders and alternate, carry a remuneration for each of the sessions previously convened which attend, which may not exceed four per month and whose value will be fixed by the Council according to the economic capacity of the municipality." The amount resulting from the stated monthly remuneration shall be discounts corresponding to the Salvadoran Institute of the Social insurance, savings system for pensions and income tax.
The owners and alternate, aldermen who simultaneously to play another position or employment in any public or private entity carry the remuneration in the form and amount referred to in the previous paragraph, and must apply them only the discount relative to the income tax."
Article 2.-this Decree shall enter into force eight days after its publication in the official journal.
