INDEX LEGISLATIVE DECREE No. 86

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
.
I. That Article 168, ordinal 15 of the Constitution states that it is attribution and obligation the President of the Republic ensure the effective management and conduct of public affairs;
II.- by Legislative Decree No. 808, dated September 12, 1996, published in the Official Gazette No. 189, Volume No. 333 of 9 October of the same year, the Law of Creation of the Superintendency issued General Electricity and Telecommunications;
III It is necessary to establish the legal powers to enable the Public Administration select officials most competent private sector, through the openness and diversity of proposals; therefore appropriate to introduce corresponding amendments to the Law referred to in the previous paragraph a.
THEREFORE,
in use of its legal powers and initiative of the President of the Republic, through the Minister of Economy,
DECREES the following:
AMENDMENTS TO THE LAW OF CREATION OF THE SUPERINTENDENT GENERAL ELECTRICITY AND TELECOMMUNICATIONS
Art. 1. To substitute in § 6, first paragraph, letter b), by the following:.
"B) A Director of a non-governmental, elected and appointed by the President of the Republic, an open list of candidates of the trade associations of private enterprise with legal personality, non-governmental organizations concerned with issues of consumer protection sector or electricity and telecommunications directly with legal personality, universities accredited by the Ministry of Education and unions in enterprises engaged in activities covered by this Act. procedures concerning the literal present shall be governed by regulation.
The entities referred to in this literal wishing to include in the list candidates must select them according to their national law. "
Art. 2. The owner and deputy directors elected by private sector trade associations legally established in the country who are appointed to the date of entry into force

of this Decree, shall hold office until August 31, 2012, unless already appointed Directors pursuant to this Decree or in a new appointments process, according to the provisions of the this reform, in which case will fungiendo, as it is not done.
Art. 3. This Decree shall enter into force eight days after its publication in the Official Journal.
