1 index Legislative Decree Nº 95 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-Art. 168, ordinal 15 ° of the Constitution, establishing that it is attribution and obligation of the President of the Republic, to ensure effective management and conduct of the public business;
II. by Decree-Law No. 341, date of October 17, 1961, published in the Official Journal No. 191, volume no. 193 of the 19th of the same month and year, are issued the law of the national administration of aqueducts and sewerage systems;
III.-that it is necessary to establish the legal powers that allow the public administration, select more competent private sector officials, through the opening and diversity of ideas, what must be the corresponding reforms to the law referred to in the previous recital;
Therefore, in use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of public works, transport and housing and urban development, DECREED the following: reforms to the law of the Administration national of AQUEDUCTS and SEWER article 1.-Article 6 be replaced by the following: "article 6.-the powers and duties conferred by this law to the institution" as well as the general policy of the same, exercise them and determine a Governing Board composed of a President, five proprietary directors and five attachments. The President shall have a substitute. Such officials shall be appointed as follows: a) the President and his Deputy, by the President of the Republic;
(b) four owners and their respective deputies: by the Executive Body in the fields of public works, transport and housing and urban development, Interior, health and national planning and economic coordination Council;
(c) a landlord and his Deputy, representative of the non-governmental sector, elected and appointed by the President of the Republic, an open list of candidates of the Union entities of the private company with legal personality, non-governmental organizations with legal personality related to the theme of water, 2 unions legislative index of the institution and universities accredited by the Ministry of labour and Social Welfare and education respectively.
The entities referred to in point (c)), who wish to include candidates on the list, must select them according to their domestic systems.
Concerned about such appointments procedures will be regulated by law."
