THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 677, dated October 11, 1993, published in the Official Gazette No. 231, Volume No. 321, dated December 13 the same year, the Family Code was approved.
II that law, in Article 230, second paragraph, which refers to the need for judicial authorization to sell, provides that when judicial authorization to sell whatever tangible or intangible property, such sale shall be by public auction and the auction price will be the value that the experts assigned to such goods.
III that such a mechanism is detrimental to the heritage of the children, because it limits the pricing of good, eliminating the possibility of being sold in a sum greater than that assessment, being therefore necessary to reform the second paragraph of Article 230 of the Family Code, in the sense that if judicial authorization whatever to sell, the sale will be made at public auction and the price of it may not be less than the value that the experts asignaren to property.
THEREFORE,
in exercise of its constitutional powers and initiative of Congressman Rodolfo Antonio Parker Soto; and with the accession of Deputies and the Deputies: Lucia del Carmen Ayala Leon, Alma Rosa Cruz Sailor, Carmen Elena Figueroa Rodríguez, Rodolfo Antonio Martinez, David Ernesto Reyes Molina, Karina Ivette Sosa Lara, Guadalupe Antonio Vasquez, and Francisco José Zablah safie.
DECREES the following: REFORM
