1 Decree No. 241 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the exercise of the electoral jurisdiction, constitutional reforms created the Supreme Electoral Tribunal as the highest authority in this matter, with technical, administrative and financial autonomy, establishing clear and precise rules which ensure the equitable participation of the political forces responsible for the consolidation of democracy in our country.
II.-that the Electoral Code was issued by Decree legislative No. 417, dated December 14, 1992, published in the Official Journal No. 16, volume no. 318, on January 25, 1993.
III. the Electoral Code has as their primary aim to regulate the activities of the Electoral body, electoral management bodies, political parties and the activity of the State in regard to the election process.
IV.-that the State can have real roots of public finance in order to donate them, give them in usufruct, bailment or lease, prior authorisation from the Legislative Assembly to entities of general utility, constitutional precept enshrined in article 233 of the Constitution of the Republic.
V that the State and Government of El Salvador, in the field of finance, is owner of an urban nature property, located in the fifteen Street West, four thousand two hundred twenty-three number, between eighty and one and eighty-three North Avenue, Colonia Escalón, of the city and Department of San Salvador, a surface extension of a thousand thirty-six point seventy-three square meters (1,036.73 M2) which is registered to the number five of book a thousand nine hundred thirty and two from the registry's root property and mortgages of the first section of the Centre and it is required by the Supreme Electoral Tribunal, TSE, transferred him in as a donation, to be used for the operation of the offices of the entity.
VI.-that the Council of Ministers authorized the State and Government of El Salvador, in the field of finance, through the point of Act three B), session number SIXTEEN, two of February in the year one two thousand and twelve date, transfer in character of donation to the Supreme Electoral Tribunal the related property, it is not necessary for the purposes of public finances , but it is very useful to achieve the purposes of the institution.
Therefore, in use of his constitutional powers and at the initiative of the President of the Republic, by average index legislative 2 of the Minister of finance, DECREES: article 1.-authorized to the Executive Body in the field of finance, to donate free, simply and irrevocably in favor of the Supreme Electoral Tribunal, TSE, an urban nature property, located in fifteen calle poniente , number four thousand two hundred twenty-three, between eighty and one and eighty-three North Avenue, Colonia Escalón, of the city and Department of San Salvador, a surface extension of a thousand thirty-six point seventy-three square meters (1,036.73 M2); registered number five of book a thousand nine hundred thirty and two of the root property registration and mortgages of the first section of the Centre, Department of San Salvador and whose technical description is as follows: "a property located in fifteen calle poniente number four thousand two hundred twenty-three, between eighty and one and eighty-three Avenue North, this city" , which is described thus: "a lot of land segregated Hacienda San Diego, located in the suburbs of the district the ordeal of this city, a lot of land in the"Block"seventy-six"A"of the plan of subdivision, a surface of thousand and thirty-six square meters and seventy-three centimeters square, equivalent to one thousand four hundred and eighty-three rods square 35 hundredths of a square rod" , that measured and linda: to the North, 15 Street West of by half, twenty-four meters eleven centimeters, bordering with rest of Hacienda San Diego of shell widow of step e daughter, company; to the East, forty and three meters, with rest of the Hacienda San Diego of Concha widow of step and daughter, company; to the South, twenty-four meters eleven centimeters, with doctor Pedro José Rosales, and West, forty-three meters with rest of the Hacienda San Diego, widow shell step and daughter, company. Article 2.-the property that is authorizes donate will be used for the operation of the offices Central of the Court Supreme Electoral.
Article 3.-the value of the property in reference, in accordance with the valued practiced by the direction General of the budget of the Ministry of finance, is the sum of five hundred eighty and six thousand ninety dollars of the United States of America ($586,090.90).
Article 4.-exempted from the payment of registration rights that generates the transfer for the registration of the donation which will be made of the immovable object of this Decree, in favor of the Supreme Electoral Tribunal.
Also exempted from the payment of tax on transfer of real estate, resulting from the transfer granted pursuant to this Decree.
Article 5.-is responsibility of the Supreme Electoral Tribunal, the payment of taxes, and municipal contributions of the property described in article 1 of this Decree, the date that is using it.
Article 6.-empowering the Attorney General or official that this delegate, so on behalf of the State, granting the public deed of corresponding donation, before a notary that the Supreme Electoral Tribunal will designate.
