THE LEGISLATURE OF THE REPUBLIC DEEL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 487, dated 23 November 2007, published in the Journal official No. 222, Volume No. 377 dated 28 the same year, the Transitional Law for the Stabilization Rates Public Service Collective Passenger Transport was issued.
II.- by Legislative Decree No. 543, dated December 9, 2010, the effects of the legislative decree is extended for a period of one year, which ends on 31 December 2012.
III.- that the reasons that led to the Legislature for approval of the Transitional Law for the Stabilization Rates Public Service Collective Passenger Transport, still exist, and in order to continue to protect the family economy people who use the public transport of passengers, it is necessary to maintain current levels unchanged cost of bus fare and microbus through financial compensation to the transport sector.
IV.- That for the reasons stated above, it is necessary to extend for another year, the effects specified in the Act.
THEREFORE,
in exercise of its constitutional powers and initiative of Deputies Fidelia Norma Guevara of Ramirios and Sonia Margarita Rodríguez Siguenza, and Orestes Fredesman Deputies Ortez Andrade and Antonio Olivo Guillermo Mendez.
DECREES the following:
LAW REFORM TRANSIENT STABILIZATION OF PUBLIC SERVICE FEES COLLECTIVE PASSENGER
Art. 1. reformed the second paragraph of Article 7 as follows:.
"Resources in reference will be used to subsidize with HUNDRED DOLLARS OF THE UNITED STATES OF AMERICA (US $ 200) monthly to monthly authorized buses authorized microbuses and FOUR DOLLARS OF THE UNITED STATES OF AMERICA (US $ 400), both to provide the public service collective passenger transport. Transport units must have current circulation card, line permit duly authorized by the Vice Ministry of Transportation and should be operating the service.

Notwithstanding the provisions of the preceding paragraph, the Executive Branch in the corresponding Ramo, may increase by up to one hundred percent the aforementioned amounts as compensation for stabilizing the rate of public transit service passenger, inasmuch as it has the financial availability and according to the commitments made by the National Bureau of Transportation; as well as the fulfillment of commitments for the benefit of the user population.
Art. 2. The subjects referred to in Art. 10, third paragraph, of the Transitional Law for the Stabilization Rates Public Service Collective Passenger Transport contained in Legislative Decree No. 487 of 23 November 2007 published in the Official Gazette No. 222, Volume No. 377 of the 28th of that same month and year, they will have a period of one hundred eighty days from the publication of this Decree, to file an application to the Vice Ministry of Transportation, to effect of signing the respective concession contract.
Applications submitted must be accompanied by documents proving their borrowers quality public transport service.
The Vice Ministry of Transportation must sign on behalf of the State, the respective Concession Contracts, ten-year term, according to the Law on Land Transportation, Traffic and Road Safety not apply to this procedure as set out in the Act procurement of Public Administration.
Compensation for stabilizing the rate of public service collective passenger transport shall not be subject to payment of income tax.
Art. 3. extension, until 31 December 2013, the provisions of the Transitional Law for the Stabilization Rates Public Service Collective Passenger Transport, issued by Legislative Decree No. 487, dated 23 November 2007, published in the Official Gazette No. 222, Volume No. 377 dated 28 the same month and year, and its subsequent amendments, as well as the reform contained in this Decree.
Art. 4. This Decree shall enter into force from the day of its publication in the Official Journal.
