1 DECREE No. 247

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 329, dated April 15, 2010, published in the Journal official No. 76, Volume No. 387, 27 of the same year, authorized the Executive Branch in the Field of Finance, so that by the holder or the official designated by him, subscribe on behalf of the State and Government of the Republic of El Salvador a Loan Agreement with the Central American Bank for Economic Integration, BCIE, up to an amount of $ 143,433,870, resources for the implementation of the "Program for the Development of Social Infrastructure and Prevention Vulnerability";
II.- by Legislative Decree No. 370, dated May 27, 2010, published in the Official Gazette No. 107, Volume No. 387, June 9 the same year, it was approved in all its parts the Agreement BCIE loan No. 2015, signed with the Central American Bank for Economic Integration, for an amount of up to $ 143,433,870, to finance the implementation of the "Program for the Development of Social Infrastructure and Prevention Vulnerability" in the scope of which included the Ramo Environment and Natural Resources in the amount of $ 6,000,000 to carry out the 5102 project "Strengthening Program for Reducing Risk and Vulnerability Socio-environmental (BCIE 2015)" also assigning the amount of $ 780,000 from the General Fund Counterpart (VAT payment );
III.- That the Budget Law 2011, the Field of Environment and Natural Resources for $ 3,759,000 scheduled resources in order to finance the implementation of Project 5102 cited above, of which $ 3,330,000 corresponded to BCIE loan No. 2015 and $ 429,000 to the General Fund; of these resources the amount of $ 2,344,941 External Loan and $ 304.842 General Fund was incurred, leaving a balance of $ 1,109,217 unexecuted ($ 985.059 External Loan and $ 124.158 General Fund);
IV.- That the amount accrued in 2011, the institution requested $ 1,195,001 to provision of external loans and $ 155.350 of the General Fund; however, due to the breach of the obligations under the contract "Services imaging LIDAR and Photogrammetry for Production Models Digital Evaluation and Surface and Orthophotography" MARN he requested nullifying such provision, giving terminate its contractual relationship with the supplier on 18 June 2012;
V. That the Budget Act of 2012, passed by Legislative Decree 918, dated November 23, 2011, published in the Journal No. 236, Volume No. 393, of December 16 of the same year, was scheduled the complement of resources by $ 3,017,100, to finance the aforementioned Project 5102, whose

amount $ 2,670,000 for the balance available BCIE Loan No. 2015 and $ 347.100 General Counterpart Fund; also by Legislative Decree No. 132, dated September 20, 2012, published in the Official Gazette No. 186, Volume No. 397 of October 5 of that year, the amount was incorporated not executed in 2011 for $ 985.059, whose It return for $ 124.158 was financed with own assignments of the institution; and VI.-
That according to the Procurement Plan and Program Disbursements appeals by the institution, the deadline for the execution of the project is two years, estimated completion in the current fiscal year 2012; and in order to complete the external financing of that project 5102, it is necessary to incorporate the Budget Law in effect the amount of ONE MILLION ONE HUNDRED NINETY-FIVE THOUSAND ONE DOLLARS OF THE UNITED STATES OF AMERICA (US $ 1,195,001.00) financed by the Loan BCIE No. 2015.
THEREFORE,
in exercise of its constitutional powers and initiative of the President of the Republic, through the Minister of Finance, DECREES
:
Art. 1. In the current Budget Law, Section -A General State Budget, amendments listed below are inserted:
A) In Section II - INCOME, Item 31 Public Debt, Account 314 loan agreements external, 31404 increméntase the specific source multilateral organizations, as well:
Loan No. 2015, signed with the Central American Bank for Economic Integration (BCIE) to finance the partial implementation of the "Program for the Development of Social Infrastructure and Prevention Vulnerability "approved by Legislative Decree No. 370, dated May 27, 2010, published in the Official Gazette No. 107, Volume No. 387, June 9 of that year $ 1,195,001

B) In Section III - EXPENSES in the share Bouquet of Environment and Natural Resources, in paragraphs 3. Relationship with Allocated Resources and Purposes 4. Budget Allocation Heading Grouping, Funding Source and Destination economic, in the Budget Unit 05 Strengthening Program for Reducing Risks and Vulnerability Socioambiental, increméntase Line Working 01 Strengthening Program for Reducing Risks and Vulnerability Socioambiental, with the amount of $ 1,195,001 and in paragraph 5. List Public Investment projects, would increase the cost of the 5102 project "Strengthening Program for Reducing Risk and Vulnerability Socio-environmental (BCIE 2015)," with the same amount, thus:

Art. 2. This Decree shall enter into force from the day of its publication in the Official Journal.
