1 Decree No. 273 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the voting is a fundamental right established in article 72 of the Constitution of the Republic, which is the fundamental pillar that holds the principle of popular sovereignty established in articles 83 and 86 thereof, and consequently a requirement to realize the system of Government Republican, democratic and representative.
II. the exercise of the suffrage by citizens residing outside their country of origin, is a demonstration that increasingly takes hold around the world, especially in countries with high migrant mobilizations product of political, economic and social causes.
III.-that because of the significant and growing importance that they have acquired the communities of Salvadorans abroad and the need to guarantee the exercise of their political citizenship, better be has aroused interest inside and outside El Salvador, oriented to the Salvadorans living abroad to vote in the presidential election.
IV.-that in accordance to the previously exposed and convinced of the necessity and importance of providing the necessary means for the exercise of the franchise of the Salvadorans living abroad, is issuing a special for the execution of the same law.

DECREES the following: law special to the exercising of the vote from the outside in the elections presidential Art. 1.-create vote from abroad, with the object to the Salvadorians and the Salvadorans living outside the national territory, to exercise their right to active suffrage in electoral events to elect President and Vice President from the year 2014.
Article 2.-means resident abroad, to any citizen or Salvadoran citizen whose domicile is outside the national territory. For the purposes of this Act, home is accompanied by residence, real or presumptively, remain in her mood.
Article 3.-the implementation of the system of voting from abroad will be under the responsibility of the Supreme Electoral Tribunal, hereinafter "the Tribunal", which will be universally to all Salvadoran citizens resident outside the national territory.
Article 4.-to vote from abroad, the form will only be the postcard or voting by correspondence and is required: 1. possess document only of identity force with address of residence in outdoors. (1) 2. Be registered in voter registration and the electoral register of residents abroad.

Article 5.-the Court shall draw up, on the basis of voter registration, the voter registry of residents abroad, which hereinafter is referred to as an "Electoral Register".

3. IN ORDER TO EXERCISE THE VOTE FROM ABROAD, THE CITIZENS SHALL EXPRESS ITS UNEQUIVOCAL WILLINGNESS TO BE INCLUDED IN THE ELECTORAL ROLL, USING A SPECIAL FORM PROVIDED BY THE TRIBUNAL; ONE HUNDRED AND EIGHTY DAYS BEFORE THE ELECTORAL EVENT. (1) SHALL APPLY THE TERMS OF SUSPENSION AND DEFINITIVE CLOSURE OF VOTER REGISTRATION REGULATED IN ARTICLE 30 OF THE ELECTORAL CODE, EXCEPT THE CASE OF SALVADORANS RESIDENT ABROAD WHO ACQUIRE THE ADULT AGE IN THE PERIOD BETWEEN THE PERIOD OF SUSPENSION AND CLOSURE OF REGISTRATION TO VOTER REGISTRATION AND THE DAY OF THE VOTE, WHO WILL BE ENROLLED IN THE ELECTORAL REGISTER OF RESIDENTS ABROAD UP TO SIXTY DAYS PRIOR TO THE ELECTION , PROVIDED THAT SUCH PERSONS HAVE REQUESTED THEIR RESPECTIVE SINGLE DOCUMENT OF IDENTITY AND COMPLIED WITH THE REQUIREMENT STATED IN THE PARAGRAPH ABOVE, PRIOR TO SAID TERM OF SUSPENSION AND CLOSURE OF VOTER REGISTRATION. (1) article 6.-to confirm their inclusion in the electoral roll, the person concerned will manifest, by means of a form, their willingness to be included in it, for any of the following means: 1. personally at the time of the issuance, replacement, renewal or modification of your single document of identity abroad.

3. personally in the offices of the Court in El Salvador.
In the case of registration regulated in paragraph 1) of this provision, the Court, together with the national registry of natural persons, will establish the necessary procedures so that citizens resident abroad can register at the time of obtaining, by any of the procedures regulated in the law, its single document of identity abroad.

Article 9.-for updating, debugging and correction of the voter registry, it must be available to the citizens on the Web page of the Court and will follow the same rules that has the Electoral Code, within the deadlines of the electoral timetable approved by the Court.
Article 10.-in the period between the opening of the application process the electoral roll and the closing of the same term, when a Salvadoran person based abroad has been included on the electoral register and change their residence to another place, in that same period you must update your residence and address in the electoral roll; and when you change your residence to the national territory, it must request his disaffiliation of the same and make the necessary home modifications in the electoral register, to effect of voting in El Salvador.
Article 11.-electoral material sending and receiving the votes of Salvadoran citizens abroad shall be under the responsibility of the Court, for which it will create one Electoral Board's vote from abroad, on "JEVEX", and for scrutiny, many joints recipients of votes from abroad, on "JRVEX", may be necessary. Insofar as they are compatible with the particular nature of the vote from abroad, the JRVEX will attend the provisions of articles 50 and 53 of the Electoral Code, except in the conformation of the partial registers that will be up to 1500 voters each, which will be listed in alphabetical order to vote from abroad.
The JRVEX will be located in the capital of the Republic, at the polling place that has the Court.
Article 12.-the JEVEX will be integrated with a maximum of five owners members and their respective alternates; four of them a proposal from those political parties disputing who obtained the largest number of votes in the last election. The fifth will be chosen by lot from among other parties or coalitions participating in elections and shall be appointed by the Court. For the functioning and decision-making thereof, it will be necessary to have the majority of the 5 members; also, for integration, will need a minimum of three proprietary members and their respective alternates; in case there is no proposals of candidates to join the Board, the Court shall appoint persons deemed suitable for this purpose. 4 meet and resolve on any situation that interfere in the normal development of the voting process from the outside, and report complaints and irregularities which, in relation to the election process, submitted to the Court.
5. receive documentation and copies of the minutes of closing and scrutiny that give the joint recipients of votes and based on these, develop a preliminary general act of the scrutiny of the vote from abroad, which should deliver to the Court the original and one copy to each of the political parties or coalitions contenders at least eighteen hours after the close of voting. The non-delivery of the copy of the mentioned Act to political parties or coalitions contenders, shall be punished as provided under Article 280 of the Electoral Code.

Article 14.-the JRVEX will be integrated by a maximum number of five owners members and their respective alternates, appointed by the Court; four of them will participate with its own right, on the proposal of those political parties contending that have obtained the largest number of votes in the last election. The fifth will be chosen by lot from among the proposals from other parties or coalitions competing in the elections. The Court should be equitably distributed among the proposals the positions of President, Secretary, first vocal, Second Committee and third vocal, with an egalitarian allocation on each charge for each instance of the proponent. Such JRVEX may be integrated with a minimum of three proprietary members and their respective alternates. The powers of the JRVEX for the vote from abroad will be which are arranged in article 126 of the Electoral Code, as appropriate.

Article 19.-envelopes that are received after the day of the elections, will be reported by the delegates of the JEVEX and cancelled unopened for untimely; then they will be destroyed, all this in the presence of the delegates of each political party or coalition contender. Article 20.-ten in the morning of the day of the elections, the JRVEX will resume the session to receive the JEVEX votes sent from abroad and prepare the scrutiny that should start at five in the afternoon, time in which the vote means closed.
Article 21.-the members of the JRVEX, to resume its session on the election day, will receive the JEVEX celestial envelopes unopened, to check and sign the voter registry of the JRVEX, by signing and sealing the Secretary in the checkbox corresponding to each electoral person, with the legend "I voted", after which, will open the celestial outer envelope that will extract the removable tab to verify if the vote corresponds to the voter which was referred documentation, establishing that the signature of the voter actually matches the signature contained in the digital archive of the single identity document. Article 23.-minutes of closing and scrutiny of the JRVEX will be raised on forms provided by the Court, in a game consisting of an original sheet and their respective legible copies, whose number depends on the number of political parties and coalitions competing in the presidential election of that question, being these sheets distributed thus: the original to the Court; the first copy to the JEVEX; the second copy to the Office of the Attorney-General; and the subsequent to each political party or coalition contenders and the Electoral supervision Board.
Each set of proceedings will have their leaves in different colors to differentiate them, the original Act, the copy for the JEVEX, the copy for the Office of the Attorney-General and copies for the contenders and the Electoral supervision Board.
Copies intended for political parties or coalitions contenders will be distributed on, according to the order in which they have obtained the greatest number of votes at that election.
Where, by reason of the number of copies that must be generated, is required to produce more than one set of proceedings, the Court shall regulate such situation and decide on the mechanism of distribution of originals and copies, based on the priorities mentioned in the preceding paragraph.
The signatures and seals must be original; If some vigilante retire before the poll, will be on the same record.
The original Act which corresponds to the Court must be turned immediately after the count, without any objection, by the President of the JRVEX to the delegate that designated the Tribunal, who will transfer it immediately to the National Center of processing of election results; failure to do so will be punished for the crimes they have committed, regardless of the corresponding economic sanction that is done to creditors by omission, in accordance with article 277 of the Electoral Code which prescribes.

Article 24.-all related to appeals and nullity will be processed as stipulated in the Electoral Code, in which it is applicable.

Article 27.-in all matters not provided for in this law shall apply the provisions of the Electoral Code.
Article 28.-this Decree shall enter into force eight days after its publication in the official journal.
