1 index Legislative Decree No. 275 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that through Decree legislative No. 1027, dated 24 April 1997, published in the Official Journal No. 85, volume no. 335, 13 of may of that year, the Prisons Act was issued.
II. that pursuant to the Act, there will be a national Criminology Council, in order to determine the kinds of applicable treatments, according to individualized than the regional criminological councils cases subject to consideration and respect of incidents arising on the application of the criteria for location and classification of inmates within the progressive system that resolved.
III.-that the article 28 of the law in question has that the Council criminological national will be formed by a lawyer, a criminologist, a sociologist, a medical, a psychiatrist, a psychologist, a licensed in work Social and a licensed in Sciences of it education and will be chaired by a Director elected by them same between their members.
IV.-that nowadays in our country there is an institution of higher education that is providing the career of Criminology, so it is difficult to integrate the Council referred to in the previous recital, in the manner prescribed by this legal provision in its entirety.
V under the above, it is necessary to introduce the corresponding reform to article 28 of the law prison, in the sense that it can dispense with the criminologist in the integration of the National Criminology Council, without affecting the opinions and resolutions issued by the Council.
Therefore, in use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of Justice and public security, DECREED the following: reform to the law prison article 1.-added to article 28, a new subsection, in the following manner: "in the event that the criminological Council, at the time of set up does not have a criminologist such as the preceding paragraph indicates, the same will be integrated with before related professionals, and can take this resolutions, opinions and reports by a majority, which will have 2 legislative index its legal effects. The Directorate-General of penal centres shall ensure that at least every two years a process of selection of a public nature for the appointment of a criminologist develops in this Council."
Article 2.-this Decree shall enter into force eight days after its publication in the official journal.
