DECREE No. 335 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- Articles 32 and 33 of the Constitution provides that the family is the fundamental basis of society, which have the protection of the State and that the law shall regulate the personal relations of spouses between them and their children, establishing reciprocal rights and duties on an equitable basis.
II.- That pursuant to Article 36 of the Constitution, both parents have an equal obligation to provide their children with protection, assistance, education and security.
III.- That in many countries have established paternity leave, as a guarantee of the full exercise of fundamental rights of every child, especially to receive love, support and care from her father, in a climate conducive to achieving their full physical and emotional development.
IV.- That the interests of the child, claims that the father is present in the first hours after birth, so that from the beginning, received from both parents affective interactions that facilitate subsequent comprehensive development.
V.- That for the reasons stated, it is necessary to amend the Act Asuetos Licensing Holidays and Public Employees, establishing a three-day leave in case of birth or adoption, in favor of the father.
THEREFORE,
in exercise of its constitutional powers and initiative of Deputies Mario Alberto Guerrero Tenorio, Richard Geston Claros Reyes, Cesar Humberto Garcia Aguilera, Jose Wilfredo Guevara Diaz, Carlos Guzman Walter Coto, Wilfredo Iraheta Sanabria, Rafael Tobar Ricardo Morán, José Gabriel Murillo Duarte, Lorenzo Rivas Echeverria and Jose Francisco Zablah Safie; and with the support of MEPs Francisco Roberto Lorenzana Durán, Damian Joy, Yohalmo Edmundo Cabrera Chacon Blanca Noemi Coto Estrada, Carlos Cortez Hernández, Dario Alejandro Girls Argueta, Nery Arely Diaz de Rivera, Antonio Echeverria Veliz, Emma Julia Fabian Hernandez Santiago Flores Alfaro, Juan Manuel de Jesus Flores Cornejo, Norma Guevara, Estela Yanet Hernandez Rodriguez, Benito Antonio Lara Fernandez Hortensia Margarita Lopez Quintana, Audelia Guadalupe Lopez De Kleutgens, Guillermo Francisco Mata Bennett, Rodolfo Antonio Martinez, Misael Mejia Mejia Jose Melara Yanes Santos, yeymi Elizabett Morán Muñoz, Antonio Olivo Guillermo Mendez, Nelson Quintanilla Jesus Gomez, Jackeline Noemi Rivera Avalos, Sonia Margarita Rodríguez Siguenza, José Simón Paz, Ramon Aristides Valencia Arana and Jaime Valdes Gilberto Hernandez.
ENACTED THE FOLLOWING LAW REFORM AND LICENSES ASUETOS THE HOLIDAY public employees

Art. 1. hereby added a clause to Article 9 as follows:
"Every public employee, if paternity birth or adoption, shall be entitled to three working days leave, granted his choice from the birth day, continuously, or distributed within the first fifteen days from the date of birth. In the case of adoptive parents, the period shall run from the date on which the judgment becomes final adoption respectively. For the enjoyment of this license must be submitted birth certificate or certification of the judgment of adoption, as appropriate. "
Art. 2. This Decree shall enter into force eight days after its publication in the Official Journal.
