Legislative Assembly - Republic of EL SALVADOR index Legislative Decree N ° 435 the Assembly Legislative of the Republic of EL SALVA DOR, considering: i. that the branch of health records a deficit in medicines and medical supplies since the implementation of health reform, are currently with 692 units community of family health (UCSF) throughout the country categorized as basic UCSF, intermediate UCSF and UCSF specialized and also are running 517 community teams of health (ECOS), of which 481 are family, and 36 specialized, same that are distributed in 164 municipalities in the country, which has generated it is addressed to more than 1.8 million people directly (with consultation, preventive, curative and rehabilitation) resulting in a remarkable increase in the consumption of drugs and medical supplies to be able to give coverage to the population of the aforementioned municipalities; so it requires a budget boost in the amount of US$ 15,000,000.00 to the purchase of medicines for nationals of the country's 30 hospitals and health establishments distributed in the 5 regional directorates of health and US$ 10,000,000.00 in medical, reagents, supplies of laboratory and x-ray referral hospitals;
II. that by means of Decree legislative Nr. 164, dated October 18, 2012, published in the Diario official No. 196, volume no. 397, the 19th of the same month and year, is authorized to the Executive Body in the field of finance, issue securities up to the amount of eight hundred million of dollars of United States of AMERICA (US$ 800,000,000.00) , in order to cover the contingency of early redemption (right of the holder to exercise the put) which provides for the issuance of Eurobonds of El Salvador due 2023;
III. that the securities before referred to by value of eight hundred million of dollars of United States of AMERICA (US$ 800,000,000.00), they were placed in the international stock market November 28, 2012 and the proceeds of the sale was placed in the special account opened at the Bank Central of reservation of El Salvador, to do so the 5 of December of the same year;
IV. that in accordance with article 5, literally i), Legislative Decree No. 164 before designated, the funds collected by the issuance of securities values, must be used with priority over any destination to meet the demand for early redemption of Eurobonds of El Salvador due in 2023 and up to an amount of eight hundred million of dollars of United States of AMERICA (US$ 800,000,000.00);
Decree No. 435 2 V. That the date of expiry of the deadline for early redemption, was presented any holder of such Eurobonds; so according to the authorisation established in the literal ii) of the same article 5, proceeded to use of such funds for the payment of LLETS up to an amount of four hundred millions of dollars of United States of AMERICA (US$ 400,000,000.00);
VI. that in accordance with article 5, literal iii) and article 6 of the Decree legislative cited above, to refocus the four hundred millions of dollars of the United States of AMERICA (US$ 400,000,000.00) unused, as set out in the literal referrals i) and ii), in locations other than those determined in the Decree, must be authorized by the legislature and should be in accordance to the provisions of article 148 of the Constitution of the Republic;
VII. that by means of Decree legislative Nr. 340, date March 20, 2013, published in the Official Journal No. 57, volume no. 398 of the 22nd of the same month and year, are redirected from the unused funds, resources up to the amount of forty million of dollars of United States of AMERICA (US$ 40,000,000.00), to finance the extraordinary special budgets for the 2014 election event Residential voting and voting from abroad;
VIII. that by means of Decree legislative Nr. 365, date of April 25, 2013, published in the Official Journal No. 76, volume no. 399, of 26th of the same month and year, was adopted to reorient resources remaining from the placement of the securities, credit values, up to the amount of three hundred and sixty million of dollars of United States of AMERICA (US$ 360,000,000.00) , the amount of forty and five million of dollars from the United States of AMERICA (US$ 45,000,000.00), for the purpose of funding cover the payment of subsidy to the liquefied Gas in the months from July to September this fiscal year, as well as debt payment of the subsidy to the public transportation of passengers corresponding to the months of August to December 2012; In addition, authorized to the Executive Body in the field of finance to make use of such resources remaining, the amount of three hundred fifteen millions of dollars of United States of AMERICA (US$ 315,000,000.00) to honor commitments pending payment of letters of the treasure of the State of El Salvador, identified as LLETS;
IX. that by means of Decree legislative Nr. 380, date 23 May 2013, published in Official Journal No. 96, volume no. 399, of the 28th of the same month and year, was adopted refocus of the approved resources to honor the payment of LLETS, up to the amount of three hundred fifteen millions of dollars of United States of AMERICA (US$ 315,000,000.00) , the amount of seventy and three million five hundred forty and five thousand nine hundred dollars of the United States of AMERICA (US$ 73,545,900.00), in order to finance the deficit in operating expenses of different secretariats of the Decree No. 435 3 President of the Republic; the salaries and bonuses of 6,300 seats for the troop which supports the joint with PNC security areas, corresponding to the months of July to December/13; the acquisition of specialized equipment to strengthen public security actions and coverage of the payment of the subsidy to liquefied Gas from the months of October to December of the current fiscal year, leaving a balance available for LLETS payment in the amount of two hundred forty and a million four hundred fifty and four thousand one hundred dollars of the United States of AMERICA (US$ 241,454,100.00);
X that of the balance referred to in recital above, to date still resources are available up to a value of forty and a million five hundred thousand dollars of the United States of AMERICA (US$ 41,500,000.00); and at the same time, is required to meet the demand of the health sector, which has a character that is inescapable and urgent, since it is the drug supply in the amount of fifteen millions of dollars of United States of AMERICA (US$ 15,000,000.00), as well as medical supplies, in the amount of ten million of dollars of United States of AMERICA (US$ 10,000,000.00); so, it is necessary to reorient the fate of the remnants of the placement of the titles, credit values, to effect of adding section II - revenue of the law of budget, voted by means of Decree legislative Nr. 182, dated November 8, 2012, published in Official Journal No. 228, volume no. 397, on December 5 of the same year , the amount of twenty-five millions of dollars of United States of AMERICA (US$ 25,000,000.00); and section III costs, increases in the share of the health sector, the value of $15,000,000.00 in the 01 address budgetary unit and institutional management, line of work 03 management technical regulations, item 54 acquisitions of goods and services and $10,000,000.00 in the budgetary unit 04 support for affiliated institutions, and other entities, item 56 transfers currents by which resources are allocated to hospitals.
Therefore, in use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of finance, DECREES: article 1. In the current budget law, section – A General State budget, the following modifications are introduced: a. section II - revenue, item 31 borrowing public, has 312 placements of securities values in the external market, increase the specified source 31201 State bonds with a value of $25,000,000.00.
