DECREE No. 447 THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 725, dated September 30, 1999 published in the Official Journal No.208, No.345 Tomo, November 9 of that year, the Framework on Enforcement of Financial Aid and Technical and Economic Cooperation in El Salvador ratified Convention under Regulation "ALA" between the Government of the Republic of El Salvador and the European Community.
II.- Art. 3 of the Framework Convention aforementioned states that any cooperation project selected by the Commission can lead to a specific financing agreement between the Commission, acting on behalf of the European Community and the Government of the Republic of El Salvador authorities or public bodies.
III.- That on November 25, 2009, the Ministry of Education signed with the European Community, the Financing Agreement No. DCI-ALA / 2009 / 020-152 for the implementation of the program "Strengthening Cohesion social in the Educational Sector of El Salvador (Pro-EDUCA) ", for an amount of € 25,000,000 Euros, equivalent to US $ 34.44 million estimated at the exchange rate of US $ 1.3776, of which € 23,000,000 Euros, equivalent to US $ 31,684,800 will be allocated to finance development environments safe living in 100 schools, provision of mobile stations laptops, teacher training, curriculum development, infrastructure maintenance and equipment of workshops and laboratories of National Institutes and € 2,000,000 Euros, equivalent to US $ 2,755,200 for technical assistance, with a duration of 72 months from the entry into force of the Convention.
IV.- That the value of $ 31,684,800 above was programmed in the Budget Act of 2010 Branch of Education, an amount of US $ 6,199,200, of which I said Ramo executed the amount of US $ 3,187,228, leaving a balance of US $ 3,011,972; Also, in 2011 resources amounting to US $ 12,929,450 which included the balance of the previous year, of which US $ 10,092,079 was accrued were assigned, reflecting the end of the year an available US $ 2,837,371 that were not implemented due to various processes tenders They were declared void.
V. That the Budget Act of 2012, the value of US $ 12,578,851, which included the value of US $ 2,837,371 not executed in 2011, of which the amount of US $ 9,496,121 was incurred, running out the scheduled run amount of US $ 3,082,730, of such availability, only scheduled in the Budget Act current value of US $ 1,725,100 leaving a surplus of $ 1,357,630.


2 VI.- That, as indicated in the previous paragraphs, the amount of US $ 31,684,800, the Field of Education has implemented to date a total of $ 22,775,428; if this amount is added the value of $ 1,725,100 set in the Budget Law 2013 of the bouquet and $ 336.226 which will not be disbursed by the European Community, the Convention reflects an available balance of US $ 6,848,046, which is requested to incorporate this time only the value of $ 1,021,404, in order to have the budgetary allocation necessary to continue the processes within the framework of the implementation of the Public Investment Project 5268 program "Strengthening Social Cohesion in the Educational Sector of El Salvador (Pro- EDUCA).
VII.- That in order that the bouquet of Education budget allocation available to continue the implementation of the program in question, it is necessary to reform the current Budget Law, approved by Legislative Decree No. 182, dated 8 November 2012, published in the Official Gazette No. 228, Volume No. 397, of December 5 of that year, in order to incorporate in allocations of income and expenses, the amount of oNE MILLION TWENTY THOUSAND, FOUR HUNDRED FOUR DOLLARS UNITED STATES oF AMERICA (US $ 1,021,404) from the said agreement.
THEREFORE,
in exercise of its constitutional powers and initiative of the President of the Republic, through the Minister of Finance,
DECREES: Art. 1. In the current Budget Law, Section -A General State budget, introdúcense
modifications indicated below:
