1 Decree No. 451 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that according to the Constitution, it is the duty of the State to protect natural resources, as well as the diversity and integrity of the environment, to ensure sustainable development.
II.-in order to make effective the protection established in the previous recital, the same Constitution provides for the protection, conservation, rational use, restoration or replacement of natural resources are declared to be of social interest.
III. that in order to make effective the previous postulates, was issued the criminal code by Decree legislative number 1030, dated April 26, 1997, published in the journal official No. 105, vol. No. 335 of 10 June of the same year, which was established in Title X on offences relating to the management of the territory , protection of natural resources and the environment.
IV. Chapter II of title mentioned in the previous recital, establishing crimes relating to nature and the environment, contemplating a series of offences, including predation of wildlife, which in recent years has increased this. So, it is appropriate to increase the term of imprisonment and in addition, impose penalties accessory.
Therefore, use of his constitutional powers and at the initiative of MEPs: Roberto José d'Aubuisson Munguia, Irma Lourdes Vasquez Palacios, Francisco José Zablah Safie, Nery Arely Díaz de Rivera, Adelmo Rivas Rivas Santos and Ciro Alexis Zepeda Menjívar.
DECREES, following reform to the code PENAL Art. 1.-reforming article 260, as follows: "depredation of Wildlife Art. 260.-which used for hunting or fishing, poison, explosive media or other instruments or arts generate a similar destructive efficiency, shall be punished with imprisonment from two to four years.
The same penalty will incur persons carrying out fishing activities within the three maritime miles, counted since the lower tide line on industrial boats.

2. in both cases, if the person any licence or registration for hunting or fishing, also the penalty of cancellation of the licence or registration shall be imposed by the same time of the main penalty."
Article 2.-this Decree shall enter into force eight days after its publication in the official journal.
