1. Decree No. 442 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that through Decree legislative Nr. 329, dated April 15, 2010, published in the Official Journal No. 76, volume no. 387, the 27th of the same month and year, is authorized to the Executive Body in the field of finance, so that by means of the holder or representative which he designated it signed on behalf of the State and Government of the Republic of the Salvador, a loan agreement with the Central American Bank for economic integration, CABEI, up to an amount of $143,433,870, resources allocated to the implementation of the "programme for the development of infrastructure Social and prevention of vulnerability";
II. that by means of Decree legislative Nr. 370, dated May 27, 2010, published in Official Journal No. 107, volume no. 387 on 9 June of the same year, was adopted in all its parts the BCIE No. 2015 loan contract, signed on 4 May 2010, between the Government of the Republic of El Salvador and the Central American Bank for economic integration , for an amount of up to US$ 143,433,870, to finance the implementation of the "programme for the development of infrastructure Social and prevention of vulnerability", whose scope included the field of environment and natural resources, with an amount of $6,000,000 so it will hold the 5102 project "Program of strengthening for the reduction of risks and vulnerability socio-environmental", assigning in addition the amount of $780,000 from the General Fund for the payment of compensation (payment of VAT);
III.-that the 2011 budget law, the field of environmental and natural resources programmed the BCIE No. 2015 loan, for an amount of $3,330,000 with the purpose of funding the implementation of the aforementioned project 5102; funds, the industry devengó the amount of $2,344,941, leaving a balance without running of $985,059; However, the amount accrued, MARN requested provision $1,201,080, but due to the breach of the contract of one of the companies that offered their services within the framework of the programme 5102, provision of resources, was left without effect by the end of the year was only recorded an accrual of $1,143,861 of the external loan;
IV.-that the budget law for the year 2012, the complement of the BCIE No. 2015 loan resources was programmed by $2,670,000; also, by means of legislative decrees numbers 132, dated September 20, 2012, published in Official Journal No. 186, volume no. 397, on 5 October of the same year and 247, dated December 19, 2012, published in Official Journal No. 239, volume no. 397, the 20th of the same month and year, amounts were not executed and based on the provisions in the year 2011 of the referred BCIE loan by $985,059 and $1,195,001 2 respectively, making a total of $4,850,060; However, at the end of the year only devengó an amount of $1,894,805 of the external loan;
V that loan no. 2015 signed with the Central American Bank for economic integration to date presents an available balance in the amount of $2,961,334, which corresponds to the amount not executed during the period 2012 by $2,955,255 and the rest of the resources not provisioned in 2011 by $6,079,los which are necessary for the execution this year of 2013 , strengthening program for the reduction of risks and Socio-environmental vulnerability;
VI.-in order to facilitate the use of the funds through the field of environment and natural resources to complete the financing of the project 5102 "Program of strengthening for the reduction of risks and vulnerability socio-environmental", makes necessary to amend the existing budget law in section II - revenue, item 31 public debt, account 314 recruitment of external borrowing , increasing supply specific 31404 agencies multilateral, with the amount of two million twentieth century sixty and a thousand three hundred thirty and four dollars of the United States of AMERICA (US$ 2,961,334) and in section III - expenses, in the part corresponding to the field of environment and natural resources, incorporating the unit budget 08 program of strengthening for the reduction of risks and environmental vulnerability and the line of work 01 programme of strengthening for the reduction of risks and social and environmental vulnerability, with the amount of two million twentieth century sixty and a thousand three hundred thirty and four dollars of the United States of AMERICA (US$ 2,961,334). Also, is added the relationship purposes with assigned resources, budgetary allocation by group category, source of funding and economic destination and modifies the list of projects of public investment, incorporating the draft code 5102 "Program of strengthening for the reduction of risks and vulnerability socio-environmental" (BCIE 2015).
