DECEMBER No. 491

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- In accordance with Art. 131, ordinal 11th of the Constitution, is empowered by this Legislative Assembly to decree, in general, tax or any benefits and incentives for the promotion of cultural, scientific, agricultural, industrial or other activities.

II.- Let Art. 35 first paragraph of the Constitution of the Republic states that, “The State shall protect the physical, mental and moral health of minors, and shall guarantee the right of minors to education and to assistance”; likewise, the Comprehensive Special Law for a Life Free of Violence for Women establishes in its Art. 5, that “...every form of discrimination is prohibited, understood as any distinction, exclusion, restriction or arbitrary differentiation based on sex, age, sexual identity, family status, rural or urban origin, ethnicity, economic status, nationality, religion or belief, physical, psychic or sensory disability, or any similar cause, whether it comes from the State, its agents or individuals.”

III.- That the General Assembly of the United Nations, at its 89th Plenary Session, declared, through its “Resolution 66/170”, dated 19 December 2011, on 11 October of each year as the “International Day of the Girl Child”, in recognition of the rights of girls and the exceptional challenges they face around the world, urging all member States, civil society organizations and agents of the private sector to help girls

IV.- That in our country, although it is true, there have been significant progress in the recognition of the rights of girls and women, there are still many girls who, due to cultural patterns and erroneous stereotypes, are still deprived of the right to education, becoming victims of crimes such as trafficking in persons, forced labour, child marriage and slavery, among others; on the basis of which, it becomes imperative that the State ensure the effective fulfilment of their rights, ensuring that girls enjoy their moral development.

V.- That in view of the above, it is important that in accordance with the international declaration of the “Day of the Girl Child”, El Salvador can count on a “National Day of the Girl Child”, in recognition of the rights of this vulnerable sector of our society, where the population in general, as well as public institutions,

and civil society, they can raise awareness of the importance of respect for the rights of girls.

RIGHT:

Art. 1.- Decline on 11 October every year as “NATIONAL DAY OF THE CHILD”, in recognition of the rights of girls and the exceptional challenges they face around the world.

Art. 2.- This decree shall enter into force eight days after its publication in the Official Gazette.
