THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- In accordance with Art. 16 of the Law on the Production, Industrialization and Commercialization of the Azucarera Agro-industry of El Salvador, the annual budget of expenses and investments of the Salvadoran Council of the Azucarera Agro-industry, will be financed with a contribution to be provided by the producers of cane and sugar mills or ingenuities, per pound of sugar extracted, which will be established by the Legislative Assembly, on the proposal of the Ministry of Finance.

II.- That by Legislative Decree No. 396, dated 13 June 2013, published in Official Gazette No. 116, Volume No. 399, of 26 of the same month and year, was established at US$0.000338, the contribution to be made by producers of cane and sugar mills or ingenuities, per pound of sugar extracted during the 2012/2013 harvest, which was estimated at 1,648,165,680 pounds.

III.- That through Legislative Decree No. 482, dated 13 September 2013, published in Official Gazette No. 176, Volume No. 400, of 24 of the same month and year, approved the Special Budget of the Salvadoran Council of the Azucarera Agro-industry, CONSAA, for fiscal year 2013, for the amount of $797,080, of which $557,080 are financed with the contribution of the cashew sector and the difference of $24.

IV.- That according to Note DGT-DEX-380-2013, dated 10 July 2013, the General Treasury Directorate certifies that in Account No. 600-060 MINEC-CONSAA, a available balance of previous years is recorded for a total amount of $307,291.29, which corresponds to surplus in the collection of contributions of the producers of cane and the sugar mills or ingenuities, for which the Credit was not extracted,

V.- That for the purpose that CONSAA can make use of such balances to supplement the operating expenses and to carry out national projects and programmes of benefit for the producers of cane, sugar mills or ingenuities of the country, it is necessary to amend the current Budget Law of 2013, in sub-paragraph II- Income, with the amount of TRESCIENTS SIETE MIL DOSCIENTS NOVENTA AND ONE 00/100 DOLARES OF THE UNITED STATES OF AMERICA ($307,291); and in Apartament III- Expenditures, in the part of the Economics Branch, increase the budget allocations of the Budget Unit 07 Support to Applied Institutions, with the amount of TRESCIENTS SIETE MIL DOORS AND ONE 00/100 DOLARES OF THE UNITED STATES OF AMERICA ($307,291); and, in turn, in section B

Special Budgets, B.1- Non-Business Decentralized Institutions, the Special Budget of the Salvadoran Council of the Azucarera Agro-Industry is modified, increasing the share of Income and Expenses with the same amount and Source of Financing.

TANTO,

in the use of its constitutional powers and at the initiative of the President of the Republic, through the Minister of Finance,

RIGHT:

Art. 1.- The current Budget Act introduces the following modifications:

(1) In Section -A General State Budget:

A) In Part II – INGRESOS, Book 41 – Income by Special Contributions, Account 411–Contributions to Special Products, the specific 41102 is increased – Contribution for Extra Sugar Libra, with the amount of $307,291.

B) In Apartado III –GASTOS, in the part corresponding to the Economy Ramo, Tax Unit 07 Support to Applied Institutions, encreméntase la Line de Trabajo 08 Consejo Salvadoreño de la Agroindustria Azucarera, con la cantidad de $307,291, así:

Art. 2.- This Decree shall enter into force on the day of its publication in the Official Gazette.
